Mayor Koch called the Meeting to order. Mr. LaPorte moved that the
minutes of the meeting held on February 9, 1968 and the special
meeting of March 2, 1968 be approved as written and the reading of
these minutes be waived. Mr. Hoyle seconded the motion. Motion
passed.
Mr. LaPorte moved that the Financial Report for February be approved
as written and all expenses included in the report be approved, with
the exception of the bill for Ocean Ridge Gulf Service which is to
be checked over and the expenses verified by the Town Clerk. Mr.
Hoyle seconded the motion. Motion passed.
Attorney Frederick E. Hollingsworth, 401 Pan Am Building, West Palm
Beach, representing Col. Young requested a building permit for a
garage on Col. Young's property as shown on the sketch submitted by
Col. Young and attached to these minutes. The requested location
of the garage would be in the front of Col. Young's home.
A letter from D.W. Colhoun was read objecting to a garage in the
rear of Col. Young's property and pointing out deed restrictions
prohibiting it there. Mr. Curtis Shetler had previously talked
with the Town Clerk about the garage and stated that he did not
like the location of it but would not enter an objection.
During discussion it was pointed out that the present request
would meet former setback requirements in the front but did not
comply with the greater setback for AlA as specified in Ordinance
No. 123.
Mr. Hollingsworth stated that on behalf of his client he was
asking for a permit to build a garage and not a variance in the
setback requirements.
Mr. LaPorte moved that the request of Col. Young to be granted
a building permit for a garage be approved providing the garage
is built exactly as shown on the attached sketch. Mr. Hoyle
seconded the motion. Motion passed.
A letter from Mr. James J. Ritterbusch, President of The Somerset
of Gulfstream, Inc., was read in reply to a complaint from the
February 9, 1968 commission meeting.
At the request of the Palm Beach County Bar Association, Inc.,
Mayor Koch issued a proclamation regarding Law Day, May 11 1968.

A letter from Attorney Joseph P. Metzger was read notifying the
Town of the settlement of the suit resulting from the accident
between a Town police car and a motorcycle on May 41 1967.
The Town Clerk as requested at the previous meeting gave a report
on the Gulf Stream Shores Apartments building. A copy of the
report is attached hereto.
Police reports for February were read.
The Town Clerk reported that the sodding of the area in the rear
of the Town Hall has been completed and also pointed out the new
State flag in the Commission room. The cost of the flag was $83.38
and a check for this amount has been received from Mr. George T.
Trumbull as a contribution from him to the Town Hall Building Fund.
Mr. LaPorte moved that Resolution No. 2 -68, setting the date for
the Board of Equalization hearing, be approved. Mr. Hoyle seconded
the motion. Motion passed.
The Town Clerk reported on the accident last Saturday night, March
2, involving a Town police car. The police car was declared a total
loss and a check from the Town's insurance company in the amount
of $1650.00, after the $100.00 deductible, has been received. The
Commission agreed to accept this amount and the Town Clerk was
instructed to sign the necessary papers to transfer the wrecked
car to the insurance company after the Police equipment had been
removed.
The Town Clerk read the following bids for an immediate replacement
for the wrecked Police car:

Mr. LaPorte moved that the low bid from Adams Chevrolet Company
be accepted. Mr. Hoyle seconded the motion. Motion passed.
Mr. LaPorte voiced a complaint on the answering service now being
used by the Town. Following discussion the Town Clerk was
instructed to transfer the answering service from Mobile
Communications to We Answerphone, operated by Emory J. Barrow.

the meeting was adjourned.

Dear Mr. Ward:
We have your letter of February 15th regarding the
complaints received by one of the town commissioners
about the "bright lights" on the Somerset property.
This weekend I examined the lighting at night and
have instructed the manager of the Somerset to remove
one light that had been placed in one of the islands
near the road. Other than that one light, it appears
to me that the lights at the Somerset should not be
a disturbing factor for any residents in the area.
If the Town Commission still feels as if further
correction should be made, I would appreciate meeting
with either the complaining parties or with the Town
Commission to get their views on what lights are a
disturbing influence.

Investigation of layout of Gulf Stream Shores Apartments
Measurements were taken by the undersigned on February
29, 1968 and are reflected on the attached sketch.
I believe that the measurements are reasonably accurate,
however, a surveyor or engineer in taking exact measure-
ments might very likely show slight differences from the
figures on the attached sketch.
From my observations and measurements, I would say that
the only encroachments into the 78 foot setback area are:
The concrete slab at the foot of the stairs under the
canvas canopy,
The bottom five feet of the stairs, and
About nine feet of the 12 foot canvas canopy.
As previously stated a survey might show some different
figures but I believe the figures given here would be
within a foot or so of those resulting from a survey.
Lower wattage bulbs have been placed in the light stan-
dards which illuminate the parking area and this should
help reduce any complaints from adjacent property. owners.

RESOLUTION NO. 2 -68
FIXING TIME WHEN TOWN COMMISSIONERS WILL SIT AS A
BOARD OF EQUALIZATION
WHEREAS, the Town Charter requires that the Town Commission shall
sit as a Board of Equalization on the annual tax rolls on a day
or days between March 15 and April 1;
NOW THEREFORE, BE IT RESOLVED, by the Town Commission of the Town
of Gulf Stream, Florida, in regular session assembled on March 8,
1968 as follows:
1. That the Town Commission will sit as a Board of Equalization
at the Town Hall in Gulf Stream, Florida, on the Town Tax Rolls
for the year of 1968 on March 29, 1968 between the hours of
10:00 a.m. and 12:01 p.m. for the purpose of hearing complaints,
if any, and of equalizing the tax rolls.
2. The Town's Deputy Town Clerk is directed to post a copy of
this resolution on the Town Bulletin Board immediately after its
adoption and to leave the same on the bulletin board until
April 1, 1968.
3. All persons having any complaints or objections to the assess-
ment rolls are directed to make their complaints in writing and
to present the same at the time that the commission will sit as
a Board of Equalization.
ADOPTED THIS 8th DAY OF MARCH, 1968.

Gentlemen:
Thank you for your advice that a request has been made for a
variance in the Town Zoning that affects our property.
I must refer you to the file on this matter that was considered
in 1962 and denied for good and sound reasons. The situation has not
changed since then and we must object again to the change in zoning as
it affects Oleander Way.
The proposal off AIA is not adjacent to our property so we
have no comment, except in general we think the zoning for our town
good and should not be changed except for good reason.
We regret this matter has to consume the commissioners time
again and suggest Mr. Young be advised there is a deed restriction that
Prohibits the change he has in mind on Oleander Way, and at the present
writing Bessemer Properties, the Shetlers and Colhouns have no intent to
waiver this deed restriction.

from Col. Cecil P. Young for a variance in
the setback requirements to permit him to
build a garage on his property, Lot 43,
Gulf Stream Properties No. 2.
Enclosed are two sketches showing the pro-
posed location and an alternate for the
garage.
This request will be considered at the neat
Commission meeting on March 8, 1968. The

Dear Sir:
Enclosed you will find a copy of a proposed Mayoral
Proclamation declaring May 1 as Law Day in the cities
throughout Palm Beach County. As you may be aware,
Law Day first originated by Presidential proclamation
in 1958 and is now observed nation -wide on the first
of May by joint resolution of Congress and proclamation
of the President of the United States.
The purpose of Law Day is to foster respect for law;
to increase public understanding of the place of law
in American life; and to point up the contrast between
freedom under law in the United States and governmental
tyranny under Communism.
This year the Law Day Committee is attempting to obtain
the permission of the Mayor of each city throughout
Palm Beach County to include his respective name and
the name of his city on the enclosed joint proclamation.
This proclamation would then be presented by as many of
the Mayors included thereon who could attend to the
presiding Circuit Judge in Palm Beach County. If we are
able to include your name and the name of your city on
this proclamation, I would appreciate your dropping me
a short note indicating same.
On behalf of the Palm Beach County Bar Association, I
wish to thank you in advance for your cooperation in
this most worthy annual event.

WHEREAS, in many areas of the United States respect
for constituted authority and the principle of the supremacy of
law are being heedlessly challenged; and,
WHEREAS, the rights and freedoms which Americans
accept as their birthright are made possible only by public
acceptance of and obedience to the rule of law. In today's complex
society there is a particular need for understanding on the part of
every citizen that respect for law is vital to the preservation of
individual liberties and a free and orderly society; and,
WHEREAS, the Congress of the United States, and the

President by official proclamation, have designated May 1 as
Law Day USA, it is especially fitting, therefore, that this year we
should as citizens reaffirm our faith in the rule of law and in the
supremacy of government by law rather than by man. The theme
for this eleventh annual observance of Law Day USA carries a timely
message: Only a Lawful Society Can Build a Better Society. It
reminds us only through adherence to the processes of law and
representative government can our community and nation achieve the
goals we seek in social betterment and progress.
NOW, THEREFORE, WE, the Mayors of the cities listed
hereafter, do hereby proclaim Wednesday, May 1, 1968, as Law
Day USA in our respective cities and call upon all citizens,
organizations, churches, and schools to recognize this special day
through appropriate programs and ceremonies.
