WHEREAS, pursuant to Section 30-73 of the Vitlage of Key Biscalme ("Village") Code
of Ordinances ("Code'), the Most Reverend Thomas G. Wenski, Archbishop of the Archdiocese
of Miami ("Applicanf') submitted a Planning and Zoning Application bearing Public Hearing
No. SP-29 ('Application') seeking approval of a site plan for development at the property
located at 100 Harbor Drive as more fully described in the legal description attached hereto as
Exhibit "A" ('?roperty'); and
WHEREAS, on April 28, 2020, the Village Council conducted a duly-noticed public
hearing and considered the Application in its entirety, as well as all testimony and other evidence
presented and otherwise made part of the record.
NOW THEREFORE, BE IT RESOT,\{ED BY TIIE VILLAGE COI]NCIL OF
Tm VILLAGE OF KEy BISCAYNE, tr'LORIDA AS FOLLOIVST
Sectiqp-t Recitsls. Each of the above-stated recitals are hereby adopted, confirmed,
and incorporated herein.
Section 2. Findines. Thc Village Council, based upon the competent strbstantial
evidence presented, finds that the Application is consistent with the Village's Master Plan and
that the Applicant has met all of the applicable requirements within the Village's Zoning Codg
and in panicular Section 30-73 of the Village Code.

Section 3. Site PIan Apnroved. The followingplans prepared by Jorge L. Hernandez
Architect dated March 27, 2020, and consisting of sheets SP-1.0 tbrougb L-5, respectivelR
reduced copies of which are attached hereto as nxdibit "8," ar€ hereby approved zubject to the
conditions in Section 4 below.
Section 4., Conditions. The approval granted by this Resolution is zubject to
compliance with the following conditions:
Review and approval of the proposed traffic signal timing modifications to the intersection
of Crandon Boulevard and Harbor Drive by Miami Dade County DTPW Traffic
Engineering Division prior to issuance of building permits.
Any cornments from the Fire Department must be addressed at Building Pennit review
and plans modified accordingly.
At permit, plans must confirm that all utilities such as air conditioning and generators are
screened with a solid stnrcture at a minimum of 12" above the top of utilities, and said
structtual screen is to painted to match the main buildings. Also, these utilities are not to
be located within a front yard.
The dumpsters shall be construoted of concrete block and stucco. The building rnaterial
for thegates shall only be comprised of overlapping lourned or solid metal.
The Property contains a variety of palm trees and canopy trees. Page L2 refers to existing
site trees which will be further detailed at permit. Prior to demolition, the Village shall
havE the opportunity to remove any trces that will not be retained on site and place them
on public property. The reloeation cost shall be at the expense of the developer.
r Non-material rnodifications of the Site Plan, which do not inorease the intensity of
development, and axE substantially in accordance with the Site PIan, rrny be
administratively approved by the Building Zoning, and Planning Director. All other
changes shall be approved by the Village Council aftera public hearing.
r The Resolution for this Site Plan approval must be recorded with the Miami Dade Cor.rnty
Clerk and submitted to the Village Clgrk prior to approval of the Building Permit.
Section 5. Recordine. This Resolution shall be recorded, prior to the issuance of a
building permit, by the Applicant at its expense in the public records of Miami-Dade County,

Florida. A copy of the proof of recordation shall be submitted to the Village Clerk prior to the
issuance of any building permits.
Section 6. Effective Date. This Resolution shall be effective immediately upon
adoption.
