Councilmen Byork, Green, Higgins, Morris and Rowe answered the roll call. ..~,~ Also present were City Attorney Murphy and City Manager Valliere. The meeting was adjourned to executive session for matters of litigation. Following the executive session, it was moved by Councilman Morris, seconded by Councilman Byork, and carried, that the meeting be adjourned. { ,. ~~City ler , City of Lynwood APPROVED APRIL 5,i1~977 r, City of Lynwood ~ 57 REGULAR MEETING MARCH 15, 1977 The City Council of the City of Lynwood met in a regular session in the City Hall, 11330 Bullis Road, on above date at 7:30 p.m. Mayor Rowe in the chair. Councilmen Byork, Green, Higgins, Morris and Rowe answered the roll call. Also present were City Attorney Murphy and City Manager Valliere. COUNCIL REORGANIZATION It was moved by Councilman Byork, seconded by Councilman Morris, and carried, that the meeting be turned over to the City Clerk or the City Manager for the purpose of reorganization of the Council. Councilman Morris read RESOLUTION N0. 76-26 concerning reduction in costs of city government and stated that in view of the Cityts problems and in the interest of continuity, he nominated Councilman Rowe to continue as Mayor. Councilman Byork nominated Councilman Green for Mayor. It was moved by Councilman Morris, seconded by Councilman Higgins, and carried, that nominations be closed. ~-- The following votes were cast Councilman Byork: Councilman Councilman Green; Councilman Councilman Morris: Councilman Councilman Rowe. Mayor Rowe asked for nominations for the office of Mayor Pro Tempore. Councilman Morris nominated Councilman Higgins. Councilman Green nominated Councilman Byork. Councilman Byork declined the nomination. It was moved by Councilman Morris, seconded by Councilman Higgins, that the nominations be closed. Roll Call: Ayes: Councilmen Higgins, Morris, Rowe. Noes: Councilman Green. Abstaining: Councilman Byork. Absent: None. for the office of Mayor: Mayor Rowe Green; Councilman Green: re.-elected Higgins: Councilman Rowe; Rowe; Councilman Rowe: It was moved by Councilman Higgins, seconded by Councilman Morris, and carried, that the minutes of the adjourned regular meeting of March 1, 1977 and the regular meeting of March 1, 1977 be approved as written. Coun.Higgins re-elected Mayor Pro Tempore ~i MANAGEMENT STUDIES AND REPORTS Genl. Liability A report was presented by the City Manager on the policy with City's general liability insurance coverage with Star Ins. Co. Star Insurance Company which has been cancelled cancelled effective March 16, 1977 because of the company's 3/16/77 insolvency . Mr. R. J. Syfritt of R. J. Syfritt and Associates addressed the Council to inform them that he has ' `' been successful in obtaining coverage to replace the Star Insurance Company policy and presented a binder with Lloyd's of London for the Council's consideration. He stated that the premium for the coverage is being negotiated and estimated that the cost would be approximately $80,000 including the Police Department and $50,000 to $60,000 without the Police Department. Lloyd's of London There followed a discussion of the circumstances binder app'd surrounding the bankruptcy of Star Insurance Company and at the request of the City Attorney, it was moved by Councilman Morris, seconded by Councilman Byork, and carried, that the meeting adjourn to executive session for discussion of possible litigation. Following the executive session, the meeting was called to order. The City Manager reviewed the situation commenting that the proposed coverage by Lloyd's of London for approximately $80,000 annually is preferred to self-insurance and that the City would like to exercise the binder; that Mr. Syfritt will complete negotiations with Lloyd's of London within approximately two weeks when the actual cost will be known and in the meantime, he will continue to seek a domestic carrier. If can- cellation with Lloyd's of London is desired before the 30-day binder period expires, the City may do so and then pay a pro rata share, plus 10~ penalty, or approximately $7,500. Mr. Syfritt stated that the Manager's review of the situation was substantially correct and that he would continue to seek a domestic carrier. A report on the request from Paul Martinez for permission to re-rent State-owned property at 11696 Atlantic Avenue was presented by the City Manager, Mr. Martinez who presently operates an auto body and paint shop on Wright Road was present to explain how he intends to conduct business at the Atlantic Avenue address. It was moved by Councilman Green, seconded by Councilman Morris, that the request be granted with the 2~9 understanding that all work will be conducted within trYe building, that no more than 6 cars will be stored outs~.de the building at any one time and there will be no storage of cars on Atlantic Avenue, Fernwood Avenue, the ad,~acent alley or any other public right-of-way adjacent to the property. A report on the five year General Services Agreement currently in effect between the City of Lynwood and the County of Los Angeles was presented by the City Manager. The agreement will expire on June 30, 19770 Tt was moved by Councilman Higgins, seconded by Councilman Byork, that the agreement be renewed and the Mayor be authorized to ez~.ecute the agreement on behalf of the City. The result of bids received for furnishing the City with 800 water meters was presented by the City Manager with the recommendation that the low bid of Hersey Products Inc. be accepted at the total bid price of $23,744. It was moved by Councilman Higgins, seconded by Councilman Morris, that the Council concur in the recommendation. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: Nane. Absent: None, A report on completion of plans and specifications for concrete ramps for the physically handicapped (Gas Tax Project Noe 7-150-202) was presented by the City Manager with the recommendation that the Council approve the plans and specifications and authorize a call for bids to be received on April 6, 1977 at 2 p.m. It was move3 by Councilman Byork, seconded by Councilman Higgins, ghat the Council concur in the recommendationo Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. The City Manager^ reported that pursuant to a survey by the Public Works Department and recommendation of the Traffic and Parking Commission, it is recommended that parking on Virginia Avenue, between Long Beach Boulevard and Longvale be prohibited at all times on the north side of the street. It was recommended that the restriction be authorized by adoption of RESOLUTION N0. 77-22 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING RESOLUTION N0. 67-9 DESIGNATING CERTAIN STREETS WHEREIN PARKING IS PROHIBITED AT ALL TIMES." It was moved by Councilman Morris, seconded by Councilman Byork, that Resolution No. 77-22 be adopted. Absent: Noneo Public Hearing The City Manager presented a report on the 4/5/77 on proposed proposed reconstruction of State Street (Gas reconstruction of Tax Pro,j ect No . 6-150-203 ) and recommended that State Street the Council authorize a hearing on the prod ect on April 5, 1977 at 730 p.m. It was moved by Councilman Green, seconded by Councilman Higgins, and carried, that the Council concur in the recommendation. Res.No. 77-23 The local agency-State of California Agreement Auth.execution No. 10, Program Supplement No. 2, for State of agrt. for Street Improvement ( Gas Tax Pro,j ect No . State St. ima:~~vt. 6-150-203) was presented for Council's consideration. Execution of the agreement will permit a claim for reimbursement of an estimated $4,200 incurred by the City in preparation of Negative Declarata_an Reports and preliminary engineering f°or the project. The City Manager recommended that the agreement be authorized by adoption of RESOLUTION N0. 77-23 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING EXECUTION OF LOCAL AGENCY- STATE AGREEMENT N0. 10, PROGRAM SUPPLEMENT N0. 2, FOR THE IMPROVEMENT OF STATE STREET." Bid call auth. - A report on specifications for repowering and Repowering and repainting Fire Engine No. 31 was presented with repainting of the recommendation that the Council approve the Engine No. 31 specifications and authorize a Ball for bids to be received on April 15, 1977 at 2 p.m. It was moved by Councilman Higgins, seconded by Councilman Morris, and carried, that the Council concur in the recommendation. RESOLUTION Res.No. 77-24 The City Manager reported on the desirability Auth. FINANCE REPORT RESOLUTION N0. 77-25 entitled: "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND APPROVING THE DEMANDS PRESENTED AND ORDERING WARRANTS DRAWN THEREFOR." was presented. It was moved by Councilman Byork, seconded by Councilman Morris, that Resolution No. 77-25 be adopted. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. The Mayor declared a five-minute recess. Following the recess, the meeting was called to order. CITY CLERK'S AGENDA Res.No. 77-25 Demands Feces It was moved by Councilman Green, seconded by ISKCON request Councilman Higgins, and carried, that the application for permit from ISKCON (International Society for Krishna denied Consciousness) for a permit to solicit funds from March 20, 1977 to March 20, 1978 be denied. It was moved by Councilman Byork, seconded by Councilman Higgins, and carried, that the application from the Criminal Justice Coordinating Council, '; Compton Judicial District, for a permit to solicit funds from April to December, 1977, be tabled pending receipt of further information. It was moved by Councilman Higgins, seconded by Councilman Green, and carried, that the Council approve the request from the Greater Long Beach Girl Scout Council for permission to conduct cookie and calendar sales from March ~1 through March 21 and November 18 through December 10, 1977, respectively. It was moved by Councilman Morris, seconded by Councilman Green, and carried, that the Council approve the application of Bert Hardison for a special permit to conduct a used T.V. Sales business at 11213 Atlantic Avenue. COUNCIL AGENDA Councilman Green asked what can be done in response to a complaint he has received concerning loud music from radios and other devices. TI~e ""~` City Attorney informed him that the noise ordin- ance can be enforced with the aid of decibel level readings and although the City has no meter, the use of one is available to the City through the County of Los Angeles. Green re Councilman Green questioned the City Manager about Sheriff's study the timing of the Sheriff's study. The anticipated schedule of events was outlined by the City Manager, Coun. Byork re Councilman Byork questioned Mr. Andrew Swan about tree removal, " removal of Mr. Charles Garvey's tree. Mr Swan block watch" . informed him that he has been in touch with signs Mr. Garvey as to what the City will do. ! Councilman Byork also inquired about the "block watch" signs he had requested at the previous meeting and Mr. Swan described the signs which were designed by a Lynwood resident and which are currently on order. PUBLIC BUSINESS FROM THE FLOOR D. Richman Mr. Dave Richman, 11106-B Benwell Drive, addressed the Council to read a letter he had received from the Mayor of the City of Commerce. P• Meyers re Mrs. Peggy Meyers, 5164 Century Boulevard civil service , addressed the Council to review the various civil ordinances service ordinances and to state that the current ordinance prohibits transfer of police services to the Sheriff's Department. S. Warvi re Mrs. Star Warvi, 11045 Pine Street, invited the breakfast on Council to be present at the March 30, 1977 fund- 3/30/77 raising breakfast at Stop's Restaurant being co-sponsored by the March of Dimes and the Lynwood Women's Club. Rev. J. Edner Rev. James Edner addressed the Council to direct questions to the Mayor concerning his stand on matters affecting the community.
