HomeMy Public PortalAbout12-17-2015THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, DECEMBER 17, 2015 The Board of Public Works and Safety of the City of Richmond, Indiana, met at 5:00 P.M., Thursday, , 2015, in the Council Chambers at the Municipal Building, 50 North 5"' Street, Richmond, Indiana. President Robinson called the meeting to order and the following business was conducted: ROLL CALL Board members present were: Vicki Robinson, Tony Foster and Dick Foore. Also in attendance were Kim Vessels, Assistant City Attorney; Karen Chasteen City Clerk; Jeff Gindling, Shaun Staton, Rob Leavitt, Bill McGathey, Fire Department; Ashley Schultz Plan Technician; Beth Fields Urban Enterprise Association; Sarah Mitchell, City Planner; Craig Parker, Esq.; Police Chief Mark Connery; Fire Chief Jerry Purcell; and, Media. APPROVAL OF MINUTES Mr. Foore moved to approve the minutes of December 10, 2015, supported by Mr. Foster. Upon a vote viva voce, the motion carried. CLAIMS FOR PAYMENT Mr. Foster moved to approve the Claims for Payment of December 15, 2015 in the amount of One Hundred Twenty Six Thousand Eight Hundred Eighty Four Dollars and five cents ($126,884.05), supported by Mr. Foore. Upon a vote viva voce, the motion carried. REQUESTS - None BID OPENINGS • ROUND 2, BID 2, DEMOLITION FOR BLIGHT ELIMINATION PROGRAM Bids were received as follows: Mikesell Excavating Culy Contracting Prol-awn Care Complete Demolition Svc. R -35686 (95 -2014) — CHANGE ORDER NO. 10 Lift Stations 1 & 2 Power Cable Modifications Not to exceed $6,176.86 Mr. Foore moved to approve, supported by Mr. Foster. Upon a vote viva voce, the motion carried. Mr. Foore moved to correct the address to 312 NW "K" Street, supported by Mr. Foster. Upon a vote viva voce, the motion carried. • CONTRACT NO. 118 -2015 —CHANGE ORDER NO.2 Culy Construction (Tire Removal — 901 North "H" Street) Not to exceed $685.00 Mr. Foster moved to approve, supported by Mr. Foore. Upon a vote viva voce, the motion carried. ADDENDUMS CONTRACT NO. 83-2015 — CSX TRANSPORTATION Extend .ontract term to February 1, 2016 for soil tests Mr. Foore moved to approve, supported by Mr. Foster. Upon a vote viva voce, the motion carried. Mr. Foore moved to authorize Vicki Robinson to sign any documents relative to this change, supported by Mr. Foster. Upon a vote viva voce, the motion carried. • CONTRACT NO. 118-2015 — ADDENDUM NO.1 Culy Construction - Blight Elimination Program Time extension — no later than March 1, 2016 Mr. Foster moved to approve, supported by Mr. Foore. Upon a vote viva voce, the motion carried. • CONTRACT NO. 142-2015 — ADDENDUM NO.1 Mikesell Excavating — Blight Elimination Program Group A — Not to exceed $54,800.00 Mr. Foster moved to approve, supported by Mr. Foore. Moore is not guilty of the charges 1,Z3,5 and 6 alleged by the Chief the Notice of Hearing. 2. Moor's capacity (change #4) is to be determined in accordance with this Final Order. 3. Moore's capacity to work as a firefighter for the City of Richmond Fir Department shall be determined by Dr. Moffatt using the latest (2013) version of NFPA 1582 as the standard. 4. If Dr. Moffatt determines Moor may be replaced for full duty as a firefighter, Moore shall be assigned to return to his former and regular position as a driver operator. 5. If Dr. Moffatt determines Moore is fit for limited, light or restricted duty, Moore will be assigned to such duty in accordance with SOP 02.12 and Article 34 of the current Labor Agreement. 6. If Dr. Moffatt determines Moore is unfit for duty, Dr. Moffatt's medical opinion shall be forwarded to this Board and this Board will determine whether and when to request a hearing before the Local Pension Board pursuant to Article 30 of the current Labor Agreement and Indiana Code § 36 -8-8- 12.3, 12.5 and 12.7. RECOMMENDATIONS: 1. A FIREFIGHTER RECEIVING A a90 Day Fit for Duty Letter" should not be considered "Unfit for Duty" or to have `failed" the annual physical unless and until the Department receives an `Unfit for Duty" letter from a qualified medical doctor. 2. While the Chief may make initial de6terminations regarding a firefighter's fitness based on his knowledge and experience, He should always rely on a qualified medical doctor, who is knowledgeable and applies the latest local and national standards for firefighter fitness, for the ultimate determination. 3. The physician paid by the Department to determine whether a firefighter is fit for duty should not be the same doctor a firefighter is paying directly when following a medically directed program. This creates a conflict of interest for the doctor 4. If the Chief recommends disciplinary charges against a member and those charges include neglect or violation of a rule, the Chief should specify in the notice to the firefighter exactly which rule the Chief alleges the firefighter neglected or violated. 5. If the firefighter is alleged to have violated an order, the Chief should include in the notice, who the order came from, the approximate date and time the order was given, and the content of the order. If the cost is reasonably similar, this Board would recommend the Department use Dr. Moffatt's office to conduct the Department's annual Article 30 physicals..
