Dear Custodian of Records,
I am writing you to request to inspect public records in your custody.
I ask you to take note of §119.07(1)(c) Florida Statues and your affirmative obligation to (1)
promptly acknowledge receipt of this public records request and (2) make a good faith effort which
“includes making reasonable efforts to determine from other officers or employees within the agency
whether such a record exists and, if so, the location at which the record can be accessed.”
If you contend that any of the records I am seeking, or any portion thereof, are exempt from
inspection or disclosure please cite the specific exemption as required by §119.07(1)(e) of the Florida
Statutes and state in writing and with particularity the basis for your conclusions as required
by §119.07(1)(f) of the Florida Statutes.
If the public records being sought are maintained by your agency or contractors for your agency, in an
electronic format please produce the records in the original electronic format in which they were
created or received. See §119.01(2)(f), Florida Statutes.
I ask that you provide only those records for inspection that do not require extensive use of
information technologies or extensive staff time or both in excess of 15 minutes. Please also take
note of §119.07(4)(a)3.(d) Florida Statues and if you anticipate that any records exist, the production
for inspection of which will require extensive use of information technologies or extensive staff time or
both in excess of 15 minutes, then please provide those records that can be produced within the first
15 minutes and advise me of the cost you anticipate to be incurred by your agency for the remaining
records prior to incurring this cost. Please do not incur any costs on my behalf without first obtaining
my written authorization to proceed.

The Town understands your request to be seeking e-mails sent to or received by Town
Employees between April 1, 2017 and April 30, 2017 that contained the text of your e-mail
address “chrisoharegulfstream@gmail.com” in the body portion of the record but not from, to or
copied to you or any of your agents or attorneys.
If you are seeking a particular record, please let us know and the Town may be able to provide
the record to you without incurring special service charges as permitted pursuant to Florida
Statute § 119.07. Based on the Town’s understanding of your request, the Town now estimates
that to fully respond to your request will require approximately a half hour of administrative
support at $38.54 per hour and a half hour of IT support at $95.00 per hour, the labor cost of the
personnel providing the service, per Fla. Stat. § 119.07(4)(d). If the costs of producing these
documents will exceed your deposit, the Town will provide you with an initial production of
responsive records and an estimate for the production of any additional responsive records. If the
costs of production are less than the deposit, the Town will provide you with the responsive
records and a refund.
(.50 hour @ $38.54 + .50 hour at $95.00) – (.25 hour @ $38.54) = Deposit Due: $57.13 in
cash or check.
Upon receipt of your deposit, the Town will use its very best efforts to further respond to your
public records request in a reasonable amount of time. If we do not hear back from you within
30 days of this letter, we will consider this request closed.

Thank you for your prompt reply to my public record request of May 5, 2017 which you have labeled GS #2541
(O'Hare email address in record during April 2017).
In your email reply you state, "The Town understands your request to be seeking e-mails sent to or received by
Town Employees between April], 2017 and Apri130, 2017 that contained the text of your e-mail address
"chrisohareeulfstream(agmail.com " in the body portion of the record but not from, to or copied to you or any
of your agents or attorneys. " Your stated understanding is mostly accurate. To be more precise, I asked to
inspect all "public records" as that term is defined by 4119.011(12) Florida Statutes to wit: all documents,
papers, letters, maps, books, tapes, photographs, films, sound recordings, data processing software, or other
material, regardless of the physical form, characteristics, or means of transmission, made or received pursuant to law
or ordinance or in connection with the transaction of official business by any agency.
I am not searching for a particular public record. Rather I wish to inspect all public records that are responsive
to my request. In order to minimize the amount of time you may need to find this record I offer the following
limiting characteristics of any responsive record and I ask that you don't spend any time searching for, or
producing, records outside these parameters or without these characteristics:
1. The record(s) contain the phrase ch risoharegulfstream ccD.gmail.com in any form i.e., bold, not bold;
any color, blue, black, etc; underlined or not underlined; any typeface; any size, italic or not
italic.
2. The record(s) were sent from, or received by, a Town employee between April 1, 2017 and April
30, 2017
3. The record(s) are not legal pleadings, depositions, motions, orders or any other records of court
documents that were filed by any Plaintiff or Defendant attorney (I already have access to these records
through the courts electronic portal.
4. The record(s) are any communications that contain, reference or discuss, within the record, the phrase
and/or email address chrisohareaulfstreamlaDgmail.com.
5. The record(s) are not addressed to, addressed from, or copied to, the email
account: chrisoharegulfstrearriRgmail.com.
It is my understanding that you now have a sophisticated software program that I expect has a search function
that I am hoping will automatically produce responsive public record(s) simply by you entering the
phrase chrisoharegulfstreamCilgmail.com in the search box and hitting enter. If that is not the case please
quote me your most accurate estimate to find any responsive records.
