Werrski, Archbishop of the Archdiocese of Miami (Applicand) is the owner of 100 Harbor Drive, Key Biscayne, Florida as more fully described in the legal description attached hereto as E><hibit "{" ('?roperty'); and WHEREAS, pursuant to Section 30-53 of the Village Code of Ordinances fVillage Code"), the Applicant has submitted a Planning and Zoning Application bearing Public Hearing #RV40, seeking to vary the parking lot fiont, parking lot rear, and parking aisle front setback requirements of Section 30-110(k)(1)(a) of the Village Code ('Variance'); and WHEREAS, after proper public notice, the Village Council conducted a public hearing and considered all testimony and other evidence presented and otberwise made part of the record conceming the Variance. NOW, TmREFORE, BE IT RESOL\mD BY THE VTLLAGE COUNCTL OF THE VILLAGE OF KEY BISCAYIYE, FLORIDA AS FOLLOWS: Sectiop 1. Recltals. Eash of the above-stated recitals are hereby adopted confirmed, and iucorporated herein. Secdon 2. Findings. The Village Council finds that the Applicant has met all of the requirenrents in Seotion 30-63 of the Village Code. Specifically, the Village Council finds that the Variance wil[: (a) result in conditions that maintain aad are consistent in all material respects Pagc I of3 with the intent and purpose of the Village Code, and that tho general welfarre, stability and appeafimce of the comnrunity will be protected and maintained; and O) be compatible with the sunounding land uses, and otherwise consistent with the Village Code and the Comprehensive Plan, and will not be detrimental to the community. Secflon 3. @ The Village Council hereby approves the Applicant's r€quest to vary the provisions of Section 30-110(kxlXa) of the Village Code, subject to the conditions set fortb in Section 4 below, to permit a: (1) parking lot front setback variance to provide parking spaces 3'6" from Harbgr.Drive; (2) par{<ing lot rear setback variance to provide a parking lot 5 feet from the rear prcperty line adjacent to Crandou Park; and (3) parking aisle front setback variance to provide a parking aisle adjacent to the porte cochere tapering to a minimum gf one foot from the front property lina Secfion 4. Con$ifrons. The approval granted by this Resolution is subject to compliance with the following conditions: a. The Resolution for this variance mlst be recorded with the Miami-Dade CountyCled( and zubmitted totheVillage Clerk prior toapproval of the Section 5; Recording. This Resolution shall be recorded, prior to the issuance of a building pe{mrt1 by the Applicant at its expense in,tloe.publi.g records of Miami-Dade County, Florida. A copy of thq proof of rpcordation shall be nrbmitted to the Village Clerk prior to the issuance of any building perrrits. 'Secfion 6. Effecfive Dato.
