RESOLUTION 8 -2015
RESOLUTION AUTHORIZING THE WRITE -OFF OF CERTAIN FEES AND PENALTIES
WHEREAS, The Richmond Sanitary District (RSD) of the City of Richmond, Indiana has determined
that it is cost - prohibitive and ineffective to attempt legal ly- permitted collection
procedures, including the placement of liens on property, on certain delinquent storm
water accounts of minimal amounts which remain unpaid; and
WHEREAS, Indiana Code Section 8- 1.5- 5 -30(k) provides that a storm water management board may
write off a fee or penalty that is for less than forty dollars ($40) which has been due and
unpaid for at least ninety (90) days; and
WHEREAS, The Storm Water Management Board of the City of Richmond, Indiana has determined
that it is in the best interest of the efficient operation of the Richmond Sanitary District to
delegate this authority to the officer charged with the collection of storm water fees and
penalties, the operating authority of the Richmond Sanitary District.
NOW, THEREFORE, BE IT RESOLVED BY THE Storm Water Management Board of the City of
Richmond, Indiana, that:
1. The Richmond Sanitary District, through its officers, is hereby authorized, on behalf of
the Storm Water Management Board of the City of Richmond, Indiana, to write -off such
storm water fees and penalties, which are less than forty dollars ($40) per account, which
remain unpaid for at least ninety (90) days, as it deems appropriate and advisable.
All of which is adopted and approved this as day of �r 2015, to be effective
immediately upon adoption.
