HomeMy Public PortalAbout19950220REGULAR COUNCIL MEETING, FEBRUARY 20, 1995 CALL TO ORDER The Regular Council Meeting of February 20, 1995, was called to order at 7:30 P.M. with Mayor Louise Gardner presiding. Prayer was offered by Father Conrad, St. Peters Church, followed by the pledge of allegiance. ROLL CALL The following Council Members were present for roll call: Present: Barnicle, Bertel, Byrd, Estes - Benward, Green, Haake, Halsey, Jackson, and Nilges Absent: None A quorum was declared present. PRESENTATIONS FROM THE GALLERY Councilman Jackson stated he felt it inappropriate to allow the presentation from the gallery by Environmental Management Corporation (EMC) for several reasons, and made a motion that the presentation be disallowed. Motion was seconded by Councilman Byrd. Councilman Jackson then called for the question. Call for the question was approved, with Councilman Green voting "Nay." The motion was then approved by the following roll -call vote: Aye: Barnicle, Bertel, Byrd, Estes - Benward, Haake, Halsey, and Jackson Nay: Green and Nilges Presentation from the gallery by Environmental Management Corporation (EMC) was disallowed. Councilman Nilges stated that, although me somewhat agrees with Councilman Jackson's position on this issue, he is opposed to disallowing anyone who wishes to make a presentation to the Council from doing so, and reminded the Council that is the reason he sponsored an ordinance in the past regarding public participation in Council Meetings. CONSENT AGENDA The Consent Agenda consisted of the following items: a) Minutes of February 6, 1995, Council Meeting b) Bid 1533 - Design /Build Fire Station 4 Expansion, Fire Department c) Appointment to Tax Increment Finance Commission James P. Cox, replaces Larry Vincent (term ends 4 -96) REGULAR COUNCIL MEETING, FEBRUARY 20, 1995 Councilman Byrd moved for approval of the Consent Agenda as presented, motion seconded by Councilman Halsey, and approved. MINUTES /REPORTS RECEIVED AND FILED Mayor Gardner stated that the following minutes /reports have been received and are on file in the City Clerk's office: Plumbing Board, 1/25/95; Historic Preservation Commission, 10/25/94 & 11/22/94; City Administrator's Annual Report for 1994 ANNOUNCEMENTS BY MAYOR There were no announcements by the Mayor at this time. BILLS INTRODUCED Bill 94 -194, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING SECTION 19- 401 OF THE CODE OF THE CITY OF JEFFERSON, SCHEDULE V (DISABLED PARKING SPACES), PERTAINING TO A PORTION OF EAST MILLER STREET. Bill 94 -195, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH WAVCO CONSTRUCTION FOR FIRE STATION 4 EXPANSION. Councilman Nilges requested that the rules be suspended and Bill 94 -195 placed on final passage to expedite the process of repairing the damage to Fire Station 4. There were no objections to the request for suspension of the rules. Bill 94 -195 was read third time by title, placed on final passage and passed by the following vote as Ordinance 12243: Aye: Barnicle, Bertel, Byrd, Estes - Benward, Green, Haake, Halsey, Jackson, and Nilges Nay: None Bill 94 -196, sponsored by Councilman Green, Nilges, Bertel & Halsey, entitled: AN ORDINANCE AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI, BY THE ADDITION OF A NEW SECTION PERTAINING TO CITY RECORDS. Bill 94 -197, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE PERSONNEL POLICY MANUAL OF THE CITY OF JEFFERSON, MISSOURI, BY REPEALING SECTION 3 -3. ALCOHOL, DRUG, AND CONTROLLED SUBSTANCE ABUSE AS ADOPTED BY ORDINANCE 12202 AND ENACTING A NEW SECTION IN LIEU THEREOF. REGULAR COUNCIL MEETING, FEBRUARY 20, 1995 Bill 94 -198, sponsored by Councilman Bertel & Nilges, entitled: AN ORDINANCE ESTABLISHING A TEMPORARY BOARD OF REVIEW FOR ALL APPLICATIONS FOR CITY PERMITS AND LICENSES IN NORTH JEFFERSON CITY. Councilmen Bertel & Nilges requested that the rules be suspended and Bill 94 -198 placed on final passage. There were no objections to suspension of the rule. BILLS PENDING Bill 94 -190, sponsored by Councilman Estes - Benward, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING ORDINANCE NO. 12216 PERTAINING TO FRINGE BENEFITS, INCLUDING HEALTH AND RETIREMENT BENEFITS, FOR THE MAYOR AND MEMBERS OF THE COUNCIL, WHICH WAS ENACTED BY COUNCIL ON JANUARY 9, 1995. Councilman Estes - Benward requested that Bill 94 -190 be withdrawn. Bill 94 -191, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING A BUDGET REAPPROPRIATION FOR CONTRACTS IN PROCESS AND PURCHASE ORDERS OUTSTANDING AT OCTOBER 31, 1994, AND TO REBUDGET REVENUES. Councilman Haake requested that Bill 94 -177 remain on the Informal Calendar RESOLUTIONS RS94 -38 - Support for Chamber's Efforts at Expediting Convention Center Development (Green and Nilges). Councilman Green moved for adoption, seconded by Councilman Byrd, and approved. RS94 -39 - Authorizing Application for Section 18(I) Assistance Grant ( Haake). Councilman Bertel moved for adoption, seconded by Councilman Halsey, and approved. REGULAR COUNCIL MEETING, FEBRUARY 20, 1995 COUNCIL LIAISON REPORTS There were no Council Liaison Reports at this time. NEW BUSINESS Councilman Green stated he strongly disapproved of the disallowance of the presentation from the gallery by EMC at the beginning of the meeting, and gave his opinion why he believed the presentation should have been allowed. Councilman Jackson stated he would support the full authority of the Mayor until the her predecessor took office at the April 17 Council Meeting. Councilman Green requested that the Missouri River Regional Library reconsider its holiday closing policy in the future to facilitate citizens who wish to use the library on holidays. APPROVAL OF EXECUTIVE SESSION MINUTES* Mayor Gardner stated that the Executive Session Minutes would be available for the Council Members to review following correction of a clerical error, and suggested they be presented to Council for their review during Executive Session. The meeting would reconvene in open session following the Executive Session to allow the Council to approve the minutes. EXECUTIVE SESSION Councilman Byrd moved that the Council go into Executive Session for the purpose of discussing Real Estate and Litigation, seconded by Councilman Bertel, and approved by the following roll -call vote at 8:35 P.M.: Aye: Barnicle, Bertel, Byrd, Estes - Benward, Green, Haake, Halsey, and Jackson Nay: Nilges APPROVAL OF EXECUTIVE SESSION MINUTES *Council was reconvened in open session with Mayor Louise Gardner presiding. The following Council Members were present: Present: Barnicle, Bertel, Byrd, Estes - Benward, Green, Haake, Jackson, Nilges. Absent: Halsey Councilman Bertel moved to approve the Executive Session Minutes of February 6, 1995, seconded by Councilman Nilges, and approved. There being no further business to come before the Council at this time, Councilman Nilges moved that the meeting be adjourned, seconded by Councilman Byrd, and approved.
