A RESOLUTION OF THE VILLAGE COTJNCIL OF TIIE
VTLLAGE OF KEY BTSCAYi\E, FLORTDA, CoI\FTRMTNG
EMERGENCY EXPENDITTJRES RELATING TO THE
NOVEL CORONAVIRUS/COVID-19; PROVIDING FOR
RATIFICATION; AND PROVIDING FOR AIY EFFECTIVE
DATE.
WHEREAS, the Novel Coronavirus Disease 2019 ("COVID-I9") is a severe acute
respiratory illness that can spread among humans through respiratory transmission and presents
symptoms similar to those of influenza; and
WIIEREAS, COVID-|9 poses a public health risk to residents of the Village of Key
Biscayne (the "Village"), particularly elderly residents; and
WHEREAS, on March l,2020,Florida Govemor Ron DeSantis issued Executive Order
No. 20-51 directing the Florida Deparhnent of Health to issue a Public Health Emergency; and
WIIEREAS, on Marchg,2}z},a State of Emergency was declared by Florida Governor
Ron Desantis and by Miami-Dade County Mayor Carlos Gimenez on March 12,2020; atd
WHEREAS, on March 13,2020, the Village Manager issued a Declaration of State of
Emergency concerning COVID-l9 (the "Declaration") and subsequently issued various
emergency orders to mitigate and slow the spread of COVID-19 within the Village; and
WHEREAS, on April 7, 2020, the Vitlage Council approved Resolution No. 2020-21
confirming the Declaration and emergency orpendinres and actions taken by the Village
Manager and ratiffing any action or emergency order issued by the Village Manager to protect
the public from COVID-I9; and
WHEREAS, on April 28,2:n20,the Village Council approved Resolution No. 2020-23
confirming additional emergency expendinres and actions taken by the Village Manager to
protect the public from COVID-l9 and ratifying the emergency orders issued since the adoption
of Resolution 2020-21; and
WHEREAS, in an effort to continue mitigating and slowing the spread of COVID-l9
within the Village, the Village Manager has issued additional emergency orders; and
WHEREAS, the Village Council desires to confirm any additional emergency
expenditures and actions taken by the Village Manager to protect the public from COVID-l9 and
ratiry the emergency orders issued since the adoption of Resolution No. 2020-23; and
WHEREAS, the Village Council finds that this Resolution is in the best interest and
welfare of the residents of the Village.
NOW THEREFORE, BE IT RESOLVED By THE VILLAGE COUNCIL OF TTTE
VILLACE OF KEY BISCAYNE, F',LORIDA, AS FOLLOWS:
Section 1. Recitals. That the above recitals are tnre and correct and incorporated
herein by this reference.
Section 2. Confirminq Expenditures. That, in accordance with Section 9-5 of the
Village Code, the Village Council hereby confirms any additional emergency expenditures and
actions taken by the Village Manager relating to the Declaration to protect the public from COVID-
19, as furttrer provided in the Village Manager's staffreport supportiog this Resolution.
Section 3. Ratilication. That the Village Council hereby ratifies and approves any
action or emergency order issued since the adoption of Resolution No. 2020-23 by the Village
Managerto protect the public from COVID-I9.
Section 4. Effective Date. This Resolution shall take effect immediately upon
adoption.
