at 9:00 A.M.

IV. Minutes of the Regular Meeting of February 10, 2017.
Vice Mayor Stanley moved that the minutes of the Regular Meeting
i— of February 10, 2017 be approved as circulated, Commissioner Orthwein
seconded the motion and all voted AYE at roll call.
V. Additions, withdrawals, deferrals, arrangement of agenda items.
There were no changes to the agenda.

VII. Communication from the Public (3 min. maximum)
Martin O'Boyle apologized for some previous untrue remarks he had
made about Attny. Sweetapple and commented regarding his current
candidacy for a Town Commissioner seat.
Miguel Neumann asked for an update on the proposed Gunther Volvo
construction, the reason for a Town Hall addition and expressed
displeasure at a recent political advertisement.
Julio Martinez thanked the Commissioners and town employees for their
services.

VIII. PUBLIC HEARING
There was no ex -parte communication declared and the Town Clerk
administered the Oath to Carlos Linares, Cristina Montane, Joe Peterson.
A. Applications for Development Approval
1. An application submitted by Carlos Linares of Randall
Stofft Architects, as Agent for Dan and Maria Reinhart,
the owners of property located at 955 Indigo Point, Gulf
Stream, Florida 33483, legally described as Lot 71 and
Part of Lot 72, Place Au Soleil Subdivision.
Mr. Linares stated this is a partial 2 -story Gulf Stream Bermuda style
home consisting of 7,340 square feet that meets all of the required'
setbacks. He added that a detailed landscape plan is included and he
apologized for the absence of the landscape architect.
Commissioner White commented that the ARPB has recommended that there be
more landscaping on the south side and Mr. Linares replied that the
landscape architect is aware of this and will have amended drawings to
present. Commissioner Lyons believed there should also be more
landscaping on the north side to screen the second story and the other
members of the Commission were in agreement. Mayor Morgan pointed out
that there are 2 discouraged items on the design and additional
landscaping is justified.
Commissioner Orthwein felt the entire application should go back to the
ARPB as the landscaping is a part of the entire project.
Mr. O'Hare questioned whether the plan conforms to provisions in Ord.
15-2 to which the reply was that a review by Urban Design, Kilday
confirmed that it does comply.
Vice Mayor Stanly moved to defer further action on the application until
the ARPB has an opportunity on March 23, 2017 to review the entire
project with the complete landscape plans available, after which the
application will be returned to the Commission for final action at the
next Commission meeting. The motion was seconded by Commissioner White
with all voting AYE at the roll call.
2. An application submitted by William Wietsma as agent for
533 Middle Road Holdings, LLC, owner of property located
at 533 Middle Road, Gulf Stream, Florida 33483, legally
described as Lot 10 of Gulf Stream Cove Subdivision in the
Town of Gulf Stream, Florida.
Cristina Montane, in the absence of William Wietsma, displayed
Drawings and a rendering of the proposed structure, a Gulf Stream
Bermuda style, partial 2 -story single family dwelling consisting of
5,146 square feet. She explained that all of the surrounding neighbors
had been contacted and none had any objections to what is planned.
Commissioner Lyons called attention to a large, second floor porch and

Owas concerned that those using the porch would be looking down into the
neighbors back yards. He suggested that this be addressed with landscape
material.
Landscape Architect Joe Peterson explained there is a 6' hedge on the
neighboring property and a line of Fishtail Palms. In addition there
will be Clusia planted the length of the house and extending to the
north. In the back corner, they are planning a Gumbo Limbo tree with
fire bush shrubs below. The Commission believed there should be some
tall plantings installed on both sides of the porch to assure the
privacy of the neighbors. Mr. Peterson suggested that he could add some
Palm clusters in these areas of a height to screen the porch.
a. LAND CLEARING PERMIT to prepare for new construction
and new landscaping.
Vice Mayor Stanley moved to approve the Land Clearing
Permit and Commissioner Orthwein seconded the motion with all voting AYE.
b. DEMOLITION PERMIT to demolish existing structures
on the property in preparation for new construction.
Vice Mayor Stanley then moved to approve the Demolition
Permit. Commissioner Orthwein seconded the motion with all voting AYE.
C. SPECIAL EXCEPTION REVIEW to permit 196 square
O feet of covered, open space that exceeds the maximum
FAR.
A motion to approve a special exception to allow 196 SF
of covered, unenclosed area that exceeds the maximum permitted Floor
Area Ratio was made by Vice Mayor Stanley and seconded by Commissioner
Orthwein with all voting AYE at the roll call.
d. LEVEL 3 ARCHITECTURAL/SITS PLAN REVIEW to permit the
construction of a Gulf Stream Bermuda style, two-
story, single family dwelling with attached 2 -car
garage consisting of 5,146 sq. feet, and a swimming
pool.
Vice Mayor Stanley moved to approve a Level 3
Architectural/Site Plan based on a finding that the proposed construction
of a Gulf Stream Bermuda style two-story, single family dwelling with
attached 2 -car garage consisting of 5,146 SF, and a swimming pool meet
O the minimum intent of the Design Manual and applicable review standards
with the following conditions: 1) Prior to the issuance of a certificate
of occupancy, the owner of the property shall prepare and record a deed
restriction which shall provide that all roof projection areas shall
remain unenclosed as per approval of the special exception for a long as
the structure is in existence or exceeds the maximum FAR. 2) A landscape
plan shall be approved administratively to add a Palm plant species at a
planting height of 18 to 20 feet per the specs by the landscape architect
along the north east boundary line and along the north west boundary

Oline. The motion was seconded by Commissioner Orthwein and all voted AYE.
IX. Reports.
A. Utility Undergrounding-Danny Brannon (Engineer)
In the absence of Mr. Brannon, Mayor Morgan reported that
FP&L stated they have scheduled to install the new street lights along
�l AlA this month after which they will remove the old poles in Phase I.
B. Town Manager
1. Vehicle Purchases for Maintenance Dept. & Police Dept.
Mr. Thrasher stated this is an update from the currently
approved budget for 2017. He said the police department is scheduled to
purchase 2 vehicles, the budgeted amount being $46,000 with the
purchasing amount being $46,712, a 1.5% difference. He went on to say
that the water department is purchasing a truck for $34,242, with the
budgeted amount being $35,000. He went on to say that these were
approved when the budget was adopted and this is being offered as
current information.

X. Items for Commission Action.
A. Proposal -Preparation of Construction Drawings for Town Hall
Addition -Bridges, Marsh & Assoc.
Town Manager Thrasher advised this is not expected to exceed
$15,000 but it will go above the $10,000 amount that he feels
comfortable in allocating and signing the contract without Commission
approval. He explained the architect would like to not only design the
Q structure itself but also the electrical and plumbing to have a cohesive
design. He ask Commission approval to sign the $15,000 contract.
Vice Mayor Stanley moved to approve the contract estimated not to exceed
$15,000 for the construction drawings with the signature of the Town
Manager. Commissioner White seconded the motion and all voted AYE.
B. Items by Mayor & Commissioners
O Commissioner White asked if there was any information with
regard to the vehicle that was stolen in Place Au Soleil. Chief Allen
advised that the vehicle has been recovered but that it had hit a house

Oand been destroyed. It is believed that it was taken by a group from
Broward County as Delray Beach had several similar incidents that have
led to Broward but no one has as yet been apprehended.
Mayor Morgan advised that Mr. Snavely has appeared before the Delray
O Beach Zoning Board and with the owner of the car dealership regarding
the application to allow the construction of a 3 story parking garage
adjacent to Place Au Soleil. He said the dealership only offered to add
some plantings to soften the appearance which is not acceptable. The
Mayor said he has an appointment to meet with Mayor Glickstein and the
head of the Planning Department in Delray next week to explain the Gulf
Stream concerns and offer suggestions as to what might be done.
XI. Adjournment.
Mayor Morgan adjourned the meeting at approximately 10:00 A.M.
