I make this request pursuant to Article 1, Section 24 of the Florida Constitution and Chapter 119 of the Florida Statutes. I hereby reserve all rights granted to me under the Florida Constitution and Florida Statutes. As background to this request I note that Officer O'Donnell recently contacted Ms. Shelley O'Hare at 2516 Avenue Au Soleil to tell her he was investigating a complaint of barking dogs. Officer O'Donnell subsequently contacted me about the same matter just a few days ago and I promised to do what I could to mitigate the matter. I was again contacted by the Town to make me aware that another complaint was received today at 2:10 pm about barking dogs near my home but the Officer explained he heard no barking when he arrived. I request to inspect all public records in the Town of Gulf Stream's custody that are partially or substantially regarding these complaints and any subsequent action or investigation by the Town. I anticipate that responsive records may include but not necessarily be limited to phone messages, voice messages, dispatch recordings, memos, emails, reports are similar type records. *The term public records, as used herein, has the same meaning and scope as the definition of Public records adopted by the Florida Legislature as Statutes Chapter 119. **The phrase Town of Gulf Stream when used herein refers to the Town in its entirety and all entities of the Town including all Town Officials, Town Employees, Town Attorney, and any other entity associated with the Town and subject to public records law. I ask you to take note of §119.07(1)(c) Florida Statues and your affirmative obligation to (1) promptly acknowledge receipt of this public records request and (2) make a good faith effort which "includes making reasonable efforts to determine from other officers or employees within the agency whether such a record exists and, if so, the location at which the record can be accessed." I am, therefore, requesting that you notify every individual and entity in possession of records that may be responsive to this public records request, including individuals and entities under contract with your agency, to preserve and produce all responsive records on an immediate basis. If you contend that any of the records I am seeking, or any portion thereof, are exempt from inspection or disclosure please cite the specific exemption as required by §119.07(1)(e) of the Florida Statutes and state in writing and with particularity the basis for your conclusions as required by §119.07(1)(f) of the Florida Statutes. Produce for my inspection all responsive records and ONLY redact that portion of the record that you consider exempt. To be clear, if you consider an entire record to be exempt, produce that record in its entirety with all portions redacted that you consider exempt. I specifically ask you to do this in order that I may inspect fully redacted records for the purpose of challenging a particular redaction or establishing a reference for a future request of a record that is only temporarily exempt, as in the case of a public record that was prepared by an agency attorney exclusively for litigation and is only exempt from disclosure until the conclusion of the litigation. If the public records being sought are maintained by your agency or contactors for your agency, in an electronic format please produce the records in the original electronic format in which they were created or received. See §119.01(2)(f), Florida Statutes. I ask that you provide only those records for inspection that do not require extensive use of information technologies or extensive staff time or both in excess of 15 minutes. Take note of §119.07(4)(a)3.(d) Florida Statues and if you anticipate that any records exist, the production for inspection of which will require extensive use of information technologies or extensive staff time or both in excess of 15 minutes, then please provide those records that can be produced within the first 15 minutes and advise me of the cost you anticipate to be incurred by your agency for the remaining records prior to incurring this cost. Please do not incur any costs on my behalf without first obtaining my written authorization to proceed. If you produce only a portion of all existing responsive records, please tell me that your response includes only a portion of all existing records responsive to this request. If you do not understand any part of this request or if you need clarification about this request, notify me as soon as possible so I may further describe or clarify this request. THE DOGS ARE LEFT OUTSIDE ALL DAY WHEN THE OWNERS LEAVE FOR WORK. DURING THE INTERVIEW PROCESS I MADE SEVERAL OBSERVATIONS. THE NEIGHBORHOOD HAD ONGOING CONSTRUCTION PROJECTS, LANDSCAPING SERVICES IN PROGRESS AND PEDESTRIAN TRAFFIC WHILE WALKING DOGS. I DID OBSERVE AT LEAST TWO DOGS WITHIN THE PROPERTY LOCATED AT 2520 AVE. AU.SOLEIL. THE DOGS WERE FENCED IN. ONE DOG WAS BLACK IN COLOR AND THE SECOND ONE WAS BROWN IN COLOR THE DOGS WERE ACTIVELY BARKING. THE DOGS WERE POSSIBLY BARKING IN REACTION TO THE CONSTRUCTION, LANDSCAPING NOISE AND PEDESTRIAN TRAFFIC. I REMAINED IN THE AREA OF 2516 AVE. AU. SOLEIL FOR SEVERAL MINUTES WITH THE VEHICLE WINDOWS ROLLED DOWN. I TURNED ON THE IN -CAR CAMERA LOCATED IN VEHICLE 757. THE CONSTRUCTION AND LANDSCAPING NOISE HAD STOPPED AND THERE WERE NO PEDESTRIAN TRAFFIC IN THE VICINITY. THE DOGS CONTINUED TO BARK EXCESSIVELY. I WAS UNSUCCESSFUL IN MAKING CONTACT WITH THE PROPERTY OWNER AT 2520 AVE. AU.SOLEIL. AS I ENTERED UPON THE DRIVEWAY I DID HEAR DIFFERENT BARK THAT MAY HAVE BEEN COMING FROM A THIRD DOG ON THE PROPERTY. I ATTEMPTED TO MAKE CONTACT WITH MR. CHRISTOPHER OHARE HOWEVER THE PHONE NUMBER WAS DISCONNECTED. I ATTEMPTED TO MAKE CONTACT BY TELEPHONE WITH MR. CHRISTOPHER OHARE'S FORMER WIFE MS. SHELLY OHARE. MS. OHARE RESIDES NEXT DOOR AT 2516 AVE. AU.SOLEIL. I HAVE PERSONAL KNOWLEDGE THAT MS. OHARE ALSO HAS A SMALL DOG. THE THIRD BARKING DOG MAY HAVE BEEN HERS. I LEFT A DETAILED VOICE MAIL FOR MS. OHARE. SEVERAL HOURS LATER I WAS CONTACTED BY TELEPHONE BY MS. SHELLY OHARE. MS. OHARE CONFIRMED THAT ALL THE DOGS WERE OWNED BY THE OHARE FAMILY. GREY POODLE (CHLOE) OWNED BY MS. SHELLY OHARE. BROWN MIX MUTT (SUNNY) OWNED BY MR. CHRISTOPHER OHARE. BLACK MIX MUTT (SHADOW) OWNED BY THE OHARE'S SON CHRISTOPHER JR. MS. OHARE WAS COOPERATIVE AND APOLOGETIC FOR THE EXCESSIVE BARKING. MS. OHARE WAS NOT AWARE OF THE ISSUE AND INDICATED SHE WILL QUELL THE EXCESSIVE BARKING WHEN LEAVING THE PROPERTY. I LEFT A WRITTEN MESSAGE NOTE AT THE FRONT DOOR FOR MR. CHRISTOPHER OHARE FOR HIM TO CONTACT ME REGARDING THIS INCIDENT. AS OF 1900 HOURS I HAVE NOT HEARD BACK FROM HIM. I CONTACTED MR. RUSSO AND MR. WOOD AND ADVISED THEM OF MY FINDINGS. MR. RUSSO AND MR. DURING THAT INVESTIGATION I DETERMINED THE BARKING DOGS WERE OWNED BY MR. CHRISTOPHER OHARE AND HIS SON CHRISTOPHER JR. THE THIRD DOG WAS OWNED BY MR. OHARES FORMER WIFE MS. SHELLY OHARE. I MADE SEVERAL UNSUCCESSFUL ATTEMPTS IN MAKING CONTACT WITH MR. OHARE BY DIRECT CONTACT OR TELEPHONE CONTACT. I MADE CONTACT WITH MS. SHELLY OHARE WHO WAS COOPERATIVE AND APOLOGETIC. MS. OHARE CAME BACK TO THE RESIDENCE AND PUT THE DOGS BACK INSIDE HER FORMER HUSBANDS RESIDENCE. DURING TODAYS COMPLAINT AND SUBSEQUENT INVESTIGATION I FOUND THAT A DOG WAS OUTSIDE AND BARKING. WHILE ON SCENE I WAS MET BY MS. SHELLY OHARE. MS. OHARE INQUIRED IF I WAS THERE BECAUSE THE DOGS WERE BARKING AGAIN. DURING THE INITIAL QUESTION MS. OHARE ACKNOWLEDGE THE BARKING DOG AND IMMEDIATELY WALKED TO HER FORMER HUSBANDS PROPERTY AND PUT THE DOG BACK INSIDE. UPON HER RETURN MS. OHARE IDENTIFIED THE BARKING DOG AS (SUNNY). MS. OHARE STATED THAT THE DOG HAS THE ABILITY TO OPEN THE BACK DOOR. MS. OHARE PROVIDED ME MR. OHARE CELL NUMBER. I MADE CONTACT WITH MR. OHARE BY TELEPHONE. MR. OHARE WAS POLITE AND WAS UNAWARE OF THE PREVIOUS COMPLAINT. DURING THE PREVIOUS COMPLAINT I HAD PLACED A BUSINESS CARD WITH MY CONTACT INFORMATION SO AS WE COULD DISCUSS THE INCIDENT. MR. OHARE FAILED TO CONTACT ME. MR. OHARE STATED FURTHER THAT THE DOG SUNNY HAS THE ABILITY TO OPEN THE DOOR TO THE BACKYARD. MR. OHARE WAS APOLOGETIC AND INDICATED HE WILL MAKE FURTHER ATTEMPTS TO SECURE THE REAR DOOR. I ADVISED MR. OHARE THAT FURTHER COMPLAINTS WILL RESULT IN RECEIVING A PALM BEACH CTY CITATION. MR. OHARE ACKNOWLEDGE THE ENFORCEMENT ACTION. I MADE CONTACT WITH MR. RUSSO WHO WAS OBVIOUSLY ANNOYED WITH THE ONGOING ISSUE. MR. RUSSO STATED THAT THE DOG WAS ALSO BARKING THE ENTIRE DAY UP UNTIL 2030 HOURS ON 3/6/2017. MR. RUSSO DID NOT CALL DURING THIS TIME. I ALSO MET WITH MR. JAMES WOOD WHO HAD ALSO COMPLAINED ABOUT THE BARKING DOGS ON 3/2/2017. MR. WOOD STATED THAT SINCE MY INITIAL INVESTIGATION ON 3/2/2017 HE HAS NOT HEARD THE DOGS BARKING. I PROVIDED BOTH INDIVIDUALS A PALM BEACH COUNTY, NUISANCE DOG COMPLAINT AFFIDAVIT. I SUGGESTED THEY BOTH KEEPA DAILY LOG WITNESSING THE EXCESSIVE DOG BARKING. THIS CASE WILL REMAIN INACTIVE. RUSSO REQUESTED THAT I GO TO THAT LOCATION TO SEE IF I COULD HEAR THE DOG(S) BARKING SO THAT I COULD ISSUE O'HARE A CITATION FOR VIOLATION OF THE TOWN OF GULF STREAM DOG ORDINANCE. I WENT TO THE AREA OF THE RESIDENCE AND REMAINED THERE UNTIL 1535 HOURS. I DID NOT HEAR OR OBSERVE ANY VIOLATION OF THE DOG ORDINANCE. I ADVISED RUSSO TO CALL US BACK TO THE AREA IF HE HEARD THE DOG(S) BARKING AGAIN. HE SAID HE WOULD DO SO. ON 03/09/17 AT 1540 HOURS I SPOKE TO O'HARE VIA CELL PHONE AND ADVISED HIM OF THE COMPLAINT. O'HARE SOUNDED CONCERNED AND SAID THAT HE HAS BEEN KEEPING THE DOGS IN A BEDROOM SO THAT THEY WOULD NOT BOTHER THE NEIGHBORS SHOULD THEY BARK. O'HARE SAID THAT BASED ON THE TIME OF OCCURRENCE OF THE INCIDENT TODAY, HE BELIEVES THAT THE DOGS MAY HAVE BARKED MOMENTARILY WHEN HIS DAUGHTER RETURNED HOME FROM SCHOOL.O'HARE SAID THAT HE WOULD CONTACT HIS EX-WIFE, SHELLEY O'HARE WHO LIVES NEXT DOOR AT THE PREVIOUSLY DOCUMENTED ADDRESS, TO ALERT HER REFERENCE THE ADDITIONAL COMPLAINT SO THAT THEY CAN TAKE APPROPRIATE ACTION TO KEEP THE DOGS FROM BARKING AND AVOID ENFORCEMENT ACTION. I CALLED MS. O'HARES'S CELL PHONE AFTER COMPLETING THE CALL WITH MR O'HARE AND MY CALL WAS ANSWERED BY VOICE MAIL. I LEFT HER A MESSAGE EXPLAINING ABOVE INCIDENT. RUSSO WAS ADVISED OFABOVE DEVELOPMENTS. ON 03/09/17 AT 1830 HOURS OFC. C. FAHEY ADVISED ME THAT ON 03/09/17 AT 1800 HOURS WHILE HE WAS ON PATROL IN THE AREA OF MS. O'HARE'S RESIDENCE SHE ADVISED HIM THAT SHE GOT MY VOICE MESSAGE. MS. SUTTON ADVISED ME (VIA RADIO) THAT THERE WERE MULTIPLE PEOPLE WALKING THEIR DOGS IN THE VICINITY OF THE O'HARE RESIDENCE. OFC T. SUTTON FURTHER ADVISED HE DID NOT SPECIFICALLY HEAR A DOG BARKING AT THE O'HARE RESIDENCE. UPON MY ARRIVAL IN THE AREA, I DID NOT HEAR ANY BARKING DOG; NO FURTHER POLICE ACTION BY ME.
