COUNCIL MINUTES
WORKSHOP MEETING - MAY 1. 1995
The workshop meeting of the Bal Harbour Village Council was
held on Monday, May 1, 1995. in the Conference Room at Bal Harbour
Village Hall. The meeting was called to order at 11:40 a.m. by
Mayor Spiegel. The roll was called and those present were:

As a quorum was determined to be present, the meeting
commenced.
Councilman Hirschl explained more than a year ago the Village
Council met with Dr. Kelsey and the Village's Building Inspector to
discuss the tear down phenomena, which Dr. Kelsey had brought to
the Council's attention through articles that had been printed.
The concern of this Council is that the current code allows for
extremely dense structures on small lots. as well as what has
happened in the Ocean Front District, such as the number of floors
allowed did not take into consideration the amount of space between
the floors. Councilman Hirschl then proceeded to read a memorandum
from Edward Gross to the Architectural Review Board requesting them
to review the code to reduce the second floor areas and total
living square foot area on different lot size.
Mr. Silvers stated that the reality is the ownership of the homes
is changing and the people investing in these homes want a larger
home due to the larger investment. One of the items to be
recognized is the setbacks for anything more massive, placing the
emphasis on the middle of the property.
Mr. Nieda presented the following overview of zoning issues and
their impact upon residential building massing, density. and
sienage.

1.2 Role of the Architectural Review Board:

Recommendation/Presentation to Chairman and Members of the
Architectural Review Board.

1.3 Applicable Zoning Criteria to Building Massing and
Density:
A. Base Flood Elevation - Consider reference all height
limitations to the Crown of the Road elevations so that " building
pad" counts as part of the overall height.
b. Setbacks - Consider allowing unbalanced setbacks es:
and 15' on two story portion of side yard.
c. Lot Coverage - Consider decreasing lot coverage on two
story residences from 40% to 35%.

d. Maximum Building Height - Consider reference maximum
building height to the Crown of the Road elevation.
e. Average Roof Height - Consider increasing offset of two
story structures from side yard setbacks from one additional foot
for each foot above 22 feet.
f. Floor Area Ratio - Consider adopting a suitable floor
area ratio as a means of reducing building volume. Encourage a
higher floor area ratio for one story structures than two story
structures.
2. Samples of recent construction in the R-1 and R-2
Districts:
2.1 R-1 District:
a. 212 Bal Bay Drive - Main roof line is perpendicular to
the side interior lot lines. A variance was granted for side
setback. building height and average roof height.
b. 166 Bai Bay Drive - Principal roof line is parallel to
interior side property lines, raised bearing plates 11'0" plus or
minis as design feature.
2.2 R-2 District:
a. 152 Park Drive - Stepped roof line reduces building mass
visually. main roof line is perpendicular to interior side. A
variance was granted for the side yard setback and average roof
height.
b. 174 Park Drive - Two story addition to existing
residencegood integration of existing and new roof lines, main
roof line is perpendicular to side yard.
c. 208 Park Drive - Two story addition to existing
residence. raised entry feature is used to integrate existing roof
line to the two story addition. main roof line is perpendicular to
interior side. A variance was granted for side yard setbacks.
building height and average roof height.
3. Signage:
3.1- 3.2 Ocean Front District & Residential District:
Consider revising Section 15.36 of the Village Code to reflect
current building signage in use. The Ocean Front District have
different traffic patterns and therefor should have signage
reflective of the use patterns. The durability, ease of
maintenance. illumination. cost, aesthetics need to be factored in
the selection.

3.3 Building Signage TVUes:
The different types of signage to be considered are as follows:
Cast plastic on free standing masonry pedestal
Surface mounted plaque type (glazed tile).
Surface mounted cast aluminum letters.
Cast aluminum letters on free standing masonry pedestal and
marble finish.
Mr. Weiss suggested that the planner come back with recommendations
to change the Code.
Mr. Miller gave a brief history of his background before joining
Craig Smith & Associates. He stated he will review Mr. Nieda's
recommendations and come back with a report on Residential Zoning
Criteria proposed amendments. He continued to explain he will send
this report to Mr. Treppeda to be placed on the May 16th regular
Council meeting agenda. 1
3. Other Business: None
4. Adiourn: There being no further discussion. a motion was
offered by Councilman Taplin and seconded by Councilman Boggess to
adjourn. The motion carried unanimously (5-0). and the meeting
adjourned at 12:50 p.m.
