HomeMy Public PortalAbout19950417 OLD COUNCILREGULAR COUNCIL MEETING, FIRST SESSION, APRIL 17, 1995 CALL TO ORDER The Regular Council Meeting of April 17, 1995, was called to order at 7:30 P.M. with Mayor Louise Gardner presiding. Prayer was offered by Councilman Mary Bertel, followed by the pledge of allegiance. ROLL CALL The following Council Members were present for roll call: Present: Barnicle, Bertel, Byrd, Estes - Benward, Green, Haake, Halsey, and Jackson Absent: Nilges A quorum was declared present. PRESENTATIONS FROM THE GALLERY Mayor Gardner congratulated Chief Gary Kempker on his recent appointment as Missouri Safety Division Director. Mr. Steve C. Smith from Williams- Keepers presented his firm's audit report on the City of Jefferson. At the conclusion of the presentation, Councilman Green moved that two topics contained in the letters of recommendation be addressed at the next Finance Committee meeting. Those two topics are as follow: (p. 3) "Governmental Accounting Training of Personnel" and (p. 5) "Monthly Review of Financial Statements." Motion was seconded by Councilman Bertel, and approved unanimously Mayor Gardner recognized the Cedar Hills School Boy Scout Webelos Pack 105 who were in attendance at the meeting. CONSENT AGENDA The Consent Agenda consisted of the following items: a) Minutes of April 3, 1995, Council Meeting b) Minutes of April 11, 1995, Special Council Meeting Councilman Byrd moved that the Consent Agenda be approved, motion was seconded by Councilman Jackson, and approved unanimously. BIDS OVER $25,000 a) Sole Source Procurement - Nefco, Inc., Current Baffles, Water Pollution Control Plant REGULAR COUNCIL MEETING, FIRST SESSION, APRIL 17, 1995 Councilman Bertel that the bid be approved, motion was seconded by Councilman Green, and approved unanimously. MINUTES /REPORTS RECEIVED AND FILED Mayor Gardner stated that the following minutes /reports have been received and are on file in the City Clerk's office: 1994 Audit Report. ANNOUNCEMENTS BY MAYOR Mayor Gardner announced that the April Yard of the Month Award winners were Eric & Christine West, 2115 St. Mary's Blvd. Mayor Gardner distributed copies of the Boards and Commissions Directory. BILLS PENDING Bill 94 -213, sponsored by Councilman Nilges, entitled: AN ORDINANCE AMENDING THE CODE OF THE CITY OF JEFFERSON BY ENDORSING AN INTERGOVERNMENTAL PURCHASING AGREEMENT WITH THE CITY OF JEFFERSON CITY, MISSOURI. Bill 94 -213 was read third time by title, placed on final passage and passed by the following vote as Ordinance 12267: Aye: Nay: Barnicle, Bertel, Byrd, Estes - Benward, Green, Haake, Halsey, and Jackson None Bill 94 -214, sponsored by Councilman Nilges, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE 1994 -95 BUDGET OF THE CITY OF JEFFERSON, MISSOURI, BY APPROPRIATING ADDITIONAL FUNDS WITHIN THE GENERAL FUND AND THE PARKS AND RECREATION FUND. Bill 94 -214 was read third time by title, placed on final passage and passed by the following vote as Ordinance 12268: REGULAR COUNCIL MEETING, FIRST SESSION, APRIL 17, 1995 Aye: Nay: Barnicle, Bertel, Byrd, Estes - Benward, Green, Haake, Halsey, and Jackson None Bill 94 -215, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND DISCONTINUING THE RIGHT -OF -WAY FOR A PORTION OF ADAMS STREET. Councilman Haake moved to amend Bill 94 -215 by substituting the following Section 1 in lieu of Section 1 in the bill as introduced: Section 1. The Council of the City of Jefferson, Missouri, hereby declares it necessary, reasonable and proper to discontinue as a street right -of -way and forever vacate the following described street right -of -way in said City: All that part of the Adams Street right -of -way adjoining the southerly line of Inlot #723 of the City of Jefferson, Cole County, Missouri, said part thereof described as follows: "Beginning" at the southeasterly corner of said Inlot #723; thence S 39° 57' W, along the southerly line of said Inlot, 160.00 feet, said point being 9.00 feet easterly from the easterly right -of -way line of U.S. Route 50 -63; thence S 69° 48' E, 28.70 feet; thence N 39° 57'; E, parallel with and 27.0 feet southerly from the southern line of said Inlot #723, 150.30 feet; thence N 50 °00'W, along the extension of the northerly line of said Inlot, 27.00 feet to the point of "Beginning", containing 0.10 acres, subject to all current easements of record. Motion to amend was seconded by Councilman Estes - Benward, and approved unanimously. Bill 94 -215 was read third time by title, placed on final passage and passed, as amended, by the following vote as Ordinance 12269: Aye: Nay: Barnicle, Bertel, Byrd, Estes - Benward, Green, Haake, Halsey, and Jackson None Bill 94 -216, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING A CERTAIN EASEMENT FOR UTILITY PURPOSES ON A PORTION OF TIMBER HILLS SUBDIVISION, SECTION 4. Councilman Estes - Benward withdrew Bill 94 -221. Bill 94 -222, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO A STATE BLOCK GRANT AND AGENCY AGREEMENT WITH THE MISSOURI HIGHWAY AND TRANSPORTATION COMMISSION FOR LAND ACQUISITION FOR THE JEFFERSON CITY MEMORIAL AIRPORT. Bill 94 -226 was read third time by title, placed on final passage and passed by the following vote as Ordinance 12275: Aye: Nay: Barnicle, Bertel, Byrd, Estes - Benward, Green, Haake, Halsey, and Jackson None INFORMAL CALENDAR Bill 94 -199, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO AN AGREEMENT WITH SHO -ME COACH LINES, INC., FOR INTER -CITY BUS ROUTE. Councilman Haake requested that Bill 94 -199 be withdrawn. REGULAR COUNCIL MEETING, FIRST SESSION, APRIL 17, 1995 Bill 94 -200, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO A SECTION 18(1) GRANT AGREEMENT FOR PUBLIC TRANSPORTATION PROJECT. Councilman Haake requested that Bill 94 -200 be withdrawn. COUNCIL LIAISON REPORTS There were no Council liaison reports at this time. UNFINISHED BUSINESS Councilman Jackson made a statement commending the service of outgoing Mayor Louise Gardner, Councilman Randy Halsey and Councilman Mary Estes - Benward. Mr. Gary Plummer with the Chamber of Commerce presented a plaque to outgoing Mayor Louise Gardner. Mayor Gardner presented plaques to outgoing Councilmen Halsey and Estes - Benward, and also to Councilman Barnicle who has announced his resignation will be effective April 30, 1995, and thus this will be his last regular Council Meeting. Councilman Green presented a plaque on behalf of the City Council Members to outgoing Mayor Louise Gardner. Mayor Gardner made statements regarding her service with the City, and expressed her appreciation for the help given her by staff of the City. Each of the outgoing Council Members also made comments regarding their service to the City. APPROVAL OF EXECUTIVE SESSION MINUTES Councilman Byrd moved that the Executive Session minutes of April 3, 1995, be approved, motion was seconded by Councilman Green, and approved unanimously. ADJOURNMENT SINE DIE Councilman Green moved that the Council adjourn Sine Die to allow the oaths of office be administered to the newly elected City officials, motion was seconded by Councilman Bertel, and approved unanimously. REGULAR COUNCIL MEETING, FIRST SESSION, APRIL 17, 1995 OATHS OF OFFICE ADMINISTERED The oaths of office were administered to the following newly elected officials by the Honorable Tom Sodergren, Associate Judge, 19th Judicial Circuit: Duane Schreimann - Mayor Charles W. Jackson - First Ward Councilman James Haake - Second Ward Councilman Randy Kammerdiener - Third Ward Councilman Carolyn McDowell - Fourth Ward Councilman Larry Vincent - Fifth Ward Councilman Clyde Angle - Municipal Judge Stephan Cotton Walker - City Prosecutor
