I tried many times to determine if this claim is true. Today is the 2 year anniversary of my request to you of April 7, 2015 at 7:23 AM in which I again asked that you produce for my inspection ANY PUBLIC RECORDS THAT THE TOWN CLAIMS HAVE BEEN PRODUCED FOR ME THAT I HAVE YET TO PAY FOR OR PICK UP. Therefore I am following up on my request with this request: Please produce for my Inspection any records that were previously produced for me and that I agreed to pay for and that I subsequently did not pay for and did not pick up.. I make this request pursuant to Article 1, Section 24 of the Florida Constitution and Chapter 119 of the Florida Statutes. I do not consider your instructions to me that I should search through over eighteen hundred records to find the few I seek to be providing access to public records "at a reasonable time in reasonable conditions." However, I searched all eighteen hundred plus records on the Town's web site and I have found the entries I think may be the records I seek. I have attached to this email the results of my search titled GS PRR LOG- Past Due Claims.udf. My search efforts have located ninety-four records that are documented in the above referenced attachment. These records are all labeled as having payment amounts "Due. " I found no other requests made by me that were so labeled. I respectfully ask you to confirm that these records are the public records the Town claims I have yet to pay for or pick up. Please accept my thanks for any records you have produced in response to my requests. Be assured that 1 have wanted every record I ever requested of your agency and I appreciate every record I have ever obtained or examined. I have already put many of these responsive records to good use and expect to Find a use for all the others 1 have received or expect to receive. 1 note that you have produced many responsive records without any request for remuneration from me. 1 appreciate that. I also note that you have sometimes advised me that if 1 wished to obtain or examine certain records I would first need to pay a deposit to cover the expense you expected to incur in order to produce the record. In these instances, many times, 1 have decided that the estimated deposit money was more precious to me than obtaining that particular record and I therefore chose not to act on your estimate of the cost of production. If you contend that any of the records I am seeking, or any portion thereof, are exempt from inspection or disclosure please cite the specific exemption as required by �119.07(1)(e) of the Florida Statutes and state in writing and with particularity the basis for your conclusions as required by $119.07(1)(f) of the Florida Statutes. Please take note of §119.070)(c) Florida Statues and your affirmative obligation to (1) promptly acknowledge receipt of this public records request and (2) make a good faith effort which "includes making reasonable efforts to determine from other officers or employees within the agency whether such a record exists and, if so, the location at which the record can be accessed." I am, therefore, requesting that you notify every individual in possession of records that may be responsive to this public records request to preserve all such records on an immediate basis. If the public records being sought are maintained by your agency in an electronic format please produce the records in the original electronic format in which they were created or received. See �119.01(2)(f), Florida Statutes. Please provide only those records for inspection that do not require extensive use of information technologies or extensive staff time or both in excess of 15 minutes. Please take note of 6119.07(4)(a)3.(d) Florida Statues and if you anticipate that any records exist, the production for inspection of which will require extensive use of information technologies or extensive staff time or both in excess of 15 minutes, then please advise me of the cost you anticipate to be incurred by your agency prior to incurring this cost. If you anticipate the production for inspection of these public records to exceed $1.00 please notify me in advance of you incurring the cost with a written estimate of the total cost. Be assured that I have wanted every record I ever requested of your agency and 1 appreciate every record 1 have ever obtained or examined. 1 have already put many of these responsive records to good use and expect to find a use for all the others 1 have received or expect to receive. 1 note that you have produced many responsive records without any request for remuneration from me. 1 appreciate that. I also note that you have sometimes advised me that if 1 wished to obtain or examine certain records 1 would first need to pay a deposit to cover the expense you expected to incur in order to produce the record. However Town Manager Thrasher, Town counsel Robert Sweetapple and Town Attorney Joanne O'Connor all apparently have personal knowledge of these records as they have all publicly announced that these records exist. Since I first started asking to inspect these records around March 9, 2015 I should think the records were created prior to that date. If you believe you may need to prepare an estimate of deposit for extensive clerical or supervisory assistance in order to produce these records I fervently urge you to first ask Mr. Thrasher, Mr. Sweetapple and Ms. O'Connor about these records as their personal knowledge of these records will certainly provide the most expedient means to determine if they do indeed exist.
