This is to confirm that at the Public Hearing held by the Town
Commission on April 17, 2017, your application for a Level 3
Architectural/Site Plan Review to permit the construction of a
two-story single family, Gulf Stream Bermuda style dwelling with
attached three car garage consisting of 7,340 SF, swimming pool with
spa, fire pit and fountain at 955 Indigo Point was considered.
The application was approved conditioned upon the following: 1)Any
minor modifications in the landscape plan shall be submitted to the
Town Manager for review and approval and any major modifications shall
be brought back to the ARPB for review and approval, prior to commence-
ment of landscaping; 2) All boat lifts, docks, seawalls etc. will
conform to Town Code Section No. 66-369 Docks; 3) Plans to be submitted
to Place Au Soleil Homeowners Association for review and comment
prior to Public Hearing held by Town Commission on February 10, 2017;
4) During the construction period there will be a 6' high screen around
the property; 5) The hedge must meet the code on the property line,
especially in relation to the views; 6) The landscape material on the south
side of the house to be increased to provide buffer screening of the
second story; 7) The landscape material to be increased on the north
and south side of the house and landscaping material added on the west
side to soften the first story roof.
This approval shall expire on April 17, 2018 if a Building Permit
Application, including the aforementioned improvements, has not been
applied for.

the Gulf Stream Design Manual. The following issue needs to be addressed:
Maximum FAR
Under the current Town Code, Section 70-71 outlines the provisions for determining Floor Area Ratios
(FAR). FAR is determined through a sliding scale. For the Place au Soleil district the first 20,000 sf of
effective lot area FAR is .33 and the FAR for portions over 20,000 sf is .20. According to the following
calculations the maximum floor area for the site is 6,944 sf.
Effective Lot Area: 21,720 sf
20,000 x.33 = 6,600 sf
1,720 x.20 = 344 sf
6,600 + 344 = 6,944 sf
The applicant's calculations reflected 7,374 sf as the maximum square footage. Included in this
calculation was the following:
20,000 x.33 = 6,600 sf
1,720 x .20 = 344 sf
1,720 x .25 = 430 sf (incentive)
6,600 + 344 + 430 = 7,374 sf
The applicant referenced Section 70-71(c) on the site plan data in reference to incentive provisions for
additional FAR. This section of the code was in place when this application was submitted. As such, the
proposed house is consistent with the FAR regulations in place when the application was submitted.
Second Floor Area Calculations
Section 70-73 of the Town Code limits second floor area to 50% of the first -floor area. In the site data
table on the submitted site plan, the second story calculation note references 70% instead of the
correct 50%. The site data table should be updated to reflect the correct code requirement.
Entrance Features
Section 70-100 of the Town code prefers that the entry features of two-story homes are up to 14 feet
in height. The height is measured from the finished floor to the top of the balcony or similar
architectural feature. The proposed entrance measures approximately 16 feet in height which is
discouraged according to the Town Code.
Window Opening Area Threshold
Section 70-101 prohibits more than 50 percent of total window opening area on an elevation. The
calculations made by the applicant show the East Elevation as having a 44% total window opening
area. Using the calculations below, the window opening area for the East Elevation is 46%:
Total Wall Area: 1926.000 sf
Window Openings: 885.625 sf
Percentage 0.459 = 46%
Portions of the elevation included in the applicant's calculations of the total wall area were omitted for
the above calculations as they were set too far back to be considered part of the total wall area.
Mechanical Equipment
Section 70-267 of the Town's Code discouraged ground -mounted equipment higher than four feet
above grade. The Landscape Plan shows air conditioning units on the North and South sides of the
house. Please provide verification that the equipment is no taller than 4 feet in height.
Recommendation
It is recommended that the applicant revise the development plans to address the above -referenced

We have reviewed the Site & Drainage Plan dated September 27, 2016 (attached) and the surface
water management calculations dated October 13, 2016 (attached) for the above referenced project
and offer the following comments:
1. The property is in the Zone AS, EL 7 (NGVD) per FEMA Community Panel Number 125109
0001 D, dated September 30, 1982. The lowest floor of the house shall be at or above
elevation 7.0' NGVD.
2. The main level and garage Floor elevations shown on Site Plan Sheet A101 do not match the
Floor elevations on Sheet A301 and Sheet A302. Confirm the correct proposed floor
elevations and clearly indicate them on the Site & Drainage Plan. Also include a legend.
3. The Town's Code Chapter 42, Article IV, Section 42 requires that adjacent properties not be
adversely affected by the runoff from the project site. Swale areas are shown on the site but
an adequate number of proposed grading information is not provided in order to determine
whether this requirement is being meL Provide existing grades at the property line of the
adjacent lots and at the top of bank of the water. Provide proposed grades for the swale
areas and demonstrate that the runoff is being directed to the swale areas rather than
offsite. Show the flow arrows pointing in the correct direction and provide additional
proposed grades within the property.
4. The drainage calculations provided indicate that the site retains the minimum amount of
runoff within the onsite swale areas.

NOTICE OF APPLICATION FOR DEVELOPMENT APPROVAL
NOTICE IS HEREBY GIVEN that the Architectural Review and
Planning Board of the Town of Gulf Stream will hold a Public
Hearing on THURSDAY, JANUARY 26, 2017 AT 8:30 A.M., and the Town
Commission will hold a Public Hearing on FRIDAY, FEBRUARY 10, 2017
AT 9:00 A.M., both in the William F. Koch, Jr. Commission Chambers
of the Town Hall, 100 Sea Road, Gulf Stream, Florida, at which the
following will be considered:
An application submitted by Carlos Linares, Randall Stofft
Architects, as agent for Dan and Maria Reinhart, owners of
property located at 955 Indigo Point, Gulf Stream, Florida
33483, legally described as Lot 71 and Part of Lot 72 Place
Au Soleil Subdivision, for the following:
DEMOLITION PERMIT to permit the demolition of existing
structures on the property.
LAND CLEARING PERMIT to clear the site for the new
construction and re -landscaping.
LEVEL 3 ARCHITECTURAL/SITE PLAN REVIEW to permit the
construction of a 2 -story, single family, Gulf Stream
Bermuda style dwelling with attached 3 -car garage
consisting of 7,340 square feet, swimming pool with spa,
fire pit and fountain.
The Architectural Review and Planning Board shall make a
recommendation to the Town Commission, and the Town Commission
shall make a final decision regarding the subject application at
the meetings noticed above. These meetings may be adjourned from
time to time and place to place as may be necessary to hear all
parties and evidence.
The complete application materials are on file in the Office
of the Town Clerk located at 100 Sea Road, Gulf Stream, Florida
33483, and may be reviewed during regular business hours, which
generally include non -holiday weekdays from 9:00 A.M. to 4:00 P.M.
ALL PARTIES INTERESTED IN THESE MATTERS may appear before the
Architectural Review and Planning Board and the Town Commission of
the Town of Gulf Stream at the times and place aforesaid and be
heard.
