HomeMy Public PortalAbout19950306REGULAR COUNCIL MEETING, MARCH 6, 1995 CALL TO ORDER The Regular Council Meeting of March 6, 1995, was called to order at 7:30 P.M. with Mayor Louise Gardner presiding. Prayer was offered by Councilman Bill Byrd, followed by the pledge of allegiance. ROLL CALL The following Council Members were present for roll call: Present: Barnicle, Bertel, Byrd, Estes - Benward, Green, Haake, Halsey, Jackson, and Nilges Absent: None A quorum was declared present. PUBLIC HEARING (a) Rezoning of Tracts 1, 2 & 3 of Lot 24, Swift & Thompson Subdivision from RA -2 to C -O: Mr. Robert E. Dallmeyer, Jr., 615 -A E. Capitol, Jefferson City, Secretary of the Southwest Group, Inc., spoke in favor of the rezoning. (b) Rezoning of 322, 324, 326 E. Miller from RA -2 to C -1. No one spoke on the proposed rezoning. PRESENTATIONS FROM THE GALLERY Mr. Cecil Payne, Alderman of the City of Osage Beach, Missouri, appeared to present a plaque to the City's Sewer Division in appreciation for the help given during a recent emergency with Osage Beach's sewer system. Mayor Gardner accepted on behalf of the City, and subsequently presented the plaque to Public Works Director, Marty Brose, who stated he would see that it is presented to the proper persons. CONSENT AGENDA The Consent Agenda consisted of the following items: a) Minutes of February 20, 1995, Council Meeting b) Bid 1532 - Street Marking Paint, Public Works c) Termination of Agreement with VALIC d) Appointments to Police Department: Kevin W. Berendzen - Probationary Telecommunications Operator REGULAR COUNCIL MEETING, MARCH 6, 1995 Following questions by Councilman Green regarding the properties of the marking paint in Bid 1532, Councilman Byrd moved for approval of the Consent Agenda as presented, motion seconded by Councilman Halsey, and approved. REGULAR COUNCIL MEETING, MARCH 6, 1995 Mayor Gardner stated she had received a call just prior to the beginning of the meeting to inform her that an agreement had reached between Aerie and Becker Gaming. She discussed details of the agreement which were told to her. REGULAR COUNCIL MEETING, MARCH 6, 1995 Bill 94 -201, sponsored by Councilman Bertel, entitled: AN ORDINANCE AUTHORIZING RETENTION OF MISSOURI PROPERTY APPRAISAL COMPANY FOR THE PURPOSES OF PROVIDING APPRAISAL SERVICES RELATED TO THE FLOOD BUYOUT PROGRAM. Councilman Haake requested that Bill 94 -177 remain on the Informal Calendar UNFINISHED BUSINESS Councilman Green stated he would like to receive a Profit and Loss Statement regarding Bill 94 -200. Councilman Green asked Public Works Director Marty Brose to relay to the State Highway authorities that the condition of trash and litter along the state highways within the City (especially Hwy. 50 west) is unacceptable. Councilman Nilges questioned Finance Director Bette Wordelman regarding the procedure for handling cash and checks issued and deposited. COUNCIL LIAISON REPORTS There were no Council Liaison Reports at this time. NEW BUSINESS Councilman Estes - Benward made a motion that staff be directed to aggressively seek a solution to the negative impact of bars in residential neighborhoods, motion seconded by Councilman Green, and approved unanimously (Councilman Byrd was absent from the Council Chambers at the time of the vote). Councilman Bertel requested that if any further information from the people associated with the river boat is received that Council be given the information, and also suggested REGULAR COUNCIL MEETING, MARCH 6, 1995 that Aerie representatives appear before the Council in the near future to answer questions and make a presentation. APPROVAL OF EXECUTIVE SESSION MINUTES Councilman Nilges moved that the minutes of the February 20, 1995, Executive Session be approved as presented, seconded by Councilman Bertel, and approved unanimously. EXECUTIVE SESSION Councilman Green moved that the Council go into Executive Session for the purpose of discussing Real Estate and Litigation, seconded by Councilman Bertel, and approved by the following roll -call vote at 8:00 P.M.: Aye: Barnicle, Bertel, Byrd, Estes - Benward, Green, Haake, Halsey, and Jackson Nay: Nilges
