9. APPEAL OF PLANNING COMMISSION APPROVAL OF CONDITIONAL USE
PERMIT NO. 123
Comments :
To appeal Planning Commisaion approval of Conditional Use
Permit No. 123 to permit the' City Council to review the
proposal to construct exterior shops at the existing multi-
tenant retail shopping mall (Market Place) located at 3100 E.
Imperial Hiqhway in the CB-1 (Controlled Business) zone.
Recommendation:
Staff respectfully requests that after consideration, the City
Council direct staff on the disposition of the proposed
project.
10. WEED ABATEMENT PROGRAM FOR 3341 FERNWOOD AVENUE AND 11929
LONG BEACH BOULEVARD
Comments:
The Weed Abatement Program consists of the removal of weeds
from properties within the City and the collection of the cost
of said work through a special assessment.
On December 15, 1992, the City Council adopted Resolution 92-
179 setting the date for a Public Hearing on the Weed
Abatement Program for FY 1992-93.
Recommendation:
Recommend'that the City Council of the City of Lynwood approve
the attached resolution entitled: "A Resolution Passing Upon ,
Objection and Directinq the Director of Public Works to Abate
the Nuisance of Dry and Drying Weeds that Exist at 3341
Fernwood Avenue and 11929 Long Beach Boulevard in the City o£

All matters listed under the Consent Calendar will be acted upon by
one Motion affirming the action recommended on the agenda. There
will be no saparate discussion on these items prior to voting
unless members of the Council or staff sequest specific items be
� removed from the Consent Calendar for separate action.
il. SECOND READING - AN ORDINANCE OF.THE CITY COUNCIL OF THE CITY
' OF LYNWOOD' AMENDING CHAPTER 4 AND CHAPTER 25, OF THE
MUNICIPAL CODE AND ZONING REGULATIONS WITH RESPECT TO
REGULATING FAMILY DAY CARE HOME STANDARDS
12. CITY HALL BUILDING RE-ROOFING
Comments:
The main City Hall building roof is in need of complete
rehabilitation due to numerous leaks. This prevents normal
city business operations from being effectively conducted
during heavy rain-storms.
Recommendation:
It' is recommended that the City Council adopt the attached
resolution approving the rehabilitation of the Main City Hall
building roof, and authorize the City Manaqer or his designee
to make the necessary appropriation and transfer.
13. CITY HALL AND CITY HALL ANNEX IMPROVEMENT PROJECT
Comments :
The City Hall Annex Building and the Main City Hall Buildings
are in need of various improvements. The Annex is in need of
carpet paint, electrical modifications and flooring. The Main
City Hall Building is in need of modifying counters, ,
, bookshelves, electrical work, construction of a wall and
relocating doors. The estimated cost of improvements is
$39,000.
Recommendation:
It is recommended that the City Council adopt the attached
resolution approving the appropriation of $ 39,000 for various
improvements to the Annex Building and the Main City,Hall
Building located at 11330 Bullis Road and authorize the City
, Manager to make the necessary appropriation and fund transfer.
14. ACCEPTANCE OF AN EASEMENT FOR PARCEL MAP N0. 22800 (PROJECT
3697 LOUISE AVENUE)
Comments :
Tentative Parcel Map No. 22800 was conditionally approved by
the Planning Commission at its meeting of April 9, 1991. As
part of the conditions, dedication of a five foot wide
easement on Louise Avenue for street widening purposes was
required. All conditions were approved or have been
guaranteed.

15. MEMORANDUM OF UNDERSTANDING (MOU) WITH THE LYNWOOD CITY
EMPLOYEES ASSOCIATION
Comments:
To adopt a comprehensive Memorandum of Understanding between
the City of Lynwood and the Lynwood City Employees'
Association.
Recommendation:
Adopt the attached resolution approving Exhibit A, a
comprehensive MOU between ,the Lynwood City Employees'
Association.

on tonights agenda. �
PUBLIC HEARINGS
Mayor Richards announced the time had arrived for the Public
Hearing relative to the Comprehensive Housing Affordability
Strategy (CHAS) Draft Annual Plan and Performance Report
Approval.
It was moved by Councilmember Wells, seconded by Councilmember
� Byrd and carried to open the Public Hearing.

' -Claude Law questioned the Senior Citizen aspect relative to CHAS
report, as well as CDBG concerns. 5tated he would like to see
� Sectiorr 8 addressed as well, , q�u�stioned new housing and eminent
domain and the effect it would have on overcrowding in the
schools. Would like to see these items addressed.
� Rev. Floyd spoke relative to the housing projects. Sp�+ke
regarding residents being able to obtain home inprovement loans
and the number if residents that would move out of the city
because they are unable to obtain these funds.

Case No. 18: Amendment to the Lynwood Municipal Code for Family
Day Care Nomes.
It was moved by Councilmember Wells, seconded by Councilmember

� Emma Esparza questioned whether or not this item is related to
the Genesys Program, whether or not there was going to be an
snvironmental impact report done, whether or not there was going
to be an environmental impact report done, whether or not there
was qoing to be a Public Hearing and whether or not this item was
going to be placed on the ballot.

" Claude Law 3866 Walnut Ave. stated violations of riqhts to
citizens relative to changes in the ordinance that affect his
residence.
Rev. Floyd questioned chanqes in the ordinance relative to fees
and that he is not in favor of neighbor objecting to family day
care centers. Stated an alternative could be a change in fees.
also stated that if the business owner was paying the fees, that
he objects to residents having.the right to appeal.
Councilmember Rea questioned the number of licensed day care
facilities in the City and questioned if they include ambulatory
care..

City Manager Adams stated he had met with Continental cable and
the City Attorney and stated they were asking the City to
authorized to acquire this equipment through the informal bid
process, so that the City's Cable production activity can be
handled within the entrepreneurial spirit.

City Manager Adams spoke regarding a debt issuance, made up of
many component parts, proposed°as Certificates of Participation
stated it would be appropriate to discuss setting up a Lynwood
Financing Authority. Suggested revenue bonds by Public Financing
Authority and stated there were three practical instruments
available to the City. Those being a Certificate of
Participation which would be issued either by the City of the
Redevelopment Agency under status-quo. The second would be
Revenue Bonds by the Public Financing Authority we achieve three
particular objectivesz
a) lower interest rate on revenue than a Certificate
of Participation.
b) lower cost in tax allocation bonds

, To appeal Planning Commission approval of Conditional Use Permit
� No_ 123 to permit the City Council to review the proposal to
� construct exterior shops at the existing multi-tenant retail
shopping mall (Market Place) located at 310-0 E. Imperial Highway in
the CB-1 (Controlled Business) zone.
Facts•
' 1. Section 25-11.3 of the Lynwood Municipal Code provides that a
; Conditional Use Permit be obtained in order to operate any
business with respect to Multi-Tenant Malls.
2, Section 25-25.2 through 25-25.9 requires that an application
' for modification, expansion, or other+change.in an existing
Conditional Use be applied for provided that the modification
will not effect the prescribed findings in the preexisting
Conditional Use Permit as described in Section 25-25.7. of the
Lyriwood Municipal Code.
. 3. At its regularly scheduled meeting of January 9, 1990 the City
Planning Commission conditionally approved Conditional Use
Permit No. 31 under Resolution #2308 to allow the applicant
(DOnald Chae) to operate a Multi-Tenant Shopping Mall at the
above stated address.
4. On January 18, 1990 the approved Conditional Use Permit No. 31
was appealed to the City Council for review and consideration.
5. On August 13, 1991, Planning Commission approved a Conditional
' Use Permit 91 (CUP 91) under Resolution No. 2404 for the
. purpose of allowing a video arcade within the Market Place of
Lynwood. A video arcade was not permitted under the original
CUP NO. 31.
6. On October 15, 1991, the Project Review Board reviewed and
disapproved a variation of the subject proposal.
7. At its regular meeting on October 29, 1992, the Site Plan
Review Committee approved the proposed project, (CUP No. 123)
subject to the conditions in the attached Resolution No. 2453.
8. On November 10, 1992, the Planning Commission approved
Conditional Use Permit No. 123 (CUP NO. 123) with specific
conditions under Resolution No. 2453.
Issues And Analvsis:
The applicant proposes a 5,500 square foot retail addition
- consisting of shops fronting on a pedestrian walkway at the
exterior of the existing multi-tenant retail shopping mall. The
addition includes three (3) 320 square foot shops, two (2) 235
square foot shops, one (1) 205 square foot shop, one (1) 200 square
' foot shop and one (1) 160 square foot shop. The proposed design
calls for the addition to be added to the north side (entry side)
and the west side of the existing development. The design also
calls for a pedestrian promenade with shops fron '
lined sidewalk including benches, and special pa 'ng t��e�a�

Nineteen (19) additional parking spaces are proposed to accommodate
the new retail addition as shown qn the attached site plan.
The proposed exterior shops wi.th the design recommendations of
staff wil encourage pedestrian activity commensurate with the
' "paseo" design that is proposed by the applicant. In order to
facilitate an attractive shopping environment for the public, Staff
�, is recommending that a tree be installed in front of each of the 19
parking spaces. A species of trees should be selected so that the
canopy extends above the signage as depicted on the elevation.
Additionally, Staff is requiring a three (3) foot wide extended
curb in order to allow pedestrian traffic to move easily between
the parked vehicles and the paseo walkway.
Existina and Proposed Conditions of Approval•
� � Staff notes that the applicant has failed to perform previously on
several conditions of development established by the Public Works
I Department and that the applicant must bring outstanding conditions
of approval up to City standards. No development permit will be
issued without completion of all outstanding required conditions of
approval.
. In order to ensure an attractive shopping environment Staff has
approved a total of nineteen (19) additional conditions of
approval with the following amendments.
' 1. Probosed Condition: Parking abutti.ng the proposed project may
present a hazard for pedestrians and it is recommended that
, the proposed additional parking be eliminated in order to
further expand and enhance the pedestrian area abuttinq the
proposed shops.
2. Proposed Condition: Mature tree shall be installed and
maintained with an automatic irrigation system and controller.
3. Proposed_ Condition: Special Paving material shall be an
interlocking paver
4. Proposed Condition: Perimeter Landscaping shall be replanted
with shrubs and ground covers as approved by the Community
Development Director and shall be maintained with an automatic
. irrigation system and controller.
5. Proposed Condition: Banners shall be replaced along Imperial
Highway and State Street
6. Proposed Condition: Roll down doors sha11 be contained within
the parapet of the proposed shop(s).
7. Proposed Condition: Proposed shop signs shall be neon affixed
to the shop parapet wall.
8. Proposed Condition: In' order to facilitate an active
pedestrian environment, the proposed shops shall remain open
from 7:00 A.M. to 7:00 P.M., seven days per week.
� Recommendation:
� Staff respectfully requests that after consideration, that City
Council direct staff on disposition of the proposed project.

WHEREAS, the Lynwood Planning Commission, pursuant to law,
conducted a public hearing on the subject application; and
WHEREAS, the Planning Commission, considered all pertinent
testimony offered at the public hearing; and
, WHEREAS, the Community Development Director has determined
that the proposal will not have a negative effect on the environ-
ment, and has therefore declared a Negative Declaration for the
. project; and
WHEREAS,'a Conditional Use Permit is required for development
of a Multi-Tenant Retail outlet in a CB-1 (Controlled Business)
zone.
Section 1. Tfie Planning Commission hereby finds and deter- `
mines as follows:
A. The site of the proposed use is adequate in size and
shape to accommodate the structures, parkiny, walls,
landscaping, driveways and other development features
required by the Official Zoning Ordinance.
• B. The structures, as proposed, subject to conditions, will
not have a negative effect on the values of surrounding
properties or interfere with or endanger the public,
health, safety, or welfare.
C. The site will be developed pursuant to the current zoning
• regulations and site plan submitted and approved by the
Site Plan Review Committee.
D. The granting of the Conditional Use Permit will not
adversely affect the General Plan.
� E. The proposed development will aid in aesthetically
, upgrading the area and will act as a catalyst in
fostering other quality commercial developments.
Section 2. The Planning Commission of the City of Lynwood,
based upon the aforementioned findings and determinations, hereby
approves Modified Conditional Use Permit, Case No. 123, provided
the following conditions are observed and complied with at all
times.
1. The proposed development shall comply with all applicable
regulations of the Lynwood Municipal Code, the Uniform
Building code and the Fire code. .
2. Any proposed subsequent modification of the subject site or
structures thereon or increased retail space or reduction in
square feet of any booth size, shall first be reported to the �
Community Development Director, for review.of said Conditional .
Use Permit.
, 3. The applicant shall meet the requirements of all other City
Departments.
4. The applicant and/or his representative shall sign a Statement
of Acceptance stating that he/she has read, understands, and
agrees to all conditions of this resolution prior to issuance
of any building permits.

�. REDEVELOPMENT DIVISION
5.. Project design shall.be in accordance with the plan-on file in
the Community Development.Department except as approved by
, the Director of Community;Development. The applicant shall
resubmit a site plan and elevation drawings of the project for
final approval by the Community Development Director which'
shall include:
a. Extend concrete stops on plans to eliminate car overhang
' onto sidewalk area.
b. Provide tree grates in tree wells in proposed sidewalk
area.
c. Insure that proposed colors for retail addition are
consistent with existing building colors and facade.
d. Provide trees and planters on new elevation and plan
" drawings subject to approval of Director of Community
, Development.
e. Provide seven (7) pedestrian scaled lamp posts.
f. Provide colored concrete paving.
g. Seven (7�) percent of the gross lot area shall be
landscaped.
h: Provide one tree per. each proposed parking stall
(exclusive of pedestrian scaled lamp post locations (26
total) and insure that each tree is a twenty four (24")
' inch box tree. '
' i. Tree species to be approved by Director of Community
Development.
$UILDING DEPARTMENT �
6. All plans required to be submitted for approval will meet the
requirements of the 1985 edition of the Uniform Building Code,
Plumbing, and Mechanical Code, as well as the 1987 Edition on
the National.Electric Code if submitted before December 31,
1989. If submitted after December 31, 1989, plans must meet
the Building, Plumbing, and Mechanical Codes with California
Amendments.
7. All plans for this building for tenant spaces, remodeling and
use, shall be done in conformance with the Uniform Building
Code, Chapter 7(Appendix), Division 1, for Covered Mall
Buildings, 1985 Edition (before Dec. 31, 1989).
8. Restroom facilities must conform to Uniform Building, and
Plumbing codes, as well as Health Department regulations due
to the expansion of use for Multiple Tenant Usage.
PUBLIC WORKS/ENGINEERING
9. Conditions required by the Planning Commission per Resolution
No. 2308 were not completed. Therefore, all of the conditions
under Resolution No.'2308 will be applied for CUP No.. 123.

10. Extend building fire sprinkler system to protect additional

CODE ENFORCEMENT DIVISION
11.. Management will be r.esponsible of maintaining a..copy of each
, tenant's City business license. Management will ensure that
` tenants will not be open for business UNLESS a<copy of the
City Business License is on file.
12. Management will conduct daily inspection of all hallways and
- walkways to ensure tenants do not encroach.the walkways with
display of inerchandise, sign, etc.
13. Trash Compactor system must be installed in order to prevent
the present constant overflowing conditions.
14. Maintenance of sidewalk, parking area, gutters and all
surrounding area will be done at least once a day before
starting of operations by a commercial company. Copy of the
contract will be maintained in the Management's office, at the
site, at all times.
15. Management will be responsible for cleanup of the parking lot
and surrounding areas (such as immediately surrounding streets
and gutters) after any special event. For any special events
extra trash bins will be placed at each parking lot and mall
exits.
16. Parking lot area will be used for the sole intended purpose as
establ•ished under the code.
Abatement`of violations of any conditions of this conditional
use permit or the Municipal Code shall be within five (5)
days from the date of, ci.tation or formal notice to the owner.
Upon continued violation of any condition of this conditional
use permit or the Municipal Code, the conditional use permit
shall be suspended automatically which may result in the
revocation of the conditional use permit. _.
17. Management will maintain a pro-active approach to the
elimination of graffiti from any structure, fences or
accessory building(s) at the site. Daily inspections will be
conducted in order to have all graffiti removed by 12:00 p.m.
18. All entries to the parking lot area will be,po�ted in
aecordance with Section 22b58 of the California Vehicle Code.
19. No overnight storage/parking of commercial trucks.
Section 3. A copy of Resolution No. 2453 shall be delivered
to the applicant.

SUBJECT: Public Hearing/Weed Abatement Program for 3341 Fernwood
Avenue and 11929 Long Beach Boulevard
PURPOSE
To identify parcels within the City limits that are in need of
weed removal and direct City crews to remove said weeds pursuant
to Section 39501-39588 of the Government Code.
FACTS
� o Each year the City is involved in a weed abatement program
which consists of the Street Maintenance crews removing weeds
from.properties within the,City limits and then collecting the
cost of said work through a special assessment.
o The subject properties were identified to pose a nuisance of
dry and: drping weeds, and the owner were contacted by the City
staff. Since the owners.refused to have their properties
cleaned up, these properties are included in the program.
` o On December 15, 1992, Council approved and a:dopted Resolution
, No. 92-179 (aee Attachment A) that established a public
hearing on January 5, 1993 , for the purpose of allowing all
persons having objections to the proposed work to have an
opportunity to be heard.
o The property owners, identified on Resolution No. 92-179,
' have been notified by mail of the Public Hearing
(see Attachment B).
RECOMMENDATION
Recommend that the City Council approve the attached resolution
entitledd "A RESOLUTION PASSING UPON OBJECTION AND DIRECTING THE
DIRECTOR OF PUBLIC WORKS TO ABATE THE NUISANCE OF DRY AND DRYING
WEEDS THAT EXIST AT 3341 FERNWOOD AVENUE AND 11929 LONG BEACH

WHEREAS, Chapter�l3 of the Code, ciCed ac
L "Weed and Rubbish Abatement," provides for abatement of dry and
drying weede, etubble, brush, litter� or other flammable
material, that constitate a public nuisance; and
� WHEREAS, it has been bro�ght to the attention of the
City Council of the City of Lynwood by the Director of Public
Works that there is a public nuisance on certain parcels of land
located at 3341 Fernwood Avenue and 11929 Long Beach Boulevard in
the City of Lynwood, as hereina£ter more particularly described.
. �� �NOW, THEREFORE, BE IT RESOLVED by the City Council of � �
the City of Lynwood, as follows:
1. That by reason o£ dry and drying weeds, stubble,
brush, litter or other flazmnable materials being located on or in
' front thereof, a public nuisance exiets upon the parcel of land,
lot or portions of lots set forth in the attached list
(attachment A), which shall be made a part of this resolution.
2. That said weeds are hereby found and declared to be
seasonal and recurrent nuisances;
3. That said weeds and/or stubble, brush, litter, or
other flammable material which endangers the public safety by
L creating a fire hazard, constitute a public nuisance which must
be abated by the removal thereof and that if the same are not
removed by the owner of the aforesaid property, the nuisance will
be abated by the City and the cost thereof assessed upon said
properties and that upon confirmation, such costs will constitute
lien thereon until paid;
4. That the Director of Public Works is directed to
cause said notices to be posted in the time, form and manner
required by law;
5. That the proceedings for aforesaid work shall be
taken under an Act of the Legislature of the State of California
designated as the Government Code, Chapter 13, Section 39501, et
seq., cited as "Weed and Rubbish Abatement", and amendments
thereto.
6. Notice is hereby given that on the 5th day of '

PURPOSE:
To recommend that the City Council adopt the attached resolution
allocating $80,000 for the rehabilitation of the roof of the main
City Hall building located at 11330 Bullis Road.
BACKGROUND:
The'roof �of the main City Hall building is in need of complete .
rehabilitation. There have been numerous temporary repairs done
on emergency.basis after heavy rain. However, the roof has
reached a point of deterioration such that patching is no longer
practical, nor cost effective.
ANALYSIS:

�, Upon inspection of the City Hall roo£, it was determined that the
required repairs were of such a magnitude that complete re-
� roofing is required. The repair work will encompass the complete
removal of old roofing material and installation of new one along
�;with insulation, raising of existing air condition units and
� , rearrangement of its piping network, and modifications to certain
� electrical lines. The estimated cost amounts to approximately
1 $80,000 (see attachments).
�
This project is not shown in the Capital Improvement Program of
the Fiscal Year 1992-1993, therefore, funds appropriation is
necessary for this work. �
RECOMMENDATION:
That the City Council adopt the attached resolution approving the
allocation $80;000 for the rehabilitation of the roof of the main
City Hall building located at 11330 Bullis Road, and authorize
the City Manager to make the necessary funds appropriation and
transfer.

PURPOSE:
To =ecommend that the City Council adopt the attached resolution
appropriating $39,000 for various improvements to the Annex
Building and the City Hall Building located at 11330 Bullis Road.
BACKGROUND:
The City Hall Annex Building and City Hall are in need of various
improvements and repairs. They are as follows:
Annex Building
The Annex Building carpet has been temporarily patched in
several locations several times. The carpet is worn and
_ deteriorated to the point that it is a trip hazard� is in
unsightly condition, and needs to be .replaced. Also, the Annex
walls are in need of repainting, electrical modifications are
needed to bring up various circuits in the Annex up to current
Building-Code standards, and the asliestos tile floor in the
lobby �nd hallway areas need to be r.emoveci and retilecl. The
estimated cost for this rehabilitation is $19,000 (see attached
cost estimate).
City Hall Building
� For City Hall, the creation of two new office spaces will require
modifications to the City Clerk's office. These include adding
and relocating light ewitches, fixtures and-receptacles, adding a
new a\c register and related work, cutting and modifying existing
counter, bookshelves and desk, installation of new tile and
• carpet, constructing a steel stud wall with dry wall, and
• removing existing double"door entrance in the City Clerk's office
and installing one door and frame. The estimated cost for these
modifications is $20,000 (see attached cost estimate).
ANALYSIS:
The total costs for the improvements of the City Hall Annex and
the main City Hall is estimated at approximately $39,000,

PURPOSE
To:recommend that the City.Council adopt.the attached resolution
accepting an easement offered for street dedication under Parcel
Map No`. 22800.,
BACXGROUND
Tentative Parcel Map No..22800 was conditionally approved by the
Planning Commission at its meeting of April 9, 1991, per.Planning
commission Resolution No..2368, and Site Plan Review No. 42, As
part of the conditions of approval, the developer was required to�
offer for, dedicatiom a-five (5):foot w.ide s of property
along Louise Avenue for street widening purposes. (See attached
sketch)
DISCUSSION _
The above mentioned easement (as shown on the Parcel Map) is
necessary to provide for street widening at a future date. All
conditions required to be met prior to the recordation of this
map have been completed or guaranteed in accordance with the
, Subdivision Map Act and the City's Subdivision Ordinance.

It is recommended that the City Council adopt the attached

To adopt a comprehensive Memorandum of Understanding between the
City of Lynwood and the Lynwood City Employees' Association.
EACTS
1) The current MOU between the City of Lynwood and the Lynwood
< City Employees' Association expired on June 30, 1992.
2) Collective;bargaininq;has been conducted in qood faith between
' designated representatives of the City of Lynwood and desig-
• nated representatives of the Lynwood City Employees'
Association. _.
3) The f.eatures of the agreed upon MOU are as follows:
a) Family Care Leave added to Leave of Absence provision as
mandated by Family Rights Act, AB 77, Government Code
12945.2.
, b) Amend current PERS contract to increase the 1959 Survivor
Benefit from basic level to third level.
c) Amend holiday section of the MOU to provide Cinco de Mayo
� to be observed on the lst Monday in May by fulltime and
PERS eligible hourly employees.
d) Increase City contribution toward health insurance from
$325 to $375 mo:
ANALYSIS & CONCLUSION '
Collective bargaining has been conducted in accordance with the
provisions of the Myers-Milias-Brown Act. Mutual agreement between
� the respective parties .has been reached. It is in the best
interest of the City to the agreement.

Adopt the attached resolution approving Exhibit A, a comprehensive
