CITY OF TEMPLE CITY
May 15, 1961
1. A regular meeting of the Planning Commission of the City of
Temple City was held in the City Hall, 9664 East Las Tunas
Drive, Temple City. The meeting was called to order by
Chairman Pursley at 7:45 P.M.
2. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance to the Flag
was led by Chairman Pursley.
3. ROLL CALL: Present: Commissioners: Burr, Harker, Nunamaker,
Meek, Pursley;
Absent: Commissioners: None;
Also Present: Woollett, Holden, Lumsdon.
4. APPROVAL OF MINUTES: Commissioner Meek asked that the follow-
ing addition be made on page 2, last paragraph: "the closest
other rest home is zoned C -2 ". Commissioner Meek asked that
item 7, COMMUNICATIONS, be elucidated by eliminating "Mr. Meek
countered that he disagreed with this approach' and substitut-
ing the following information. I believe that if you disagree
with the plans presented, it would be to the advantage of the
applicant to know off hand that some of the things that he has
do not meet the requirements. You are certainly allowed to
discuss the conditions of any variance with either the
applicant or the 'neighbor, but that does not mean that you
have to give an opinion. I agree with the opinison part, but
as far as discussing the case pro and con, I believe that you
should be fully informed. I do not want it in the minutes
that I disagree with a decision being rendered before we come
into a meeting." Further, Commissioner Meek requested that
Commissioner Harker's comment on this matter be entered in
the minutes: "Whenever possible, we should get out to see the
property involved. We never should commit ourselves one way
or another. Such commitments should be made at the meeting."
Commissioner Meek made a motion to approve the minutes of
April 17, 1961, as expanded, seconded by Commissioner Harker
and carried unanimously.
5. PUBLIC HEARING: SPECIAL USE PERMIT CASE NO. 61 -16:
Chairman Pursley announced that this was the time and place
for a public hearing on the request for special use permit to
expand sanitarium facilities at 5610 McCulloch, Temple City.
Planning Advisor, Ed Holden, reviewed the case. Originally a
request for 36 beds, the Planning Commission, at the meeting
of April 17th, recommended denial to the City Council. The
present request before the Commission was referred to it by
the City Council with a modified plot plan which shows only
24 beds and no change in the front elevation of the home. The
plot plan shows 36 parking spaces, the driveway entrance on
the south side and the exit on the north side of the property,
with 10' one -way driveways. 5'6" walls are shown around the
entire property. This wall should not extend into the front
set -back area. Thirty -six parking spaces, as shown, are the
number required under the ordinance for 24 beds, as shown on
the plan. There is no indication on the plan that the area is
to be paved. The 12 space per bed parking requirement is based
on hospitals and sanitariums throughout the County, and may be
too great for a home with permanent patients. It has not been
made clear the nature of the patients in this home. The plot
plan appears to be inadequate in terms of landscaping and
outdoor recreation area for the patients. This request is for
a use permitted in this particular zone unless there is some-
thing about it as proposed which would be detrimental and
detract from the general community character of the neighbor-
hood. Density of the home, if permitted 36 patients, would be
equivalent to an R -3 zoning in the area; if permitted 24 patients,
would be equivalent to an R -2 zoned area. It seems that the exist-
ing 24 beds, if the Commission wishes to maintain the full 36

parking spaceq makes an inadequate total plot plan arrangement.
The front as presently established would be approximately
the same as it appears now, and more consistent with the
present neighborhood situation. As the density of land use,
particularly on a resident al street goes up, it is important
to consider the matter of •curb and sidewalks,

Chairmaniasked to hear from those favoring the requested
Special Use Permit, James A. Montpas, Seta Temple City Blvd.,
attorney representing, the applicant, Mr. George Rust, 5610
McCulloch, the appl icant,iMr+ Charles W. Parrott, owner of
rest home property, and Mr. Neuse of Brooks and Miller,
Engineers, spoke on behalf of granting the requested permit,
stressing Mr, Rust's desire and efforts to cooperate with the
City in all its:requests, his need for increased facilities
to be able to accommodate both men and women in the home. Mr.
Parrott reviewed fades concerning the rest home, which was
opened in 194.6 with t) patients, enlarged in L50 to 9 patients,
adding that it has not been a profit..making endeavor, and
has not decreased property values; that there have never
been more than three or four visitors to the home at any one
time, Mr. Montpas affirmed that residents in the area
purchased homes with knowledge of the presence of the rest
homes; that there is no parking problem as visitors are
discouraged and patients do not own automobiles; that the
light areas.on the plan will be paved with concrete, the dark
areas with asphalt; that Mr. Rust will abandon the originally
suggested change in front elevation and leave the appearance
as is; that property on McCulloch has actually increased in
value; that present facilities for rest homes in Temple City
provide a total of 35 beds; that the older people should be
provided good rest home facilities. Mr. Montpas concluded
that he hoped the Planning Commission will have the courage
and foresight to recognize the need and grant this request.
Chairman Pursley asked to hear from those opposed to this
request for Special Use Permit. Mrs. Eric McCrudden, 5620
McCulloch, stated that she and many others are still opposed
to any expansion of the home; that there are 7w of the
reported )5 beds located on McCulloch; that there is no
provision for removing patients in an emergency. Mrs.
McCrudden asked that those opposed be requested to stand.
Chairman Pursley counted 22 standing in opposition to the
proposed Special Use Permit. The following people :spoke
in opposition to granting of the permit:Salvatore Pespisa,

Mae Masterson, 5606 McCulloch. Basically the opposition
consisted of the following points: (1) desire of residents
to keep quiet residential ne i c hbo rhood; (J) concern over
lack of recreational facilities for occupants of rest home;
(3) concern over the f: :cure management of the rest home;
(4) disturbance caused when ambulances are called to home;
(5) hampers natural play of children in neighborhood.
The following people requested that their names be removed
from the petition submitted by Mr. Rust: Mr. iyiuruz.zo, 5561

Chairman Pursley asked for discussion among the commissioners.
Commissioner Harker observed that the new plot plan satisfactor-
sly answers qui2stions he raised at the previous hearing
concerning commercial appearance of oiqginei plot plan, the
single narrow driveway, and inadequate parking. He suggested
that the driveway on the north be continued to the back of the
property and that a garden area be created at the expense of
two or three parking spaces.
Commissioner Nunamaker counseled that the commission could

not turn down a reasonable plan; that there 'should bes - spade
for.the- .patients to get outside; that we must prepare for
people as they get older; that on Sunday afternoon there were
only three cars in view visiting the three rest homes on
MCC: 1 1 och;. that i n c l u s i o n of garden space would be very good.

Commissioner Burr advised that this is not a question of
'putting in a new rest home, but a matter of expansion; that
expansion is in order with the modifications to the plan
as submitted at this time; that a building which is located
within 11' of the property line, a violation of the County
Building Code, w i l 1, be demolished
Commissioner Meek counseled that he would not like to live
next door to a rest home; that there could be a poor psycholo-
gical effect on children; that the lot at ::�1O McCulloch
is very narrow; that such an expansion should be done in a
zone;.. that as compared to 3403 square feet per person at
the home on the corner of Live Oak and McCulloch, Mr. Rust's
home will provide 1C 1 square feet per person with 20 patients,
continuing that the other home on McCulloch occupies three
lots and sets way back. He continued that an attempt to
overexpand does not indicate too great concern for the older
people; that expansion of this home could begin a chain of
events ( further expansion by purchasing coat i ce ous property).
resulting in a hospital zone (C -3), which would mean that
monies presently on the tax rolls would be shared by other
residences.
Chairman Pursley advised the assemblage that less than two
months ago one-half of the people opposing this request were
requesting a rezon i nc to „ -3 (on ';'e 1 land Street); that
considering this, the matter of density and use cannot be
upper most with the opposition; that activities in a rest
home are less than those of 4 or 5 houses on e lot. Chairman
Pursley asked for a motion.
Commissioner Nunamaker made a motion that the Commission
recommend to the City Council the granting of the Special
Use Permit subject to the following conditions:
:1.) That the number of patient beds shall not exceed 20;
2) That a minimum of `.,a car spaces developed to standards
specified in the Temple City Ordinance shall be provided;
>�) That parking area and access thereto shall be paved with
asphaltic concrete or equal surfacing and the minimum width
of paving on access driveways shall be 10 feat on one -way
and 1 feet on two -way driveways;
4) That a solid concrete block or masonry wall 3'01 in
height shall be constructed and maintained adjacent to parking
areas and access driveways along a i l property lines to within
20 feet of the front property line;
That the property be developed in accordance with a revised
plot plan to be submitted; after said plot plan has been
reviewed and approved by the Planning Commission as being in
substantial compliance with the conditions contained herein,
b) That curb, gutter and sidewalk shall be constructed in
McCulloch Avenue for the width of the property i ; accordance
with the standards and specifications of the City of Temple
City;
,) That landscaped area and outdoor recreation space shall be
provided and maintained; the extent of such areas to be as
shown on the plot plan required under condition five above;
r".) One single or double faced unlighted sign not to exceed
I6 square feet in size containinc information about the
rest home, may be erected and maintained within the front
yard setback or elsewhere on the property;
A That there are exceptional) and extraordinary circumstances
applicable to the property of the applicant that do not apply
generally to the property or class of use in the same vicin:i.ty.;.
10) That the granting of the Special Use Permit of the
applicant is not detrimental to the public health, general
welfare and convenience of the community and w i l l not be
injurious to the property in the same vicinity;

11) That this Special Use Permit shall not be effective for
any purpose until the owners of the property involved have
filed with the City Clerk of the City of Tm;::le City their
affidavit stating that they are aware of and accept all the
conditions of this permit.
The motion was seconded by Commissioner Harker, and carried
with the fol lowing roil cal 1 vote:
AYES: Commissioners: Burr, Harker, Nunamaker, Pursley;
NOES: Commissioners: Meek;
ABSENT: None.
Commissioner Pursley announced the close of the public hearing.
Commissioner Burr made a motion that the meet i nd he adjourned,
seconded by Commissioner Harker and carried unanimously.
The meeting was adjourned to the regular meeting-; of June 5,
