As to any records which you choose not to produce on the basis of claim that the record is privileged kindly provide a Privilege Log or an explanation (pursuant to Chapter 119) as to Your basis for withholding any such records. The original public records request can be found at the following link: http://www2.gulf-stream.org/weblink/0/doc/110397/Page1.aspx Thank you for your public records request for all communications sent or received by one member of the Gulf Stream Police Department from January 1, 2010 through March 20, 2017. The Town notes this request is extremely broad in scope and encompasses more than a seven- year time span. Your request seeks “all records” defined as “E-mails, text messages, letters, memos and other communications” that were “sent or received by John Passeggiata”. In an abundance of caution in determining the below estimate, the Town has also included Gulf Stream Police Department Overtime and Holiday Compensation forms and Gulf Stream Police Department Leave of Absence Request forms. Records not used to determine this estimate include Police Incident Reports generated by John Passeggiata, as the Town does not interpret those records as “communications”. Due to the breadth of your request, the Town estimates to produce more than 1,200 hard and electronic files, and review these files for exemptions, will require 21 hours of administrative support at $37.34 per hour and one hour of IT support at $95.00 per hour, the labor cost of the personnel providing the service, per Fla. Stat. § 119.07(4)(d). Please be advised that this does not account for any unusually large files which may require extensive redaction. If the costs of producing these documents will exceed your deposit, the Town will provide you with an initial production of responsive records and an estimate for the production of any additional responsive records. If the costs of production are less than the deposit, the Town will provide you with the responsive records and a refund. (21 hours @ $37.34 + One hour @ $95.00) = Deposit Due: $879.14 in cash or check. Upon receipt of your deposit, the Town will use its very best efforts to further respond to your public records request in a reasonable amount of time.
