HomeMy Public PortalAbout005-Fire Stations Lowman MetalCONTRACT RENEWAL AGREEMENT THIS AGREEMENT made and entered into this JOV day of 2004, by and between the City of Richmond, Indiana, a municipal co ration acfivfby and through its Board of Public Works and Safety (hereinafter referred to as the "City") and Lowman Metal Shop, Inc., 150 Park Avenue, Eaton, Ohio 45320 (hereinafter re- ferred to as the "Contractor"). WHEREAS, City and Contractor entered into an Agreement, numbered 214-2002, on or about January 17, 2003, whereby Contractor agreed to provide mainte- nance on the heating, ventilation, and air conditioning systems located at Fire Station number one (1) during the calendar year 2003; and WHEREAS, Such Agreement provided that the City may elect to extend term of the Agreement during the calendar years 2004 and 2005; and WHEREAS, City wishes to exercise this option and extend the contract during the cal- endar year 2004. NOW THEREFORE, In consideration of the following, including the above stated recit- als, the parties agree as follows: 1. Contractor shall provide maintenance on the heating, ventilation, and air condi- tioning systems located within Fire Station number one (1) during the calendar year 2004. 2. Contractor shall be paid a total sum not to exceed Two Thousand Six Hundred Ten Dollars ($2,610.00) for the complete and satisfactory performance of the ob- ligations required by this Agreement. 3. All other terms, conditions, obligations, and covenants contained in Agreement 214-2002 are incorporated by reference, made a part hereof and control the obli- gations of the parties to this Agreement. 4. City retains the sole right to determine whether to extend this Agreement. Nothing herein shall be deemed to require the City to extend this Agreement beyond the calendar year 2004 nor shall anything be deemed a waiver of the City's right to extend this Agreement upon the conclusion of the calendar year 2004. Contract No. 5-2004 IN WITNESS WHEREOF, the parties have executed this Agreement at Richmond, Indi- ana, as of the day and year first written above, although signatures may be affixed on dif- ferent days.
