HomeMy Public PortalAboutM 1977-09-06 - CC ADJOURNED REGULAR MEETING SEPTEMBER 6, 1977 The City Council of the City of Lynwood met in an adjourned regular session in the City Hall, 11330 Bullis Road, on above date at 7 p.m. Mayor Rowe in the chair. Councilmen Byork, Green, Higgins, Morris and Rowe answered the roll call. Also present were City Attorney Murphy and City Manager Valliere. On the occasion of his reappointment to the Los Angeles County Economy and Efficiency Committee by Supervisor Kenneth Hahn, the oath of office was administered to Councilman John Byork. It was moved by Councilman Morris, seconded by Councilman Higgins, and carried, that the meeting adjourn to executive session for discussion of matters of litigation. PUBLIC HEARING Public Hearing The Mayor announced that the time had arrived for public on nuisance at hearing, continued from the previous meeting, to 11045 Duncan Av. ascertain whether nuisances are being maintained on cont'd to 9/20/77 property commonly known as 11045 Duncan Avenue. Fire Chief Johnson reported that the corrections required have not been completed and requested that the hearing be continued. It was moved by Councilman Higgins, seconded by Councilman Green, and carried, that the hearing be continued to the meeting of September 20, 1977 at 7:30 p.m. . MANAGEMENT STUDIES AND REPORTS Res.No. 77-78 RESOLUTION N0. 77-78 entitled: "A RESOLUTION OF THE Policy relating CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, to Nepotism ESTABLISHING A POLICY RELATING TO NEPOTISM." was presented for second reading. It was moved by Councilman Higgins, seconded by Councilman Morris, and carried, that the resolution be read by title only. It was moved by Councilman Morris, seconded by Councilman Higgins, that Resolution No. 77-78 be adopted. Ayes: Councilmen Green, Higgins, Morris, Rowe. Noes: Councilman Byork. Absent: None. Memorandum of It was moved by Councilman Higgins, seconded by Understanding Councilman Byork, and carried, that the Memorandum with Teamsters' of Understanding between the City of Lynwood and Local 911 reed Teamsters' Local 911 be received and filed. Uniroyal water A report on leasing of 163 acre-feet of water rights right lease from the Uniroyal Tire Company Division, Uniroyal, Inc . app'd for $28.52 per acre-foot was presented by the City Manager with the recommendation that the Council approve the lease and authorize the Mayor to execute the agreement. It was moved by Councilman Higgins, seconded by Councilman Morris, that the Council concur in the recommendation. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. The City Attorney informed the Council that Resolution No. 77-78 relating to nepotism did not include a clause insuring that it will not affect employees retroactively but that such a clause will be included in the final resolution. ~.,~ ' Pursuant to his report on the Los Angeles-County Solid Waste Management Plan, the City Manager recommended that the Council adopt RESOLUTION N0. 77-7g entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD CONCURRING WITH AMENDMENTS TO THE LOS ANGELES SOLID WASTE MANAGEMENT PLAN." It was moved by Councilman Byork, seconded by Gouncilman Morris, that Resolution No. 77-79 be adopted. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. The City Manager reported on the proposed alteration of the City's Selma Manlift by the High Rider Equipment Company for a total cost of $2,300, plus tax, and recommended approval of Municipal Garage Fund Project No. 8-185-773• It was moved by Councilman Morris, seconded by Councilman Higgins, that the Council concur in the recommendation. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. The City Manager presented a report on the proposed application to the Los Angeles County Transportation Commission by the Parks and Recreation Department for $9,24 to fund the salary of a driver for the Senior Citizen Van. It was moved by Councilman Higgins, seconded by Councilman Morris, and carried, that the Parks and Recreation Department be authorized to file an application for the funds for the purpose of employing a driver for the Senior Citizen Van. The City Manager presented RESOLUTION N0. 77-80 entitled: "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPOINTING THE HOUSING AND COMMUNITY DEVELOPMENT ACT PROGRAM DIRECTOR OF THE CITY." and an agreement between the City and Christopher R. Johnston for the Council's consideration. It was moved by Councilman Higgins, seconded by Councilman Green, that Resolution No. 77-80 be adopted. Res.No. 77-79 relating to Solid Waste Mgt. Plan Mun.Garage Fund Prod. ~-185-773 app' d Senior Citizen Van driver fund app. app'd Res.No. 77-80 appointing C.R. Johnston HCDA Program Dir. Mr. Dave Richman, a member of the Housing and D. Richman re Community Development Advisory Board, questioned HCDA Director's Mr. Johnston's status and he was assured that there duties would be no change in Mr. Johnston's responsibilities and duties. FINANCE REPORT RESOLUTION N0. 77-81 entitled: "RESOLU'T'ION OF THE Res.No. 77-81 CITY COUNCIL OF THE CITY OF LYNWOOD ALLOWING AND Demands APPROVING THE DEMANDS PRESENTED ANb ORDERING WARRANTS ..DRAWN THEREFOR." was presented. It was moved by Councilman Byork, seconded by Councilman Green, that Resolution No. 77-81 be adopted. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. The City Attorney informed the Council that review No. 1016 of the City Code provisions pertaining to private relating to patrol permits and applications has identified private patrol additional authority available to the City under permits Section 7523 of the Business and Professions Code of the State of California which provides that any city may refuse registration to any person of bad moral character and may impose such reasonable and additional requirements as are necessary to meet local needs and are not inconsistent with the pro- visions of the Business and Professions Code regulating private patrol applications. It was his recommendation that the Council consider an urgency ordinance implementing the provision that applicants for private patrol permits who are found to be of bad moral character will be denied those permits and suggested adoption of ORDINANCE N0. 1016 entitled: "AN URGENCY ORDINANCE OF THE CITY OF LYNWOOD REPEALING SECTION 27-8 (b) OF THE LYNWOOD CITY CODE, RENUMBERING SUBSECTIONS (C) AND (d) THEREOF AS (b) AND (c.), RESPECTIVELY, AND ADDING THERETO NEW SUBSECTIONS (d) AND (e) RELATIVE TO PRIVATE PATROL PERMITS." It was moved by Councilman Higgins, seconded by Councilman Morris, that further reading be waived. As there were no objections, the Mayor declared the motion carried. It was moved by Councilman Higgins, seconded by Councilman Green, that ORDINANCE N0. 1016 be adopted. Roll Call: Ayes: Councilmen Byork, Green, Higgins, Morris, Rowe. Noes: None. Absent: None. CITY CLERK'S AGENDA Holy Spirit Assn. A request was presented from The Holy Spirit Association app. denied for the Unification of World Christianity for permission to solicit funds for a six-month period. The Mayor inquired if anyone representing the organization was present. There was no response. It was moved by Councilman Higgins, seconded by Councilman Morris, and carried, that the request be denied. St.Philip Neri It was moved by Councilman Morris, seconded by app. to conduct Councilman Green, and carried, that the Council grant fiesta app'd the request from St. Philip Neri School for permission to conduct its annual Fiesta on October 1 and 2, 1977. Bekins Protect. It was moved by Councilman Green, seconded by Serv. app. Councilman Higgins, and carried, that the Council app'd grant the application of Bekins Protection Service for a special permit to conduct a private patrol service. COUNCIL AGENDA M. Haack appt'd It was moved by Councilman Higgins, seconded by Acting Planning Councilman Morris, and carried, that Planning Technician Secretary Michael Haack be appointed Acting Planning Secretary. City Manager It was moved by Councilman Higgins, seconded by appt'd Acting Councilman Morris, that the City Manager be appointed Public Works Dir. Councilman Green commented on a recent incident of a newly- Coun. Green - painted building being painted with graffiti. Attempts at Graffiti controlling the graffiti problem were discussed at length. problem Councilman Morris commented on the I-105 Freeway progress Coun. Morris and commended Councilman Byork for the great amount of I-105 Fwy. time and effort he has spent on behalf of the City relative to the freeway. He also congratulated Council- man Byork on his reappointment to the Los Angeles County Economy and Efficiency Committee. PUBLIC BUSINESS FROM THE FLOOR Mr. Dave Richman, 11106-B Benwell Drive, a member of the D. Richman re HCDA Advisory Board, addressed the Council to urge that HCDA Advisory vacancies on the board be filled. He was ~ reformed that Bd. vacancies names of individuals interested in serving are contained in the City Council members administrative report. Mrs. Prince Ella Coleman, 11067 Carson Drive, submitted a letter to Councilman Morris for distribution to the other Council members and described an incident involving her daughter and the actions of the Sheriff's Deputies in investigating the matter. She also sought advice relative to supression of crime. .Captain Waller commented on the need for citizen involvement in reducing crime and stated that if Mrs. Coleman would contact him, the ~"-' Sheriff's Department will advise her on starting a block- watch. Mr. Cass Waranius, 12416 Long Beach Boulevard, addressed the Council to comment on new legislation which permits a citizen to obtain a permit to purchase a mace-gun. P.E. Coleman re Sheriff's action C.Waranius re mace-guns Mr. Eugene Mitchell, 3661 Josephine Street, addressed the E. Mitchell re Council concerning the lack of patrol throughout residen- Sheriff's tial areas and excessive control on major thoroughfares patrol within the city. He also complained of the numerous times he and his wife have been stopped for questioning by the Sheriffs.
