Proposal
The City of Lynwood is requesting that the Planning Commission conduct a public hearing on

Recommendation
Staff recommends that the Planning Commission approve Resolution No. 3282 terminating
conditional land use approvals for Resolution No. 2781, 2799, 2817, 2899, 2916, 2921, 3165
and 3182.

The Lynwood Planning Commission met in regular session in the City Hall Council
Chambers, on the above date.
Development Services Director Colin indicated that Chair West would be running
late or possibly absent from the meeting due to a traffic accident.
Commissioner Patel led the meeting and called it to order at 6:05 p.m.
Commissioner Younger led the flag salute.
Commissioner Patel requested the roll call.

Also present were Development Services Director Jonathan Colin, Planning
Associate Karen Figueredo, Planning Associate Octavio Silva, Public Works

Commissioner Patel inquired about the Agenda and whether it had been duly
posted.

Commissioner Patel introduced Agenda Item #5, minutes of February 8, 2011,
Planning Commission Meeting and asked if there were any questions or revisions.
It was moved by Commissioner Younger, seconded by Commissioner Landeros
and carried to approve the minutes of the February 8, 2011 Planning Commission
meeting.

Proposal
The applicant is requesting approval for Tentative Parcel Map No. 2010 -02
for a 15,071 square foot retail center already under construction known as
Oakwood Plaza. The property owner is proposing to consolidate lots 94 -99
and 105 into one lot, Assessor's Parcel Numbers are 6170 - 039 -017, 6170-
037 -034, 6170 - 039 -035, and 6170 - 037 -036, which are located in the
Heavy Commercial (C -3) zone and has a General Plan designation of
Commercial.
Recommendation
Staff recommends that the Planning Commission approve Resolution No.
3277, approving Tentative Parcel Map No. 2010 -02.
Planning Associate Figueredo presented the item to the Commission.
Representing the applicant, Brian River provided some background information
about the proposal. He explained that the final piece of the puzzle to complete
the Oakwood Plaza project is approval of the TPM.
Commissioner Younger inquired about current and proposed tenants at the
subject site.

SUBJECT: City -Wide Residential Design Guidelines
APPLICANT: City of Lynwood
PROPOSAL
In an effort to inform, guide and inspire residential development through quality
design principles, the City of Lynwood is proposing to establish City-Wide
Residential Design Guidelines.
The City of Lynwood's General Plan requires the preparation of City-Wide Design
Guidelines. In 2003, the City of Lynwood adopted its current General Plan. Within
the General Plan, the City made it a priority to include a Community Design
Element. A policy of the Community Design Element is to develop design
guidelines in order to facilitate the creation and identification of distinct
neighborhoods throughout the City. To date, the design guidelines have not
been completed.
Additionally, at their January 18, 2011 meeting, the City Council voted to dissolve
the Design Review Board (DRB). The responsibility of the DRB was to ensure
that the nature and appearance of land uses and development would be
compatible and harmonious with the use and enjoyment of surrounding
properties. With the absence of the DRB, the proposed City-Wide Residential
Design Guidelines would help to guide residents, developers, and elected and
appointed officials in making quality design decisions.
ANALYSIS & DISCUSSION
The way in which land is developed and buildings are constructed or rehabilitated
influences the overall image of the City of Lynwood, as perceived by residents,
visitors and businesses. The purpose of the proposed Residential Design Guidelines
is to provide comprehensive and consistent design guidance for the development
and rehabilitation of residential structures throughout the City. The primary
objectives of the Residential Design Guidelines are:
• To promote a visually attractive, safe and well planned community through
the incorporation of sound design principles.
• To protect City of Lynwood residents from unsafe and unsightly conditions.
• To preserve and maximize the image, character and history of Lynwood.
Typically, Design Guidelines cover a wide range of design and planning themes and
techniques, including mass and scale of buildings, color schemes and consistency in
building materials. A recent survey by staff found that twelve (12) cities in the area
have Design Guidelines in place (see Exhibit No. 1). While some of the Cities that
were surveyed have specific Design Guidelines tailored to Historic Districts or
Downtown areas, overall the goal of each of the documents is to encourage good
design practices and improve the quality of life for residents and the business
community. The City of Lynwood's proposal will focus primarily on residential
structures including single family, multi - family, townhouse and apartment
complexes.
The proposed guidelines are intended to supplement the City's Zoning Code by
providing a visual reference in which staff, appointed and elected officials can
utilize to make quality design decisions. The proposed guidelines would be limited
to the rehabilitation of existing residential structures as well as the construction of
new residential units. For example, if a resident is proposing to construct a new
addition to his or her residence, staff would be able to utilize the guidelines in
conjunction with the City's Zoning Code to review the proposal. While the
Residential Design Guidelines will cover a variety of different design topics, in rare
occasions the City Council or Planning Commission would be able to waive
guideline recommendations. The guidelines are not intended to promote a
particular architectural style but rather they are intended to promote quality design
and planning practices.
In order to assist City staff in the preparation of the proposed guidelines, staff has
contracted with Hogle- Ireland, Inc. Hogle- Ireland has completed numerous design
guideline documents and has won many prestigious planning awards for their work
on Specific Plans and other related documents. Hogle- Ireland has worked with

numerous cities and jurisdictions in the area including, the cities of Downey, Long
Beach, Lakewood and the County of Orange. A complete list of Hogle- Ireland's

The Planning Commission's participation and input in the preparation of the
proposed guidelines is essential to the authenticity of the document. Hogle- Ireland
anticipates completion of a draft document for the Planning Commission to review
within (8) weeks of project commencement.
RECOMMENDATION
Staff recommends that the Planning Commission receive and file this report.

SUBJECT: Inactive Conditional Use Permits
APPLICANT: City of Lynwood
REQUEST
The City of Lynwood is requesting that the Planning Commission conduct a public
hearing on previously approved Conditional Use Permits (CUP) in order to terminate
approvals due to land use inactivity.
BACKGROUND
The City of Lynwood recognizes that certain uses, due to the nature of the use,
intensity, or size, require special review to determine if the proposed use or
location of that use is compatible with surrounding uses. Through the imposition of
development and use conditions, the City can ensure that a conditionally permitted
use is compatible with surrounding uses. Currently, the City requires that a CUP be
obtained in order to operate a variety of uses including, but not limited to, truck
storage, church uses, and homeless shelters.
A CUP approved by the City of Lynwood's Planning Commission and granted
pursuant to the provisions of the Lynwood Zoning Code runs with the designated
land. A CUP continues to be valid upon change of ownership of the land or any
lawfully existing building or structure on the land, so long as the use for which the
CUP is granted is exercised.

ANALYSIS & DISCUSSION
Section 25 -130 -8 of the Lynwood Municipal Code (LMC) allows the City and its
Planning Commission, as well as the City Council within its discretion, to review and
modify a CUP based on changed circumstances. Changed circumstances include,
but are not limited to, a modification of the business, a change in scope, emphasis,
size or nature of a business, or the expansion, alteration, reconfiguration, or
change of use.
Periodic review of CUPs is important in order to ensure that uses are still consistent
with established Conditions of Approval as well as consistent with the goals and
objectives of the City's General Plan. Additionally, by terminating inactive CUPs, the
City can ensure that new business owners are not permitted to operate under out-
dated Conditions of Approval.
In researching expired or inactive CUPs, staff identified eight (8) cases between the
years of 2000 -2010 in which the uses currently being exercised on the properties
are not the uses that were originally approved under the CUPs; in other words, the
uses under the CUPs were discontinued or abandoned. The eight CUPs that staff
identified were granted for land use purposes such as live dancing, teen counseling
and child care services. Those uses have been discontinued or abandoned at their
respective properties. Please see table below:

In order to confirm that the uses approved under the eight CUPs have been
discontinued or abandoned, staff worked closely with the Business License Division
to review license records. A review of records indicates that the eight inactive CUPs
do not have current business licenses. Additionally, staff conducted physical site
inspections to verify if the eight CUPs might be operating without the benefit of City
business licenses. The inspection found that in some cases, the original building
location had been demolished or the use had changed.
From staff's research of business license records and on -site inspections, it was
determined that the uses and circumstances surrounding the eight CUPs had
changed dramatically, which warrants a review by the Planning Commission. In
light of the changed circumstances, staff recommends that the Planning
Commission terminate conditional land use approvals for the eight identified CUPS.
As part of the public hearing process, staff mailed out notices to all current
property owners in order to inform them of the City's proposal to terminate inactive
CUPS.

ENVIRONMENTAL ASSESSMENT
The Development Services Department has determined that proposed project is
categorically exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15301 (Existing Facilities).
RECOMMENDATION
Staff recommends that the Planning Commission approve Resolution No. 3282
terminating conditional land use approvals for Resolution No. 2781, 2799, 2817,
2899, 2916, 2921, 3165 and 3182.

business at 11148 Atlantic Avenue, but the sewing business has changed to a retail
market; and
WHEREAS, CUP No. 2002 -20 was approved by Resolution 2899 for a child
care center at 11181 Bullis Road, but the child care center has changed to a
residence; and
WHEREAS, CUP No. 2002 -29 was approved by Resolution 2916 for a child

WHEREAS, CUP No. 2007 -10 was approved by Resolution 3182 for an auto
parts sales center at 3030 Martin Luther King Jr. Boulevard, but the auto parts
sales center has changed to an auto repair shop; and
WHEREAS, the City staff conducted a review of the above conditional uses
approved under the CUPs to determine whether a changed circumstance existed at
any of the properties or for any of the uses, and specifically, conducted a review of
business license records associated with the uses at the properties and an on -site
inspection of each of the properties; and
WHEREAS, the Lynwood Planning Commission, pursuant to law, on June 14,
2011 conducted a public hearing; and
WHEREAS, the Planning Commission considered all pertinent testimony
offered at the public hearing; and
WHEREAS, the Development Services Department has determined that
the proposed project is categorically exempt from the California Environmental
Quality Act (CEQA) pursuant to Section 15301 (Existing Facilities);
NOW THEREFORE THE PLANNING COMMISSION HEREBY FINDS AND
DETERMINS AS FOLLOWS:
Section 1. The Planning Commission finds the above recitals are true and
correct and are incorporated herein by this reference.
Section 2. With respect to CUP No. 2000 -15 approved by Resolution No.
2781, the Planning Commission hereby finds and determines as follows:

approved under CUP No. 2000 -15.
CUP No. 2000 -15 was approved by Resolution 2781 for a teen center at
12001 Atlantic Avenue. However, upon an on -site inspection of the
property, the building was demolished. A teen center is no longer
operating at the property.
B. That there is no valid business license for the conditional use
approved under CUP No. 2000 -15.
The business license for the conditional use approved under CUP No.
2000 -15 expired on December 31, 2006 and has not been renewed.
Section 3. With respect to CUP No. 2000 -23 approved by Resolution No.
2799, the Planning Commission hereby finds and determines as follows:
A. That there are changed circumstances in the conditional use
approved under CUP No. 2000 -23.
CUP No. 2000 -23 was approved by Resolution 2799 for an auto sales
center at 10733 -10749 (10821) Long Beach Boulevard. However, upon
an on -site inspection of the property, an eating establishment was
operating in place of the auto sales center. An auto sales center is no
longer operating at the property.
B. That there is no valid business license for the conditional use
approved under CUP NO. 2000 -23.
The business license for the conditional use approved under CUP No.
2000 -23 expired on January 1, 2003 and has not been renewed.
Section 4. With respect to CUP No. 2000 -34 approved by Resolution 2817,
the Planning Commission hereby finds and determines as follows:
A. That there are changed circumstances in the conditional use
approved under CUP No. 2000 -34.
CUP No. 2000 -34 was approved by Resolution 2817 for a sewing
business at 11148 Atlantic Avenue. However, upon an on -site inspection
of the property, a retail market was operating in place of the sewing
business. A sewing business is no longer operating at the property.
B. That there is no valid business license for the conditional use
approved under CUP No. 2000 -34.
The business license for the conditional use approved under CUP No.
2000 -34 expired on December 31, 2004 and has not been renewed.

Section 5. With respect to CUP No. 2002 -20 approved by Resolution 2899,
the Planning Commission hereby finds and determines as follows:
A. That there are changed circumstances in the conditional use
approved under CUP No. 2002 -20.
CUP No. 2002 -20 was approved by Resolution 2899 for a child care
center at 11181 Bullis Road. However, upon an on -site inspection of the
property, a residence was in place of the child care center. A child care
center is no longer operating at the property.
B. That there is no valid business license for the conditional use
approved under CUP No. 2002 -20.
The business license for the conditional use approved under CUP No.
2002 -20 expired on December 31, 2005 and has not been renewed.
Section 6. With respect to CUP No. 2002 -29 approved by Resolution 2916,
the Planning Commission hereby finds and determines as follows:
A. That there are changed circumstances in the conditional use
approved under CUP No. 2002 -29.
CUP No. 2002 -29 was approved by Resolution 2916 for a child care
center at 3590 Imperial Highway. However, upon an on -site inspection
of the property, a commercial office was operating in place of the child
care center. A child care center is no longer operating at the property.
B. That there is no valid business license for the conditional use
approved under CUP No. 2002 -29.
The business license for the conditional use approved under CUP No.
2002 -29 expired on December 31, 2002 and has not been renewed.
Section 7. With respect to CUP No. 2003 -01 approved by Resolution 2921,
the Planning Commission hereby finds and determines as follows:
A. That there are changed circumstances in the conditional use
approved under CUP No. 2003 -01.
CUP No. 2003 -01 was approved by Resolution 2921 for a dance hall at
3539 Martin Luther King Jr. Boulevard and 3898 Abbott Road. However,
upon an on -site inspection of the property, the building was demolished.
A dance hall is no longer operating at the property.
B. That there is no valid business license for the conditional use
approved under CUP No. 2003 -01.
The business license for the conditional use approved under CUP No.
2003 -01 expired on December 31, 2004 and has not been renewed.

Section 8. With respect to CUP No. 2007 -02 approved by Resolution 3165,
the Planning Commission hereby finds and determines as follows:
A. That there are changed circumstances in the conditional use
approved under CUP No. 2007 -02.
CUP No. 2007 -02 was approved by Resolution 3165 for a private school
at 3200 Mulford Avenue. However, upon an on -site inspection of the
property, a commercial office was operating in place of the private
school. A private school is no longer operating at the property.
B. That there is no valid business license for the conditional use
approved under CUP No. 2007 -02.
The business license for the conditional use approved under CUP No.
2007 -02 expired on December 31, 2009 and has not been renewed.
Section 9. With respect to CUP No. 2007 -10 approved by Resolution 3182,
the Planning Commission hereby finds and determines as follows:

CUP No. 2000 -23, CUP No. 2000 -34, CUP No. 2002 -20, CUP No. 2002 -29, CUP No.
2003 -01, CUP No. 2007 -02, and CUP No. 2007 -10 based on changed
circumstances, specifically change in or discontinuance /abandonment of use.

Section 2. The Planning Commission of the City of Lynwood, based upon the
aforementioned findings and determinations, hereby approves Conditional Use Permit
No. 2000 -15, provided the following conditions are implemented, observed and
complied with at all times.
COMMUNITY DEVELOPMENT DEPARTMENT
The subject property shall comply with all applicable regulations of the Lynwood
Municipal Code, the California Building Code, the Health and Safety Code and
the Uniform Fire Code.
2. Any proposed subsequent modification of the subject site or structure thereon
shall be first reported to the Community Development Department, Planning
Division, for review.

3. The applicants and /or their representative shall sign a Statement of Acceptance
stating that they have read, understand, and agree to all conditions of this
resolution prior to issuance of a permanent certificate of occupancy and business
license for the teen center.
4. The teen center shall become operational within 180 days of the issuance of this
approval. It not utilized, the approval for the teen center shall become invalid.
5. Other than supervisors, performers or volunteers assisting the applicant, patrons
shall be a minimum thirteen (13) years of age and a maximum eighteen (18)
years of age.
6. Hours of operation shall be limited as follows: School days — 3:00 p.m. to 9:00
p.m.; other days 10:00 am. to 9:00 p.m.
7. One (1) handicap- parking stall shall be provided that meets all ADA standards
(i.e. delineation, signs and dimensions).
8 A sign plan shall be submitted to the Community Development Department prior
to installing any signage. In addition, paint and exterior treatments shall be
approved by the Planning Division prior to alterations.
9. At all times the maximum occupancy shall be forty -nine (49) persons within the
structure.
10. At all times the teen center is open, at least one person a minimum of eighteen
(18) years of age shall be present to supervise the premises.
11. During business hours, access to the parking lot shall be available at all times. A
security fence and /or gate shall be permitted and shall only be secured when the
teen center is not open to the public.
BUILDING AND SAFETY
12. All construction shall meet or exceed the minimum building standards that are
referenced in the following codes:
The Uniform Building Code — 1997 edition;
The Uniform Plumbing Code — 1997 edition;
The Uniform Mechanical Code — 1997 edition;
The Uniform Fire Code — 1997 edition;
The National Electric Code — 1996 edition;
All as amended by the California Building Code of 1998.
In case where the provisions of the California Building Code, the City of Lynwood
Municipal Code, or the plans or specifications in these plans may conflict, the
more restrictive provisions shall govern.
Section 3. A copy of the Resolution No. 2781 and its conditions shall be
delivered to the applicant:

applicable provisions of the Zoning Ordinance as stated in the conditions
below. The conditions of approval are a result of standards set forth in the
Lynwood Municipal Code and comments for other applicable departments

S ection 2. The Planning Commission of the City of Lynwood hereby approves the
Conditional Use Permit No. 2000 -23, subject to the following conditions:
1. The proposed development shall comply with all applicable regulations of the

Planning Division and Building and Safety Division for plan check approval.
7. The property owner shall remove and not store inoperable vehicles, trailers,
campers, automotive parts, equipment, junk, trash, debris or rubbish anywhere
on the property, except within an enclosed building or approval rubbish bins.
8. A minimum of seven percent (7 %) of the gross property area shall be
landscaped and have automatic irrigation systems. Details landscaping and
irrigation plans shall be submitted to the Planning Division prior to a business
license being issued for the used car sales lot.
9. The property owner shall have a separate business license for each tenant on the
property. The property owner shall notify the Planning Division prior to future
lease agreements for tenant space.
10. The property owner shall provide employee and customer parking spaces in
accordance with the plot plan approved January 9, 2001 and on file in the
Planning Division. Such parking stalls shall be permanently paved, delineated
and have bumper guards.
11. All vehicle access areas shall be permanently paved, maintained, and kept clear
for vehicle access. Such aisles shall not be utilized for vehicle storage, vehicle
parts, equipment or rubbish.
12. All signs shall be repaired and upgraded to the satisfaction of the Planning
Division. The property owner shall submit a comprehensive sign plan for all
current and proposed signs.
13. The trash enclosure shall have solid masonry walls on three (3) sides and a solid
sight- obscuring gate.
14. The trailer identified as an auto sales office at 10749 Long Beach Boulevard shall
be removed from the property.
15. One (1) off - street loading space shall be provided. Such loading space shall
measure a minimum ten feet (10) by twenty -five feet (25�.
16. Detailed Floor plans and elevations shall be submitted for all auto repair and
office structures prior to business license approval.
17. The hours of operation for all business activities and tenants shall be limited to
7:00 am. to 8:00 p.m.
18. All lighting shall be directed away from adjacent properties.
19. All air conditioners, heating, cooling, ventilation or other such mechanical
equipment shall be screened from Long Beach Boulevard and shall not generate
excessive noise to adjacent properties.
20. The property shall be maintained in a clean and sanitary condition at all times.
21. No person shall reside, sleep or stay overnight at the premises.
22. This conditional use permit shall be brought back before in the Planning
Commission in six (6) months for review of conditions and status of the property.
REDEVELOPMENT AGENCY
23. All auto repair areas shall be within enclosed buildings or inside an auto bay
building.
24. All storage shall be within an enclosed building.

Development a program encouraging employee to use public transit.
7. The Cutting and sewing shop shall provide adequate vehicular circulation, with
respect to the loading area, so as not to create traffic problems.
8. All work must be conducted in an enclosed structure.
9. A sign permit is required prior to installing any sign on the property.
10. All structures shall be sufficiently soundproofed to prevent annoyance or detriment
to surrounding properties.
11. All activities as described herein shall be confined to the hours between seven
o'clock (7:00) A.M. and eight o'clock (8:00) P.M. daily.
12. Any artificial light shall be designed to reflect away from adjoining properties.
13. Refuse Storage Areas: Garbage or trash receptacles shall be metal or plastic
containers equipped with overlapping, fly -tight lids, or other comparable containers,
as may be approved by the Director of Community Development. Such containers
shall be stored in an area that is enclosed on three (3) sides by a solid masonry and
equipped with a latched gate. The wall should be at least six feet (6) in height.
14. There shall be no outside storage of materials or equipment of any kind.
15. The owner or operator shall maintain a pro- active approach to the elimination of
graffiti from the structure(s), fences, and any accessory building(s) on a daily basis.
16. The existing property shall be cleaned and maintained in a sanitary, neat, and
orderly manner at all times. Failure to comply may result in revocation of the
Conditional Use Permit No. 2000 -34.
17. A cover sheet of approved conditions under this resolution must be printed on the
cover page of the plans prior to submission to the Building and Safety Division.

13. The City of Lynwood vehicle maintenance division shall inspect the shuttle
bus /van for safety and maintenance and provide a report to the Planning
Commission.

WHEREAS, the Lynwood Planning Commission, pursuant to law, on November
12, 2002 conducted a public hearing on the subject application; and
WHEREAS, the Planning Commission considered all pertinent testimony offered

proposal is categorical exempt from the provisions of the CEQA Guidelines pursuant to

allowing the operation of a daycare center at the subject site. The applicant shall

13. The elevator shall remain accessible at all times.
14. The operator of the day care facility shall advise all clients of drop off and
pickup procedures , including clients not blocking vehicle access and circulation

conforming to AWWA Standard C503 -75 or approved equal. All installations

8. The applicant shall submit a detailed security plan to the Planning Division.
Such security plan shall address the interior and exterior of the establishment
and be maintained for the duration of the conditional use permit.
9. Prior to installing or altering any signs, the applicant shall submit a sign plan and
application to the Planning Division.
10. Their shall be no adult entertainment activities at any time pursuant to Lynwood
Municipal Code Section 25- 16.19.
11. All conditions of approval shall be printed on the cover page of plans prior to
submittal to the Building Division for any permits.
12. A trash enclosure shall be provided and surrounded on three (3) sides by solid
masonry, brick or concrete walls a minimum of five feet (5') in height and shall be
enclosed with a solid sight- obscuring gate of the same height. The refuse
container(s) shall have secure lids.
13. At no time shall the bar area be open or operate between 2:00 a.m. and 6:00
a.m. daily. No alcohol sales between 2:00 a.m. and 6:00 a.m.

14. The applicant shall not exceed building occupancy loads as established under
the Uniform Building Code, Los Angeles County Fire Code, or which may be

17. The applicant shall submit a detailed landscaping and permanent irrigation plans

alterations, the land use will not significantly impact properties in the vicinity and
the public health, safety and welfare would be protected.
C. That the site for the proposed conditional use is of adequate size and
shape to accommodate the use and buildings proposed.
The tenant space for the private learning center totals 1,600 square feet in area
and can adequately accommodate classrooms, conference rooms and other space
to conduct the tutoring activities.
D. That the proposed conditional use complies with all applicable
development standards of the zoning district; and
The private learning center will comply with all development standards set forth in
the Lynwood Municipal Code except parking. A variance is required.
E. That the proposed conditional use observes the spirit and intent of this
Zoning Code.
The private learning center is consistent with the C13-1 zoning that allows

Se ction 2. The Lynwood Planning Commission hereby approves Conditional Use

7. The private learning center shall not exceed occupancy capacities set forth by the
Los Angeles County Fire Department and California Building Code (i.e. 38 persons).
8. The operators of the private learning center shall keep accurate and current records
of all persons attending the facility.
9. All persons offering tutoring services at the private learning center shall submit
copies of qualifications to include but not be limited to high school diploma, college
diploma, teaching credentials.
10. The private school shall comply with noise limitations set forth in Lynwood Municipal
Code Section 3 -12 and shall not impact adjacent businesses.
11. Prior to occupancy, the applicant shall submit to the Development Services
Department proof of Fire Department approval either by an approval letter or
stamped approved plans.
12. The applicant shall obtain a City of Lynwood business license and keep such license
current and up to date.
13. A parking variance must be granted by the Lynwood Planning Commission otherwise
this conditional use permit approval shall be null and void.
13A. The private learning center shall provide tutoring services in core courses to include
math, grammar, spelling, English, history, etc. The learning center shall not provide
tutoring in courses that require conditional use permits to include but not be limited
to automotive uses.

FURTHER DESCRIBED AS ASSESSOR PARCEL NUMBER
6170- 025 -003, CITY OF LYNWOOD, COUNTY OF LOS
ANGELES, STATE OF CALIFORNIA (AMENDED BY PLANNING
COMMISSION MAY 8, 2007)
WHEREAS, the Lynwood Planning Commission, pursuant to law, on May 8, 2007
conducted a public hearing on the subject application; and
WHEREAS, the Planning Commission considered all pertinent testimony offered
at the public hearing; and
WHEREAS, the Development Services Department has determined that the
proposal is categorically exempt from the California Environmental Quality Act (CEQA)
guidelines pursuant to Section 15301(a).
Section 1. The Planning Commission hereby finds and determines as follows:
A. That the proposed Conditional Use is consistent with the General Plan.
The General Plan Designation for the subject property is Heavy Commercial which
is consistent with the C -3 and P -1 zoning designations. The project is consistent
with the General Plan policies and goals in the Land Use Element, and Economic
Development Element.
B. That the nature, condition, and development of adjacent uses, buildings,
and structures have been considered, and that the use will not adversely
affect or be materially detrimental to these adjacent uses, buildings, or
structures;
The business would be consistent with the C -3 zone development standards to
include but not be limited to setbacks, building height, landscaping and parking.
C. That the site for the proposed conditional use is of adequate size and
shape to accommodate the use and buildings proposed.
The site is appropriate in size to allow the operation of the proposed land use.
D. That the proposed conditional use complies with all applicable
development standards of the zoning district; and
The business would comply with all development standards set forth in the LMC.
No variances are necessary.
E. That the proposed conditional use observes the spirit and intent of this
Zoning Code.
The project would comply with all development standards set forth in the LMC.
S ection 2. The Planning Commission of the City of Lynwood hereby approves
Conditional Use Permit No. 2007 -10, subject to all conditions, restrictions and limitations
set forth as follows:
CONDMONS OF APPROVAL
1. The conditional use must be acted upon within one year. The Conditional
Use Permit shall become null and void 36S days from the date of approval
if not acted on within this period. One extension of 1 year may be granted
if the extension is requested in writing prior to the end of the valid period,
at the discretion of the Development Services Department.
2. The project shall comply with all regulations and standards set forth in the
Lynwood Municipal Code, the California Building Code, the Los Angeles County Fire
Code and all City Departments.
3. The project shall be developed in accordance with plans approved by the Lynwood
Planning Commission and on file in the Development Services Department, Planning
Division.
4. Any proposed subsequent modification of the subject site or structures thereon,
shall be first reported to the Development Services Department, Planning Division,
for review of said modifications.
5. The property owner shall sign a Statement of Acceptance stating that he /she has
read, understands, and agrees to all conditions of this resolution prior to issuance
of any permits.
6. Conditions of approval shall be printed on plans prior to submission to the Building
and Safety Division for plan check.
7. The subject property shall be used, solely, and only for selling and installing auto
parts. No subleasing is permitted.
8. This resolution may be considered for revocation if all conditions of approval are not
met and complied with at all times.
9. No storage of vehicles or products shall be stored in the public right of way. No large
commercial vehicles (i.e. big rigs) shall be permitted.
10. The applicant shall provide adequate vehicular circulation so as not to create traffic
problems. The applicant shall not trespass onto adjacent properties or within the
public right -of -way.
11. All work must be conducted on site within the existing building.
12. Prior to the installation of signs, the applicant or tenant shall submit detailed plans
and obtain applicable permits.
13. Business owner may not install flashing signs, roof sings, portable signs, including A-
frames and sandwich boards. Business owner may not paint any wall signs, place
inflatable signs, balloons or flags, and may not place any signs in the public right of
way. Signs shall not be installed on trees, light poles, fences or landscaping features.
14. Business owner must maintain an active business license at all times. Business
license shall be posted in a conspicuous place.
15. Any artificial light shall be directed to reflect away from adjoining properties. The
applicant shall submit a detailed lighting plan to the Planning Division prior to
occupancy.
16. Refuse Storage Areas: Garbage or trash receptacles shall be metal or plastic
containers equipped with overlapping, Fly -tight lids, or other comparable containers,
as may be approved by the Director of Development Services. Such containers shall
be stored in an area that is enclosed on three (3) sides by a solid masonry and
equipped with a latched gate. The wall should be six feet (6) in height.
17. The applicant shall secure refuse service from the City contracted company
BUILDING AND SAFETY DIVISION
18. All construction shall meet or exceed the minimum building standards that are
referenced in the following codes.
➢ The Uniform Building Code - 2004 edition;
The Uniform Plumbing Code - 2004 edition;
The Uniform Mechanical Code - 2004 edition
➢ The Los Angeles County Fire Code — 2004 edition;
The National Electric Code — 2004 edition;
All as amended by the California Building Code of 2004.
In cases where the provisions of the California Building Code, the City of
Lynwood Municipal Code, or the plans or specifications in these plans may
conflict, the more restrictive provisions shall govern.
PUBLIC WORKS/ ENGINEERING
19. Reconstruct damaged sidewalk and driveway approach along Capistrano Avenue
(southwest corner).
20. Remove existing palm trees along Martin Luther King Jr. Blvd and
Capistrano Ave.
21. Subject to Public Works Department direction, the applicant shall
remove existing palm trees along Martin Luther King Jr. Boulevard, and
Capistrano Avenue, and install four (4) 36" box street tree(s) per APWA
standards, 3 on Capistrano Ave, and i on Martin Luther King Jr. Blvd.
23. Regrade parkway and landscape with grass.
24. A permit from the Engineering Division is required for all off -site improvements.
25. This development is subject to the City's Standard Urban Stormwater Mitigation
Plan Ordinance (SUSMP).
26. Remove curb along Martin Luther King Jr. Blvd.
27. No work on vehicles allowed outside in the open.
28. No storage of chemicals outside in the open.
29. Owner shall comply with stormwater regulations, and implement best
management practices as related to stormwater regulations.
LOS ANGELES COUNTY FIRE DEPARTMENT
30. The applicant shall comply with all conditions set forth by the Los Angeles County
Fire Department for this application. Please contact the Los Angeles County Fire

Section 3. A copy of Resolution 3182 shall be delivered to the applicant.
