Present: Trustees Sherer Hotz Tweed~T Schouten Absent: Trustee Anderson President pro t,em Schouten in the Chair. Clerk and City Atty present The minutes of the meetings of January 23, 24 and 27 were read and approved as read The President pro tem announced that the election of a perman- ent President was in order . '~"~" Trustee Sherer placed the name of Trustee Schouten in nomina~' Lion as President of the Board of Trustees, said nomination upon being - seconded by Trustee Hotz, and no other nominations appearing, Trustee Schouten was elected President of the Board of Trustees by the follow- ing vote: Ayes Sherer Hotz Schouten Noes: Trustee Tweedy Absent: Trustee Anderson The President announced appointments as follows: Trustee Sherer, Commissioner Streets and Parks. Trustee Hotz, Commissioner Fire and Police. Trustee Anderson, Commissioner rater and Lights. ~lrit Coms A communication from the Edison Co regarding payment for cer- tain lighting for Carnival amounting to X20.58 said Company claiming that R Crystal contracted for same in the name of the City, was referred to the Light commissioner A protest against disturbance created by two dogs at 366 East Fern~ood ave was read and referred to the Police Commissioner Applications for positions on the poli~ae force by the follow- ing persons ware read: F E Carpenter, L G Crane, E M Erkfitz, B J Freer. Said applications were referred to the Police Commissioner. Spl Coms Trustee Tweedy reported that he had taken the matter of the installation of a wig-wag at the P E and Modjeska Ave crossing up with P E officials, and had been advised that a report would be made as soon ,-•~ as possible New Bus A new Ordinance entitled "An Ordinance of the Board of Trus- ~~e,~ of the City of Lynwood, Cal. , fixing the s laries of the 'JVater Clerk, ~~ SookkeepP.r and City Marshal; annulling Section~~'2 and 6 of Ordinance No 31 and that portion of Resolution No 63 reading "~SO per month," was read. On motion made and carried said Ordinance was declared read for the f~.rst time and laid over for second reading. A new Ordinance enntitled "An Ordinance of the Board c4f Trus- tees of the City of Lynr~ood, Cal . , fixing water rates in the said pity of Lynwood, and amending and annulling certain portions of Ordinance No 5," was read. On motion made and carried said Ordinance was declared read for the first time and laid over for second reading. The monthly reports of the B`~ater and City Clerk were read, accepted and ordered filed Police Commissioner Hotz recommended that the position of traffic office occupied by E M Er'_~fitz be declared vacant. Trustee Tweedy protested, stating that before taking this action an investiga- tion and hearing sY~.ould be given Mr Erkfitz. A motion by Trustee Hotz seconded by Trustee Sherer that the position of traffic officer occupied by E M Frkfitz be declared vacant, was carried by the following vote: Ayes: Trustees Sherer Hotz Schouten P1oes: Trustee Tweedy Absent: Trustee Anderson The resignation of L J Haslaur as City Marshal was read. A motion by Trustee Hotz seconded by Trustee Sherer that said resignation "' be accepted to take effect at once, was carried by the following vote: A es: Tru t s ees Sherer Hotz Tweed Schouten Y Y Noes: None Absent: Trustee Anderson The resignation of N S Anderson as traffic officer said resig-, nation to take effect at the pleasure of the Board, was read. A motion by Trustee Sherer seconded bar Trustee Hotz that same be received and filed, was carried by the following vote: Ayes: Trustees Sherer Hotz Schouten Noes: None Absent: Trustee Anderson Declined to vote: Trustee Tweedy The resignation of M F Reed as traffic officer, said resigna- Lion to take effect at the pleasure of the Board, was read. A motion by Trustee Sherer seconded by Trustee Hotz that same be received and filed, 1 was carried by the following vote: Ayes: Trustees Sherer Hotz Schouten Noes: None Absent: Trustee Anderson Declined to vote: Trustee Tweedy Trustee Hotz recommended that H B Johnson be appointed as City Marshal. A motion by Trustee Sherer seconded by Trustee Hotz that H B Johnson be appointed City Marshal to hold office during the pleas~rre of the Board, was carried by the following vote: Ayes: Trustees Sherer Hotz Schouten Noes: None Absent: Trustee Anderson Declined to vete~ Trustee Tweec~TT The ~:ty ~.3'e~r~C>~.~dininistereri' t_'h~d,Yr ~af' offi;ce ~t~r.: H B Jb~.a 'son 'a~s1 City Marshal Attorney A A Trippel stated that he represented his client, E M Erkfitz, and demanded a hearing for said client, sating that in the event of a hearing being refused he would advise his client to report for duty as usual. No response was made. The City Attorney reported that in the matter of Marie Stelle vs City of Lynwood in Dept 25 Superior Court ~.eto~irNo 160374 the Court had denied the injunction sought. Trustee Sherer recommended that the ~'3ri~-::°Department proposi- tion be taken up, which was done. C W Roberts, Acting Fire Chief, sake for information regarding his position, pay f ervices rendered from Nov 29 1924 to date, etc. Attorney A A S t t d t hhe e r sented hundreds of clients who were tax payers~~ri~"the C~.ty;~n~ n~'o~"` fled the Board that in the event that skid Board voted to pay the bill of dh~ Roberts for back pay they would be enjoined on the ground that same was not a legal obligation. Mr Roberts insisted on some action in this matter. ~r~stee Hotz recommended that Mr Roberts be given an an8 saver at once, and tY-.at the Fire Engine be housed in a building near the center of the City. The City Attorney advised the Board that the bill of C V7 Roberts was a legal obligation against the City and that same could be ler~a.lly paid.
