The minutes of the meeting of Feb 11 1926 were read and approved. Writ Coms An application was read from H R Postle for the position of City Engineer, said application was ordered filed Rcpt Comm Water commissioner Murray reported that the new main 11'lstall~tc tion had been completed with the exception of back-filling which would be completed in a few days Street Commissianer Roberts stated that he would~~start a street repair crew in a few days repairing excavations. IInf Bus The Street Commissioner also spoke on the matter of installing a ~ta~fiveway for W B Cr~mley, the same having been promised at the time street improvement was made abutting his property, and asked for au- thority to install same. A motion by Trustee Gordy seconded by Trustee Tweedy that the above'matt8r:•be:~rePerred to the Street Commissioner with authority to act, was carried by the following vote: Ayes: Zrustees Tweedy Roberts Gordy Murray Greenamyer Noes: None Absent: ~ None A new Ordinance entitled "An Ordinance of the Board of Trustees of the City of Lynwood, Cal., annulling Ordinances Nos 53 and 54';vwas read far the second time. A motion by Trustee Tweedy seconded by Trustee Roberts that said Ordinance be declared read for the second time and laid over for third reading and final passage, pas carried by the fol- lowing vote: Ayes: Trustees Tweedy Roberts Gordy Murray Greenamyer Noes : None ~-• Absent: None The matter of the Long Beach Blvd lighting system was now taken uA. The Contractor, Fritz 1iebarth, presented a statement showing the amount charged against the Lighting System Rjob, said amount being X11,538.88. He stated that of this amount certain salvage mi~cht be had. but could present no figures covering same at this time. The City Engineer in compliance with instructions of the Board, presented a statement showing the estimated costs and expenses incur- red by the Contractor to Feb 11 1926 in the installing of the Long Beach Blvd lighting system. Said report showing a tdtal cost of job to that date amounting to X6,114.82. Report ordered filed. In a general discussion regarding the Li~iting System, Geo E Sherer stated that he owned 310 feet of frontage on the Blvd and wanted to see the lights installed. R.4r Strain stated that chile he had no prop- erty on the Blvd that he would like to have the Blvd property owners be given an opportunity to express themselves in this. matter, and decide for themselves what was wanted in the Tray of improvements, and volun- teered his services to notify said property owners in the event that a meeting of said property owners was called. Chas E Drinkwater expressed himself as being opposed to paying the costs from the General Fund in case it was decided to abandon the proceedings already taken, and stated that if lights were to be installed on the Blvd unnecessary expense could be avoided by going ahead at this time under the proceedings al- ready taken. F M 1>owney stated that a bond issue to pay the eosts of the proceedings in case of abandonment would not carry, that the General Fund would have to be re-imt>ursed, in case costs were laid from said Fund, by an increased rate next year. And that he objected as a proper- tq owner on Long Beach Blvd to the annullment and abandonment of the project. . `.1'he pity Attorney stated that abandonment of the proceedings was l~~al, and that expenses could be met by a bond issue or paid from the general fund. He stated that one-fourth of the money necessary to be paid in the event of the abandonment of the said proceedings had been contributed by x~ublic spirited citizens and was in his hands. The City Attorney asked A4r- Giebarth if he would agree to abandon the:wot~k~~~.in case that costs were paid. ;Mr Iiebarth stated that a communication from him was on file, and that he could not answer that question. ~~~ The City Attorney stated that therewcases of record in the E~oui3ts of tha~'Stat~aof California where proceedings had been abandoned under .similar. circumstances. A motion by Trustee `Pweedy seconded by Trustee Murray that a meet- ing of property owners on Long Beach Blvd be .called to meet at the City Hall Saturday ~'eb 20, 1926 at 7:30 pm, was carried by the follow- ing vote: t~yes: Trustees Needy Roberts Gordy- Murray Greenamyer Noes: None Absent: None The President asked Mr `Liebarth what action he contemplated from date to time set for the meeting of the property owners affected. and asked definite figures to present to people. Mr Ziebarth stated that ~ on advice of his counsel that he would proceed with the work under his contract, and that he had legal advice that the Board could not cancel his contract wc~thout his consent. The City Attorney recommended that in view of the Contractor's attitude that the Board adopt a Resolution abandoning, abrogating, an- Holing, terminating and rescinding proceedings pursuant to Resolution of Intention No 265. Stating that said action should be taken to prop- erly protect the City until a final decision was reached. He further stated that in case the people wanted the lights that said Resolution could be repealed, and the work resumed. And that he would prepare a motion so that Mr Zieb~rth could proceed under former contract. A Resolution entitled "A Rasolution of the Board of Trustees of the City of Lynwood, State of Callifornia, abandoning, abrogating, an- nuling, terminating and rescinding proceedings pursuant to Resolution of Intention No 265 of the City of Lynwoad, State of California," was read. On motion by Trustee Tweedy seconded by Trustee Koberts said Resolution being Resolution No 287 was adopted by the following vote: Ayes : Trustees Tweedy Ro£~erts A4urray Greenamyer Noes: Trustee Gordy Absent : None Air Liebarth asked the status of his contract for the installation of the Lighting System. The City Attorney stated that the contract was dead. Mr Flournoy, stating that he rer~resented the Marbelite Corporation said that a special standard had been made for this fob, and would ex- pect protection. New Bus A Resolution entitled "A Resolution of the Board of Trustees of the City of Lynwood, Cal., transferring the sum of Five Hundred Dol- lars 0500.00} from the General Fund to the Clerk's Street Improvement Fund," was read. On motion by Trustee A4urray seconded by Trustee Rob- erts said Resolution being Resolution N~ 286, was adopted by the fol- lowing vote:.
