The Board of Trustees of the City of Lynwood met in adjourned regu
lar session at the City Hall 205 West Mulford Ave Friday Oct 16 1925 at
7:30 nm.
Present: Trustees Hutchinson Gordy Reed Downey
Absent: Trustee Tweedy
President Downey in the Chair

tlnf brie The City Attorney reported that the Court had issued a modif ica-
tion of the Restraining Order in the Appeal in the Case of Duncan & Nor-

follows:

The in~iznctive order heretofore made herein under date of October
13, 1925, is hereby modified so that the Defendants may, in open session,
omen, examine, and declare. the bids; therefrom determine the lowest respo
Bible bidder; instruct the Cit~r Clerk to return all cash or bonds deposit
ed by the unsuccessful bic~~lers; declare that the contract will be awarded
to such lowest responsible bidder, provided, that upon final determina-
tion of this cause by the Appellate Court the jud~nent of this Court shal
be sustained; and further declare that all otY~er proceedi3~gs be held in
abeyance pending final determination of this action.

`Phe City Attorney recommended that actions in accordance with the
above modification be taken with the exception of the last provision.
A motion by Trustee Reed seconded by Trustee Hutchinson that Fritz
Z.iebarth be declared the lowest responsible bidder, was carried by the
following vote:
Ayes: Trustees Hutchinson Gordy Reed Downey
Noss: None
Absent: Trustee '.Tweedy
A motion by Trustee Gordy seconded by Trustee Hutchinson that the
contract for the work or improvement as contemplated under Resolution of
Intention No 265 be awarded to Fritz Ziebarth in the event that the ,judg
ment of the Superior Court is sustained by the Appellate Court in the
above entitled s.ction, was' carried by the following .vote:

A Motion br, 'T'rustee Reed seconded by Trustee Gordy that the Clerk be
instructed to return all money, or bid bonds, except that of the lowest
bidder. was carried by the following vote:
Ayes: Trustees Iutchinson Gordy Reed Downey
Noes: None
Absent: Trustee Tweedy
