HomeMy Public PortalAbout19950905REGULAR COUNCIL MEETING SEPTEMBER 5, 1995 1 CALL TO ORDER The Regular Council Meeting of September 5, 1995, was called to order at 7:30 P.M. with Mayor Duane Schreimann presiding. Prayer was offered by Rev. Walter Gilpin, followed by the pledge of allegiance. ROLL CALL The following Council Members were present for roll call: Present: Bertel, Byrd, Green, Haake, Jackson, Kammerdiener, Landwehr, McDowell, Nilges and Vincent Absent: None A quorum was declared present. PRESENTATIONS FROM THE GALLERY Dr. David Scott, 1219 Fairland, made a presentation concerning the upcoming Table Tennis Tournament which will be held in Jefferson City September 9 -10. Following the presentation, Mayor Schreimann requested that Resolution RS95 -18 be brought forward on the agenda at this time. There were no objections to Mayor Schreimann's request. Mr. Neal Bisges, representing Sho -Me Coach Lines, made a presentation regarding the status of Sho -Me Coaches Lines. He explained the financial status of the company, the status of its delinquent sales taxes to the State of Missouri, and requested that the Council continuing subsidizing the company. In the question and answer period which followed the presentation, the consensus of those Councilmen making statements was that the City should discontinue its funding of this company because of its business practices and delinquency of sales taxes. They stated that the City may consider subsidizing a bus company in the future, but not Sho -Me Coaches Lines. RESOLUTIONS RS95 -18 - Recognizing United States of America Table Tennis Tournament in Jefferson City , sponsored by Councilman Nilges. Councilman moved that the resolution be adopted, motion was seconded by Councilman Byrd, and approved unanimously REGULAR COUNCIL MEETING SEPTEMBER 5, 1995 2 PRESENTATIONS FROM THE GALLERY (CONTINUED) Mr. Ed Brandel, 1809 Overlook Drive, made a presentation regarding the Gross Receipts Utility Tax, and suggested that residential taxpayers receive the same "ceiling" considerations as businesses when being assessed taxes. CONSENT AGENDA The Consent Agenda consisted of the following items: a) Minutes of August 21, 1995, Council Meeting b) Bid 1573 - West High Street Slope Protection, Public Works Dept. c) Abatement of Special Tax Bill 14769 Following questions regarding items (b) and (c), Councilman Green moved that the Consent Agenda be approved, motion was seconded by Councilman Byrd, and approved unanimously. MINUTES RECEIVED /FILED WITH THE CITY CLERK'S OFFICE Mayor Schreimann stated that the following minutes /reports have been received and are on file in the City Clerk's office: Planning & Zoning Commission, 7/13/95; Board of Adjustment, 7/11/95; USS Jefferson City Submarine Committee, 8/8/95; Convention Center Committee, 8/14/95; Financial Report for July, 1995; Finance Committee Meeting, 8/17/95 MAYORAL APPOINTMENTS Mayor Schreimann made the following recommendation for appointments: Probationary Police Officer: Gary T. Campbell Troy P. Cebulak Christopher C. Lindsey Lee R. Tubbesing Councilman Green moved that the appointments be approved as recommended, motion was seconded by Councilman Bertel, and approved unanimously. REGULAR COUNCIL MEETING SEPTEMBER 5, 1995 3 BILLS INTRODUCED Bill 95 -80, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE PERSONNEL POLICY MANUAL OF THE CITY OF JEFFERSON, MISSOURI, BY REPEALING SECTION 3 -5. HEALTH AND SAFETY, SECTION 6 -8. DEMOTION DURING QUALIFYING PERIOD, SECTION 10 -1. REGULAR WORKING HOURS; EXCEPTIONS, SECTION 10 -2. WORK SCHEDULES DETERMINED BY DEPARTMENT DIRECTORS, SECTION 10 -3. Councilman Haake requested that the rules be suspended and Bill 95 -81 placed on final passage. There were no objections to the request for suspension of the rules. Bill 95 -70, sponsored by Councilman Bertel, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THE MISSOURI HIGHWAY AND TRANSPORTATION DEPARTMENT FOR A SECTION 18 (I) GRANT FOR PUBLIC TRANSPORTATION PROJECT. Councilman Bertel stated she wished to withdraw Bill 95 -70 from consideration. Bill 95 -78 was read third time by title, placed on final passage and passed by the following vote as Ordinance 12343: Aye: Nay: Bertel, Byrd, Green, Haake, Jackson, Kammerdiener, Landwehr, McDowell, Nilges and Vincent None REGULAR COUNCIL MEETING SEPTEMBER 5, 1995 7 Bill 95 -79, sponsored by Councilman McDowell, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING ORDINANCE 12256 AUTHORIZING A REFERENDUM ON AN AMENDMENT TO THE CHARTER PROHIBITING CASINO AND RIVERBOAT GAMBLING IN THE CITY OF JEFFERSON AND PROHIBITING CITY OFFICIALS OR EMPLOYEES FROM RECEIVING ANY FORM OF COMPENSATION FROM A GAMING COMPANY OR ITS REPRESENTATIVES, AND ENACTING A NEW ORDINANCE IN LIEU THEREOF. Following discussion, Bill 95 -79 was read third time by title, placed on final passage and passed by the following vote as Ordinance 12344: Aye: Bertel, Byrd, Green, Haake, Jackson, Kammerdiener, Landwehr, McDowell, Nilges and Vincent Nay: None COUNCIL LIAISON REPORTS Councilman Bertel announced the Public Works & Planning Finance Subcommittee meeting on September 12 at 7:00 P.M. Councilman Landwehr announced the General Administration Finance Subcommittee meeting on September 7 at 7:00 P.M. Councilman Vincent reported on the meeting of the Solid Waste Committee which met Tuesday morning, September 7. He stated that the committee is working on Request For Proposals for a new composting contract due in June, 1996. He states the committee is trying to find some cost - saving methods for the City. UNFINISHED BUSINESS There was no Unfinished Business to come before the Council at this time. NEW BUSINESS Councilman Nilges stated that he had watched the Jefferson City Fire Department performing an auto extrication at an accident scene the past week, and commended the department for their efficiency and professionalism. He requested that Chief Rennick pass along his commendation to the Fire Department personnel for a job well done. Councilman Nilges asked Public Works Director Marty Brose about the traffic signal at Beck Materials at Stadium in connection with the Edgewood Drive project. Mr. Brose explained the timetable for the project and the studies conducted which had indicated the REGULAR COUNCIL MEETING SEPTEMBER 5, 1995 8 necessity for the signal to prevent safety hazards in that area. Questions were also asked of Mr. Brose concerning the traffic signal at the new Target store on Stadium, and the need for traffic signals on Missouri Boulevard. Councilman Bertel stated that City Clerk Phyllis Powell had recently received media attention for being one of four Missouri artists, and the only artist from Jefferson City, chosen to display artwork in the Healing Legacies Art Exhibit (an exhibit comprised of artwork by cancer survivors) currently on display in the Capitol Rotunda. Councilman Vincent stated that he had noticed a sign still on the bus station and which reads "Tourist Information Center," and moved that the sign, as well as the associated street signs with the same information, be removed. The motion was seconded by Councilman McDowell, and approved unanimously. Councilman Byrd commended volunteers who had recently helped with the Special Olympics in Jefferson City. Persons specifically recognized were Mr. Dan Massie, who is in attendance at tonight's Council Meeting, Councilman Rick Nilges, who served as umpire for some of the ball games, and Councilman Larry Vincent who worked in the food concession area. APPROVAL OF EXECUTIVE SESSION MINUTES Executive Session Minutes of August 21, 1995: Councilman Bertel moved for approval, seconded by Councilman Byrd, and approved unanimously. ADJOURNMENT There being no further business to come before the Council, Councilman Green moved that the meeting be adjourned, seconded by Councilman Bertel, and approved unanimously. The meeting was adjourned at 9:30 P.M.
