RESOLUTION NO. 22- 37 RESOLUTION APPROVING PROPOSED SALE OF LOT 1 COUNTRY VIEW SUBDIVISION- FIRST ADDITION TO MARCUS, IOWA WHEREAS, on this date a Public Hearing was held concerning the advisability of selling real estate along Holmes Street Country View Subdivision — First Addition to Marcus, Iowa; WHEREAS,the City has determined that a fair market value for the purchase of the premises is $28,058.49 has deemed it no longer necessary for public use, except for that portion reserved as a perpetual easement for the Marcus Trail, and hereby directs an Abstract of Title be prepared for the Buyer; WHEREAS, a resolution by the City Council is required in order for the City of Marcus, Iowa to execute a Quit Claim Deed on the premises. NOW, THEREFORE,BE IT RESOLVED,the City Council of the City of Marcus Iowa hereby authorizes the approval of the attached real estate contract and agrees to sell the following described real estate to the Ronald and Joann Erickson Revocable Trust for$28,058.40 pursuant to the terms and conditions in the attached real estate contract: Lot One (1), Country View Subdivision—First Addition to Marcus, Cherokee County,Iowa Subject to Grantors reservation of a Perpetual Easement over the East fourteen feet(14') of Lot One (1), Country View Subdivision—First Addition to Marcus, Cherokee County,Iowa as a public right-of-way.
