'{~i' ADJOURNED REGULAR MEETING AUGUST 2, 1877 The City Council of the City of Lynwood met in an adjourned regular session in the City Hall, 11330 Bullis Road, on above date at 7 p.m. Mayor Rowe in the chair. Councilmen Byork, Green, Higgins, Morris and Rowe answered the roll call. Also present were City Attorney Murphy and City Manager Valliere. At the request of the City Attorney, it was moved by Councilman Morris, seconded by Councilman Higgins, and carried, that the meeting adjourn to executive session for discussion of matters of litigation. Following the executive session, the meeting was called to order and it was moved by Councilman Morris, seconded by Councilman Byork, and carried, that the meeting adjourn. Councilmen Byork, Green, Higgins, Morris and Rowe answered the roll call. ,,.,_ Also present were City Attorney Murphy and City Manager Valliere. It was moved by Councilman Morris, seconded by Councilman Green, and carried, that the minutes of the adjourned regular meeting of July lg, 1977 and the regular meeting of July lg, 1977 be approved as written. Councilman Byork displayed a copy of the July 27, 1977 issue of the LYNWOOD JOURNAL and took exception to the article concerning the sale of city property to the Ryan Outdoor Advertising Company. Councilman Byork read a statement concerning the article and said copies would be available for the press. Councilman Green also commented on the article and demanded that there be an investigation. At the request of Mr. William Cunningham, Councilmen Higgins, Morris and Rowe commented on the news article and expressed the view that there had been no wrongdoing by Councilmen Byork and Green. After discussing with the City Attorney investigative steps that could be taken, it was moved by Councilman Green, seconded by Councilman Morris, that the District Attorney and Board of Supervisors be asked to cause a complete investiga- °^ tion of the Ryan situation and who was involved in it. PUBLIC HEARINGS The Mayor announced that the time had arrived for public hearing to ascertain whether nuisances are being main- tained on property commonly known as 11700, 11704, 11710, 11760 Wright Road and 5510, 5536, 5580 Willard Lane and Southern Pacific Railroad. The City Manager presented a report reviewing actions taken by the Building and Fire Departments to have removed from the subject premises fire-destroyed and damaged buildings, debris, junk, Investigation of Lynwood Journal artiG requested Public Hearing Nuisance at Wright Road & Willard Lane rubble, and inoperative vehicles and illegal lean-to sheds. Mr. Gerald Sanders, Building Official, was administered the oath for testimony before the City Council. Mr. Sanders identified the property and described the conditions which, in his opinion, constitute a public nuisance. He testified that the photographs on display, numbered one through nine, accurately describe and depict the conditions of the premises and in his professional -~ opinion, constitute a nuisance. Also on display was a plot plan of the area. He testified that the property is leased by the State to Mr. J. Jack Willard, who also leases land from the Southern Pacific Land Company. Mr. Sanders filed with the City Clerk a copy of a letter from Southern Pacific Land Company to Mr. Willard requesting compliance with the City's request to remove the debris and put the leased property in a safe condition. ~_. Mr. Ra.~,hard Porn, President of Willco Disposal, 11760 Wr~.,gYrt Road, after being sworn, complained that the tenants ha.d not been contacted and descr:~.bed imps©~,ez~aents that he has made to improve dumping operations and stated his company does no illegal dumping. He stsated. he can recall having had only three fz.res, one of which was of major consequence. 1Ir. Sanders described the conditior:s at the dump site which in his opinion are in need of correction, suer, as clearing access roads and fire paths. Mr. Harry Fredri~.kson, Lynwood Auto Wrecking, 5536 Willard Lane, tesi.i.fied that nuisances mentioned are va"lid and expressed concern about the condition of the property along the railway right-of-way, 1~e expressed cvill.ingness to do the beautification and painting necessary and his intention to enclose the excess vehicles on Willard Lane but was concerned about the length of time they will be able to lease the premises. He stated he was not opposed to abatement of certain nuisances, given a reasonable time to do so. Mr~• V• A• F3ickav, C & J Sales, 11.700 Wright Road, having been sworn, objected to the tenants not having been informed of the hearing and also not having been contacted about cleaning up the property without the necessity of a public hearing. He described irnpr°ovements he has already made and urged that the hearing be postponed to permit the Building Official to discuss with the tenants what must be done to correct the nuisances, particularly the fire damage. Fire Chief Johnson was sworn and testified that on June g, 1977, following the fire at CeeBee Manufacturing Company at 1.1750' Wright Road, he and Code Enforcement Officer Argante sent a letter notifying the California Department of Transportation that (1) the site be cleared of debris and hazardous chemicals, (2) if the Type IV buildings are to be occupied, that structural integrity certification be provided, and (3) that present and/or future tenants will be required. to comply with the Uniform Fire and Uniform Building Codes and that hazardous occupancies will be required to provide automatic sprinkle systems. He testified that on June 15 Cal`l'rans requested the master lessor, J, Jack Willard, to comply with the three above-mentioned items, and that to date, nothing has been done to clean i.ap the debris. He expressed particular concern abo~zt the ira2ax°d of organic peroxide contained in the debris, at~d `hat the damaged fence around the batch plan has l~;f'~; that area in a hazardous condition. Mr. Calvin Da:r°:~:1ey~ repr°esenting CalTrans, was sworn and testified, that the City receives 24~ of the revenue from freeway laight-of-way rentals and that under certain ei..rcurnstances subleasing is permitted. The Mayor in~u.ired if tl:,ere were any others wishing to be heard. Mr. Charles Conner, lessee at 5580 Willard Lane, was sworn and inquired what the common procedure is for removal of structures in the freeway corridor. He also questioned the necessity of the hearing, stating he had had fire and building inspections prior to his occupancy of the premises. He also complained of not receiving direct notice to clean up his premises. Mr. Bickov again addressed the Council to comment on the batch plant and the need for it to be torn down. The Mayor again inquired if there were any others wishing to be heard. As there was no response, he declared the hearing closed. In response to a question from the Council, Mr. Sanders stated that as of this date, the boat building is being carried on at the fire-damaged premises. In discussing the need for the action being taken against the entire property, it was noted that if any of the terms of the resolution do not apply to a particular property, those property owners will be under no obligation. RESOLUTION N0. 77-67 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DETERMINING THAT A NUISANCE IS BEING MAINTAINED ON CERTAIN PROPERTY WITHIN SAID CITY AND DIRECTING THE ABATEMENT THEREOF." was presented. It was moved by Councilman Higgins, seconded by Councilman Morris, that Resolution No. 77-67 be adopted with the following wording added to Section 3a and 3c, respectively: "except debris, junk and rubble within fenced-in areas of licensed junk yards," and "except those within fenced-in areas of licensed wrecking yards." The City Manager presented a report reviewing actions taken by the Building Department to have the condition of the building corrected. Mr. Gerald Sanders, Building Official, testifying under oath, identified the property and described the conditions which in his opinion constitute a public nuisance. He testified that the photograph on display accurately describes and depicts the condition of the premises and that in his professional opinion, constitute a nuisance. The Mayor inquired if anyone wished to speak concerning the proposed abatement. There was no response. The Mayor declared the hearing closed. RESOLUTION N0. 77-68 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DECLARING CERTAIN BUILDING OR BUILDINGS TO BE A NUISANCE AND DIRECTING THE OWNER TO ABATE IT." was presented. It was moved by Councilman Byork, seconded by Councilman Higgins, that Resolution No. 7'7-68 be adopted. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. Abatement at 2930 Poplar Dr. Public Hearing- The Mayor announced that the time had arrived for Weed Abatement public hearing on abatement of weeds on certain 1977-78 fiscal parcels of land within the City for the 1977-78 Yew' fiscal year. The City Manager presented his report and informed the Council that notice of public hearing had been posted and also mailed to affected property owners and that no protests have been received. Res.No. 77-69 The Mayor inquired if there was anyone present who Directing Weed wished to be heard. As there was no response, he Abatement declared the hearing closed. RESOLUTION N0. 77-69 entitled: "A RESOLUTION PASSING UPON OBJECTIONS The Mayor announced that the time had arrived for a public hearing, continued from the previous meeting, to ascertain whether nuisances were being maintained on property commonly known as 1104.5 Duncan Avenue. The City Manager recommended that the hearing be continued to August 16, 1977, as the required work is in progress. It was moved by Councilman Byork, seconded by Councilman Morris, and carried, that the hearing be continued to August 16, 1977, at 7:30 p.m. MANAGEMENT STUDIES AND REPORTS Spec.Assessment The City Manager presented an itemized statement auth. to abate of expense involved in abating the nuisance at nuis. at 11818 Peach Street and recommended that the 11818 Peach St. Council concur in the cost and authorize aspecial assessment to be placed on the property to recover the cost of nuisance abatement. A report on leasing of water rights from Firestone Tire and Rubber Company for $28.52 per .acre-foot was presented by the City Manager with the recommendation that the Council approve the water-right license and agreement between the City of Lynwood and the Firestone Tire and Rubber Company. Absent: None. The City Manager presented a report on bids received for purchase of an automobile and recommended that the bid of Don Kott Ford be accepted for a Ford Ltd. at $5,926.18. It was moved by Councilman Higgins, seconded by Councilman Morris, that the Council concur in the recommendation. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. A report on surplus radio equipment was presented with the request that the items be declared surplus and sale to the highest competitive bidder be authorized. It was moved by Councilman Morris, seconded by Councilman Higgins, that the radio equipment be declared surplus and sold to the highest bidder. Absent: None. `~ The proposed Bingo ordinance was discussed and because of new legislation having been passed since it was ox°iginally drafted and the City Attorney has since drafted another ordinance, it was moved by Councilman Green, seconded by Councilman Byork, and carried, that the ordinance be tabled until the next regular meeting. A summary of resolutions to be considered at the August 11,-1977 meeting of the League of California Cities was discussed briefly. CITY CLERK'S AGENDA A.Bellini req. The application of Antino Bellini for a special for special permit permit for private patrol operator was presented . for private patrol Based upon the Sheriff's Department investigative operator to be report, it was recommended that the permit be researched denied . Mr. Entino Bellini, 8478 State Street, addressed the Council to protest denial of the permit as he is licensed as a private patrol operator by the State of California. After discussion of the matter with the City Attorney, it was the consensus of the Council that the City Attorney be allowed time to research the question and advise the Council as to its authority in the matter of private patrol licensees. Claim denied - It was moved by Councilman Byork, seconded by J. Schlessinger Councilman Morris, and carried, that the Council deny the claim for damages filed on behalf of Jay Schlessinger. United Way permit It was moved by Councilman Byork, seconded by to solicit funds Councilman Morris, and carried, that the Council app'd approve the application of United Way Campaign for permission to solicit funds from September 15, 1977 to December 31, 1977. Absent: idone. ~'~<~., PUBLIC BUSINESS FROM THE FLOOR W.Cunningharn re Mr. William Cunningham, 10821 Cornish Avenue addressed Lynwood Journal , the Council concerning the lack of acitivity at the office local office of the LYNWOOD JOURNAL and asked that it be investigated. Rev. C. Floyd re Reverend Charles Floyd addressed the Council con- NAACP cerning the opening of a local chapter of the NAACF and stated membership is open to everybody, B. Anderson re Mr. Bill Anderson, 11352 Louise Avenue, inquired driveway stds., about a problem the resident of 11276 Virginia is crime having regarding covering her driveway and the negative response received from the Building Department. Building Official Sanders stated he was not familiar with the request but described the standards for driveways within the City. Mr. Anderson also commented on violent crime within the city, numbers of patrol cars in operation and excessive delays in response. Mr. Anderson made suggestions regarding crime prevention such as improving street lighting, crime prevention commission, use of CB radios, Federal money for patrol against crime and a grievance commission. A. Legg re Mr. Archie Legg, 3671 Platt Avenue, commented on a South G~,t~: tax proposed tax increase in the City of South Gate to proposal enable that city to increase its Police Department as their crime is increasing because of the law enforcement by the Sheriff in the Lynwood Station.
