11 CORPORATION DEED
FOR VALUE RECEIVED, the undersigned, SHORE CLUB LODGE, INC. ,
an Idaho corporation (hereinafter "Grantor") , does hereby convey, release,
remise and forever quitclaim unto THE CITY OF McCALL, an Idaho municipality
(hereinafter "Grantee") , the following described premises, to-wit:
A parcel of land in Section 8, Township 18 North, Range 3
East, Boise Meridian, in Valley County, Idaho, more parti-
cularly described as follows:
Beginning at the West quarter corner of Section 8, Township 18
North, Range 3 East, Boise Meridian; thence North 0°05' West a
distance of 547.25 feet to a point on the North right of way
of the State Highway; thence along_the North right of way of
State Highway, South 73°44' East a distance of 1021.42 feet to

distance of 308.63 feet to a concrete right of way marker on
the West side of Warren Wagon Road; thence southerly a distance

appurtenances thereunto belonging or in anywise appertaining, the reversion
and reversions, remainder and remainders, rents, issues and profits thereof.

Pursuant to our telephone conversation of October 1, 1979, I
am enclosing herewith a fully executed Corporation Deed from Shore Club
Lodge, Inc. , to the City of McCall.
This delivery and recordation of the enclosed deed is condi-
tional and contingent upon the following:
1. Formal and complete vacation of the old Warren Wagon Road ,
right of way;
2. Issuance of a title insurance policy from Safeco Title
Insurance Company in-accordance with the commitment, Order No. . 2446, a
copy of which is enclosed.
By copy of this letter, I am .requesting that Marilyn Schoenhut
pruceed, upon notification from you, to issue the unconditional owner's
policy in accordance with the aforemeiitioned. commitment. I am assuming
that Marilyn will take care of that task as soon as you have notified
her and provided- her with documentation concerning the vacation of the
old road right of way. r

parcels of real property more particularly' described on Exhibit A attached

Enclosed are two copies of the proposed. .Airport Zoning
. Ordinance. The same should be checked carefully prior to its
adoption. However, I believe it to be in proper form. I
would appreciate your looking at Section IX_ concerning Appeals.
The ordinance by-passes the City Planning and Zoning Commission
which would ordinarily deal with zoning problems, and such
appeals would be heard initialT by the Mayor and Council. . In
the event that the Planning and Zoning Commission should have
a voice, I shall redraw page 5 to require that the appeal
process commence with the Planning and Zoning Commission, then
to the Council and then to the District Court.
Also enclosed is a Corporation Warranty Deed from Shore
Club Lodge, Inc. , to the city c � ( s
The deed should be executed by the president
and secretary of the corporation and filed as soon as possible.
Also enclosed is a Quitclaim Deed from the City of McCall to
Shore Lodge to be held by you until the existing right of way
has been abandoned by the city by appropriate ordinances.
Title to- such road by operation of law will vest in Shore Club
Lodge, Inc. , as adjoining land owner on both sides of the old
right of way. In order to perfect record title in Shore Lodge
after such abandonment, the quitclaim deed, upon appropriate
board action, may be executed and delivered to the corporation.

As per our telephone conversation on November 27, 1990, I have
enclosed the original Quitclaim Deed from the State of Idaho to the
City of McCall. Also enclosed is a plat of the area showing the
property being transferred by said Quitclaim Deed.
Would you please review the Deed and if found to be acceptable
have the Deed recorded. Upon completion would you please return a
copy of the Deed to my office which has the recording data on it.

ADMINISTRATOR'S REPORT
DECEMBER 13, 1990
1. Rubber mats, Old Golf Clubhouse: The old locker rooms
floors are covered by a rubber matting. Doug Flaming,
McCall-Donnelly Schools , has asked if the city would
declare this material surplus to allow them to reinstall
it as floor protection in the high school weight room.
2. Nutrient management: We have received notice that our
application for a consistency determination on .Ordinance
572 is complete and a hearing will be held within 90
days of November -27, 1990. -
3 . Notice of Suit: On December 12 , 1990 I was served with
a summons (Case CU-90-244) . Richard and Kathleen Yoakum
vs. City of McCall alleging wrongful death.
4. Warren Wagon Road
a. ) In 1977, the city deeded to Shore Lodge a portion of
the Highway 55 right-of-way . The city had no
authority to make such grant.
b. ) In 1977, the Shore Lodge deeded certain lands to the
city to allow straightening of Warren Wagon Road.
c. ) In 1990, the above facts were learned. The state
has indicated its willingness to deed to the city
the land originally illegally conveyed.
d. ) New deeds must be drawn and accepted and recorded to
correct this matter.
Please indicate your willingness to accept deeds and
grant deeds to resolve this matter. An ordinance may be
required.

Re : Warren Wagon Road-Shore Lodge
Bear Bud :
In order to improve safety conditions at the intersection of
Warren Wagon Road and State Highway 56, in 1979 the City of
11cCall, by ordinance, vacated a portion of the old. Wagon Road
right of way and pursuant thereto deeded the same to Shore Lodge.
Shore Lodge deeded to the city certain land across. the Warren
Wagon Road to aid in relocation of the intersection.
The title company now advises that the vacated portion of Warren
Wagon Road was not a dedicated public street but that title
thereto was in the State of Idaho and question the validity of the
street vacation process.
In any event, 'Tom Derr advises that the state has issued a deed to
the city for the right of way so the city is now in a position to
take such further action that may be required. 'Tom also said that
corrected descriptions have been prepared for use in straightening
out this problem.
Upon my return I shall research the steps to be taken. A new
ordinance may not be required.
Tom Kerr was particularly helpful herein.
