A RESOLUTION OF' THE VILLAGE COI]NCIL OF' TIIT'
VILLAGE OF KEy BISCAytyE, FLORIDA, CON"FIRMING
EMERGENCY EXPEI\DITI]RES RELATING TO TIIENO\aEL CORONAVIRUS/COVID-19; PROVIDING F,OR
RATIFICATION; AND PROVIDING FoR AIY EFFECTIVE
DATE.
WHEREAS, the Novel Coronavirus Disease zAlD (COVID-1p') is a severe acute
respiratory illness that can spread among humans through respiratory transmission and presents
symptoms similar to those of influenza; and
WIIEREAS, COVID-l9 poses a public health risk to residents of the Village of Key
Biscayne (the "Village"), particularly elder$ residents; and
WHEREAS, on Marc h l,2020,Florida Governor Ron Desantis issued Executive Order
No. 20-51 directing the Florida Department of Health to issue a Pubtic Health Emergency; and
WIIEREAS, on March 9,2020, a State of Emergency was declared by Ftorida Governor
Ron DeSantis and by Miami-Dade County Mayor Carlos Gimenez on March 12,2020; and
WHEREAS, on March 13,2020, the Village Manager issued a Declaration of State of
Emergency conceming COVID-I9 (the "Declaration') and subsequently issued various
emergency orders to mitigate and slow the spread of COVID-l9 within the Village; and
WIIERE,{S, on April 7,2020, the Village Council approved Resolution No. 2020-21
confirming the Declaration and emergency expenditures and actions taken by the Village
Manager and ratifring any action or emergency order issued by the Village Manager to protect
the public from COVID-l9; and
WHEREAS, in an effort to continue mitigating and slowing the spread of COVID-19
within the Village, the Village Managerhas issued additional emergency orders; and
WHEREAS, the Village Council desires to confirm any additional emergency
expenditures and actions taken by the Village Manager to protect the public from COVID-19 and
ratify the emergency orders issued since the adoption of Resoluti on2020-21; and
WHEREAS, the Village Council finds that this Resolution is in the best interest and
welfare of the residents of the Village.
NOW' THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals. That the above recitals are true and correct and incorporated
herein by this reference.
Section 2. Conlirming Expenditures. That, in accordance with Section 9-5 of the
Village Code, the Village Council hereby confirms any additional emergency expenditures and
actions taken by the Village Manager relating to the Declaration to protect the public from COVID-
19, as further provided in the Village Manager's staff report supporting this Resolution.
Section 3. Ratification. That the Village Council hereby ratifies and approves any
action or emergency order issued since the adoption of Resoluti on2020-21by the Village Manager
to protect the public from COVID-19.
Section 4. Effective Date. This Resolution shall take effect immediately upon
adoption.
