LaPorte Also attending: Richard F. Ward; Henry Lilienthal; Roy Cowart; Henry Pope; Mel Dickenson; C.P. Young; C.Y. Byrd, III; and Kathleen Kirton. Mayor Koch called the Meeting to order. Mr. Iglehart moved that the minutes of the meeting held on January 5, 1968 be approved as written and the reading of these minutes be waived. Mr. Hart seconded the motion. Motion passed. Mr. Hart moved that the Financial Report for January be approved as written and all expenses included in the report be approved. Mr. LaPorte seconded the Motion. Motion passed. Mr. Hart moved that Ordinance No. 68 -1 be placed on second reading. Mr. LaPorte seconded the motion. Motion passed by unanimous vote of the Commissioners present. The Town Clerk then read the ordinance in full. Also the Town Clerk reported that letters agreeing to drainage eqsements had been received from Oleander, Inc. and Mr. and Mrs. Henry Pope. Mr. LaPorte then moved for the adoption of Ordinance No. 68 -1. Mr. Hart seconded the motion. The motion was passed by unanimous vote of the Commissioners present. The Commissioners discussed letters that had been received concerning Beach Erosion problems and work that is being done on the State level. Mr. Hart moved that a Resolution be adopted supporting Beach Erosion action and that copies be sent to the appropriate officials. Mr. LaPorte seconded the motion. Motion passed. Col. C.P. Young by letter requested permission to construct a garage on his property located at AlA and Lake View. Following discussion on the matter Col. Young was advised to submit a sketch of his pro- posed location for the garage and it would be given consideration at the next Commission meeting. Police reports for January were read. Mr. LaPorte stated that he felt the activity for the month was unsatisfactory in proportion to the heavy flow of traffic. The Town Clerk reported that a $100.00 contribution to the Town Hall Building Fund had been received from Mr. and Mrs. James N. Wallace and A $25.00 contribution from Mrs John Hupfel. The Town Clerk reported bids for sodding the rear area of the Town Hall as follows: Carr Soil & Sod, $172.70 and Boone's Nurseries, Inc., $396.10. Mr. LaPorte moved that the low bid from Carr Soil & Sod be accepted. Mr. Iglehart seconded the motion. Motion passed. Commission Meeting, February 9, 1968 Page 2 The Town Clerk reported bids for installation of a sprinkler system as follows: Kilpatrick Lawn Sprinklers, $400.00; Jim Womack's Sprinkler Service, $500.00 and Trieste Construction Corp., $505.00. The Commissioners decided against installing a sprinkler system and felt that the watering could be handled by Town employees. Mr. Hart reported that he had received some complaints on the lights at the Somerset Apartments. The Town Clerk was instructed to send a letter to the Somerset advising them of the complaint and also to send one to the Gulf Stream Shores Apartments concerning those lights. Mr. Pope stated that the Gulf Stream Shores Apartments were violating the setback requirements and also had a hotel sign displayed. Mr. Iglehart instructed the Town Clerk to investigate the above com- plaint and give a report on any violations at the next meeting. Mr. Iglehart moved that the audit report of Himes & Himes be accepted and their recommendations followed. Mr. LaPorte seconded the motion. Motion passed. A check for franchise revenue from Florida Power & Light Company in the amount of $4,591.06 was received. There being no further business to come before the Commission, the meeting was adjourned. Box 2144 Palm Beach, Florida February 8, 1968 Town Commission Town of Gulf Stream Florida Gentlemen: I wish to make application to construct a garage 20' x 20' which will conform with the architecture of my house. The garage will be located 26' east of the front property line and 10' south of the north property line, on Lot 43 at the corner of Lake View and A -1 -A. I am not presenting a sketch until approval is made as I do not wish to spend the money until such approval. The logical place for a garage is at the rear of my prop- erty on the north side which could be set back 15' from the middle of Oleander Drive. I made application heretofore but was turned down because Mr. Shetler and Mr. Calhoun objected by letter and were not required to appear in per- son to present good and valid reasons why I should not be allowed to construct a garage at that location; thus, I was the victim of discrimination. r Very truly yours, Col. AN ORDINANCE OF THE TOWN OF GULF STREAM, AMENDING THE 1952 ZONING ORDINANCE BY ALLOW- ING PRIVATE GOLF COURSES AND BUILDINGS AND USES ACCESSORY TFERETO AS A PERMITTED USE IN RESIDENCE DISTRICT "A" Wb EREAS, the `.Gown Commission of the Town of Gulf Stream, sitting as a zoning commission, has recommended and reported to the Town Commission of the Town of Gulf Stream that the zoning ordinance of the town be amended so as to allow private golf courses and buildings and uses accessory thereto as a permitted use in Residence District "A" and WHEREAS, the Town Commission at a special meeting called for the purpose of amending the zoning ordinance has been held after having given at least twenty -one days notice of the time and place of such hearing in the Palm Beach Post, a newspaper having a general circulation in the Town of Gulf Stream, and by posting on the official bulletin board of the Town Hall a copy of said notice, and by giving written notice to owners of property, as shown on the last town tax roll, within a radius of five hun- dred (500) feet in all directions from the property which will be affected by the proposed amendment, at least twenty -one days before the special meeting, and all other requirements of Section XII of the zoning ordinance of the town have been complied with; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, AS FOLLOWS: Section 1. Section III, Subdivision A of the Zoning Ordinance of the Town of Gulf Stream of 1952, relating to uses permitted in Residence District "A" is hereby amended by adding a fourth use as follows: 4. Private golf courses and buildings and uses accessory thereto, use or play on the golf course to be restricted to daylight hours. Section 2. RESOLUTION j. 1-6 OF TFE TOI,11•1 CO1.•ff!ISSIOI.1 F E TOWN OF GULF STREIIAI, FLORIDA PE12T1iINING TO BE,`.CH PROTECTIOII i:dopted: February 9 1968 ?- :IIE?EiIS, the protection and restoration of beaches along Florida's Atlantic coast is a matter of vital and important concern to the citizens and residents of Florida, and for the Preservation of valuable assets for the use of both the people of Florida and tourists; and WHEREAS, the office of the Governor of Florida is studying the problem of beach conservation and erosion and is working with the State Department of Conservation, the United States Corps of Engineers and members of the Florida Inland Navigation District, on a proposed solution; and ViTIEREAS, the Town of Gulf Stream has a vital stake at issue because of erosion of beaches in the town limits; NOW THEREFORE, BE IT RESOLVED, BY THE TO!'M COMMISSI01.1 OF THE TOUIN OF GULF STREAM, FLORIDA, in session assembled February 9, 19681 as follows: 1. The Commission is heartily in accord with any feasible plan that will protect the beaches on the Atlantic Ocean from erosion and will restore them for the common good. 2. The Commission commends the Governor of Florida and Ir1r. Nathaniel P. Reed, his Conservation aide, for their efforts to find a solution to the problem. 3. ' It is hoped that enabling legislation will be passed by the Legislature of Florida to provide funds for the work of restoration of beaches. 4. Adoption of a comprehensive plan of restoration, the passage of enabling legislation and the raising of funds necessary for the work need immediate and thorough attention. 5. That copies of this resolution be sent to the Governor of Florida, Mr. Nathaniel P.
