Councilmen Byork, Green, Higgins, Morris and Rowe answered the roll call. ~11so present were City Attorney Murphy and City Manager Valliere. It was moved by Councilman Morris, seconded by Councilman Higgins, and carried, that the meeting adjourn to executive session for personnel matters. Councilmen Byork, Green, Higgins, Morris and Rowe answered the roll call. Also present were City Attorney Murphy and City Manager Valliere. It was moved by Councilman Higgins, seconded by Councilman Morris, and carried, that the minutes of the adjourned regular meeting of May 17, 1977, the regular meeting of May 17, 1977 and the special meeting of May 23, 1977 be approved as written. PUBLIC HEARING Pub1iG Hearing- The Mayor announced that the time had arrived for Alley Vacation continuation of the public hearing on the. proposed vacation of the portion of the first alley east of Long Beach Boulevard between Beechwood Avenue and Sanborn Avenue adjacent to the Lynwood main Post Office as requested by the U. S. Postal Service for the purpose of expansion and improvement of the postal facility. The City Manager presented a report on the proposed vacation which indicated the results of notices sent to the property owners and tenants in the area. The Mayor inquired if anyone wished to speak in opposition to the proposal. There was no response. The Mayor inquired if anyone wished to speak in favor of the proposed vacation. Mr. Gerald McGinnis, Postmaster, spoke in favor of the alley vacation. As there were no others wishing to be heard, the Mayor closed the hearing. Res.No. 77-45 RESOLUTION N0. 77-45 entitled: "A RESOLUTION OF Vacation of Alley THE CITY COUNCIL OF THE CITY OF LYNWOOD ORDERING east of Long Bch. VACATION OF PUBLIC RIGHT-OF-WAY, ALLEY EAST OF Blvd & south of LONG BEACH BOULEVARD AND SOUTH OF BEECHWOOD AVENUE." Beechwood was presented. It was moved by Councilman Higgins, seconded by Councilman Morris, that Resolution No. 77-45 be adopted. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. MANAGEMENT STUDIES AND REPORTS A report on bids received for facility modifications at the Lynwood Sheriff's Station was presented by the City Manager with the recommendation that the low bids be accepted as follows: ~~ 1. Security Fencing, Quality Fence Company, $6,236. 2. Gasoline and Lubricating Facility, McAlpine Construction, Inc., $65,677. 3. Metal Lockers and Benches, Lyon Metal Products, $12,192. Councilman Green questioned the method of notifying prospective bidders and was informed that direct contact with bidders had been made in addition to newspaper advertising of the call for bids. Tt was moved by Councilman Morris, seconded by Councilman Higgins, that the bid of Quality Fence Company be accepted in the amount of $6,236. Roll Call: Ayes: Councilmen Byork, Higgins, Morris, Rowe. Noes: Councilman Green. Absent: None. It was moved by Councilman Higgins, seconded by Councilman Morris, that the low bid of McAlpine. Construction, Inc. be accepted in the amount of $65,677. Roll Call: Ayes: Councilmen Byork, Higgins, Morris, Rowe. Noes: Councilman Green. Absent: None. It was moved by Councilman Higgins, seconded by Councilman Morris, that the low bid of Lyon Metal ,,,,_, Products be accepted in the amount of $12,192. Councilman Green asked if an environmental study has been done on the remodeling project and he was informed that an environmental evaluation has been made and a negative declaration has been filed with the appropriate agencies as required by law. A request for authorization to declare certain pieces of equipment surplus and to cause its disposition was presented by the City Manager. It was moved by Councilman Morris, seconded by Councilman Higgins, that the equipment be declared surplus and its disposition be authorized. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. The City Manager presented a report on the request of Mr. Albert P. Powers, 10922 Colyer Avenue, for .-- removal of a damaged parkway tree which has damaged the sidewalk curb and gutter which has resulted in a drainage problem. The request was accompanied by the required environmental impact report. It was moved by Councilman Byork, seconded by Councilman Higgins, and carried, that removal of the tree be approved. Absent: None. ~~~,_ The City Manager presented a report on 1876 Federal Highway Act Funds for the Safer Off-System Road Project (SOS) and recommended that the Council approve the federal apportionment formula by adoption of RESOLUTION N0. 77-48 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AP~'ROVING THE FEDERAL APPORTIONMENT FORMULA FOR DISTRIBUTION OF THE SAFER OFF-SYSTEM ROAD PROGRAM FUNDS." A report on a proposed water conservation program, together with the monthly water consumption report, was presented by the City Manager. It was moved by Councilman Byork, seconded by Councilman Higgins, that the report be accepted and filed and that the staff be authorized to publicize the water conserva- tion needs. A report on adjustment and settlement of claims against the City was presented by the City Manager with the recommendation that RESOLUTION N0. 77-49 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, AUTHORIZING THE ADJUSTMENT AND SETTLEMENT OF CLAIMS AGAINST THE CITY." ,,,~, be adopted. The City Manager presented a report on the proposed agreement with Transworld Accounts, Inc, for collec- tion of delinquent accounts receivable and recommended Council approval of the collection service agreement. Absent: None. A report on establishing the practice of paying employees for fury duty as recommended by the Personnel Board was presented by the City Manager. The City Attorney informed the License Fees Council that it is desirable that the delinquency date of August 1st be established to coincide with the delinquency date established by other cities served by the Southeast Area Animal Control Authority in order to avoid an additional charge for reprogramming the computer to provide a different date for Lynwood. It was moved by Councilman Higgins, seconded by Councilman Morris, and carried, that the ordinance be read by title only. A report on disposition of 4.5 Transportation Fund 4.,~ Transporta- by the County Transportation Commission was ~, Fund Rept. presented by the City Manager. It was recommended that the Council join other cities affected by the Commission's decision and go on record asking the Transportation Commission to reconsider the intent of the State Legislature in establishing the 4.5 application fundjng procedure. It was moved by Councilman Morris, seconded by Councilman Higgins, that the Council concur in the recommendation of the City Manager and join the other cities in requesting reconsideration. Councilman Byork suggested that such an invitation be extended to Judge Ricks. Council:r~an Higgins commended the Fire Department for the handling of a mayor fire involving a State-owned building located within the freeway right-of-way.. The problem of obtaining an engineering certification on the integrity of a State-owned building following such an occurrence was discussed with Fire Chief Johnson. It was moved by Councilman Byork, seconded by Councilman Morris, and carried, that the State be requested not to re-rent property and not to allow the occupancy of property re-rented where the property does not conform to current provisions of the Uniform Fire Code and Uniform Building Code. Councilman Byork commented on a recent magazine article concerning use of old automobile tires, and the City Manager informed him that the information had been passed along to the Desser Tire Company.
