HomeMy Public PortalAbout12-21-2015PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, DECEMBER 21, 2015 The Common Council of the City of Richmond, Indiana met in regular session December 21, 2015 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR MILLER President Oler called the meeting to order and the following business was conducted: ROLL CALL Present were: Doug Goss, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Absent was Don Winget. Also in attendance were Walt Chidester, City Attorney; Monica Bums, Deputy City Clerk; Jeff Locke; Police Chief Mark Connery; Stephanie Hill Alexander, Scott Alexander, Dakota Collins; Tony Foster, Metropolitan Development; Sandra Spencer, Controller; Jerry Purcell, Fire Chief; Vivian Ashmawi, Communities in Schools; Jeff Plaster, County Council; Phyllis Quinn; Amanda Markee; Nick Wilson; Sergeant at Arms; and, Media. APPROVAL OF MINUTES Councilor Hollis moved to approve the minutes of the meeting held December 7, 2015, supported by Councilor Phil Quinn. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS Councilor Hollis moved to amend the agenda to add Resolution No. 6 -2015 for public hearing under section 6 supported by Councilor Parker. Upon a vote viva voce, the motion passed. • RESOLUTION NO. 6-2015 — ESTABLISHING AN ECONOMIC REVITALIZATION AREA (Phase Il of the Midwest Industrial Park) This resolution was on a confirmatory Public Hearing. Since there was no one against the Resolution it will stand as is. COMMUNICATIONS FROM THE MAYOR • The Inauguration Ceremony for Mayor, City Clerk, Council and Departments Heads will be on December 31, 2015 at 4:00 in the Council Chambers with a small reception afterwards in the rotunda on the 2nd floor. All the public is invited. • City Attorney Walt Chidester made a few comments on all the accomplishments of Mayor Sally Hutton during her 12 years in office as Mayor and her 18 years on Council. REPORT OF THE BOARD OF PUBLIC WORKS AND SAFETY The Minutes of the November 25, December 3, 2015 were accepted as presented. Common Council Minutes December 21, 2015 Page 2 of 4 REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS • BOARD OF ZONING APPEALS — APPOINTMENT Councilor Miller moved to reappoint Jeff Cook to the Board of Zoning Appeals, supported by Councilor Quinn. Upon a vote viva voce, the motion passed. MISCELLANEOUS BUSINESS • Police Chief Mark Connery expressed his appreciation to Council and the Mayor's administration for taking a chance on him and others in the Department. ORDINANCES ON FIRST READING Councilor Parker moved to read Ordinance No. 86 -2015 on first reading by title only. Upon a vote viva voce, the motion carried. ORDINANCE NO. 86-2015 — ADDITIONAL APPROPRIATION AMENDING THE 2015 BUDGET (EMS) The Deputy Clerk read Ordinance No. 86 -2015 on first reading by title only: This ordinance is to appropriate $17,700.00 for software and hardware equipment for the Fire Departments EMS. Councilor Wissel moved to advance Ordinance No. 86 -2015 to second reading and suspend the rules and read by title only, supported by Councilor Cruse - Nicholson. The Deputy Clerk read Ordinance No. 86 -2015 on second reading by title only. Council President Oler declared Ordinance No. 86 -2015 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Parker moved for engrossment of Ordinance No. 86 -2015, supported by Councilor Quinn. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 86 -2015 to third and final reading and suspend the rules and read by title only, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Deputy Clerk read Ordinance No. 86 -2015 on third reading by title only. Ordinance No. 86 -2015 was adopted with an 8-0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 78-2015 —AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS (EDIT -CIS) The Deputy Clerk read Ordinance No. 78 -2015 on second reading by title only. This is an ordinance that would appropriate $25,000.00 from Economic Development Income Tax Fund to fund some of the operating funds for Community in Schools. Council President Oler declared Ordinance 78 -2015 on second reading and public hearing. Nick Wilson spoke against. Tony Foster and Councilor Goss spoke in favor. • Common Council Minutes December 21, 2015 Page 3 of 4 Councilor Hollis moved to amend the Ordinance 78 -2015 in the second Whereas for it to state the appropriate additional sum of money to certain funds specifically in funding part of the of the operation of Community in Schools be contracted with Richmond Community Schools, supported by Councilor Quinn. Upon a vote viva voce, the motion passed 7 -1 with Councilor Cruse - Nicholson against. Councilor Wissel moved to amend the Ordinance No. 78 -2015 to reduce the amount to $12,500.00 with a second by Councilor Parker. Upon a vote viva vice, the motion failed 5 -3 with Councilors Wissel, Parker and Hollis in favor. Councilor Miller moved for engrossment, supported by Councilor Quinn. Upon a vote viva voce, the motion passed. Councilor Parker moved to suspend the rules and advance Ordinance No. 78 -2015 to third and final reading and read by title only, supported by Councilor Hollis. Upon a vote viva voce, the motion passed. The Deputy Clerk read Ordinance No. 78 -2015 on third reading by title only. Amended Ordinance No. 78 -2015 was adopted with a 7 -1 called vote Councilor Miller against. ORDINANCE NO. 79-2015 - A GENERAL ORDINANCE AMENDING CHAPTER 154: UNIFIED DEVELOPMENT ORDINANCE (Metro) This was held on second reading for public hearing and there was no comment for or against. Councilor Quinn moved for engrossment supported by Councilor Parker. Upon a vote viva voce, the motion passed. Councilor Miller moved to suspend the rules and advance amended Ordinance No. 79 -2015 to third and final reading and read by title only, supported by Councilor Cruse- Nicholson. Upon a vote viva voce, the motion passed. The Deputy Clerk read Ordinance No. 79 -2015 on third reading by title only. Ordinance No. 79 -2015 was adopted with an 8-0 roll call vote. ORDINANCE NO. 84-2015 -A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Grafcor-IT Equipment) Will be held until the next meeting. ORDINANCE NO. 85-2016 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Grafcor - Manufacturing Equipment) Will be held until the next meeting. ORDINANCES ON THIRD READING - None Councilor Parker said a few words and was presented with a gift for his service. Councilor Quinn said a few words and too was presented a gift for his service.
