AFFORDABLE HOUSING PROGRAM - APPROVAL TO ENTER INTO A SERVICE AGREEMENT TO PREPARE A LONG RANGE TWENTY YEAR HOUSING PROGRAM Comments : The purpose of this item is to obtain City Council approval to enter into a service agreement with Yina Moore Davis (YAM Desgin and Development) Recommendation: Staff respectfully recommends that after consideration, the City Council approve the attached resolution approving the Agreement to contract with Yina Moore Davis (YAM Design and Development) to provide consulting services for production of a Twenty Year Housing Plan for the City. 13.. RESOLUTION TO SUPPORT THE SOUTHEAST AREA SUBREGIONAL PLANNING • PROCESS Comments: On Wednesday, January 13, SCAG presented an overview of the Regional Comprehensive Plan at the Southeast Mayors and Councilmembers Association (SEMCA) meeting. It was proposed that SEMCA provide the decision making forum for developing I and adopting a subregional plan for the Southeast Los Angeles County Subregion. '� Recommendation: i It is recommended that the City Council adopt the attached � resolution for inclusion in the Southeast Area Subregional I Planning Process. 14. CERTIFICATION AND REVIEW OF UTILITY USER'S TAX EXEMPTIONS i Comments : i The purpose of this item is to comply with Resolution No. 90- 191, Section 5(j). The City Council must review and approve I the certified list of Utility User's Tax Exemptions. Current � list consists of senior citizens age 65 and over. I Recommendation: I It is recommended that the City Council adopt a resolution 1 approving the certified list of Utility User's Tax Exemptions � for period January 1, 1992 through December 31, 1992. ; 15. UTILITY USER'S TAX AUDIT � Comments : I I An Audit Report was prepared for revenue received from the � Otility User's Tax for calendar year ending December 31, 1992. , The Report provides an accounting of total revenue received . IN THE COUNCIL CHAMBERS OF THE CITY HALL, 11330 BULLIS ROAD, CITY OF LYNWOOD, CALIFORNIA. i 5 I I , SPECIAL �JOURNED_MEETING, JANUARY � 1993 The City Council of the City of Lynwood met in a Special Adjourned Session in the City Hall, 11330 Bullis Rd. on the above date at 7:30 p.m. Mayor Richarde in the chair. Councilmembers Byrd, Heine, Rea, Wells and Richards answered the roll call. - Also present were City Manager Adams, Deputy City Attorney Barnes and Deputy City Clerk Manibusan. Deputy City Clerk Manibusan announced the Agenda had been duly posted in accordance with The Brown Act. Mayor Richards stated he would like to take item #9 out of order and open discussion on The Chamber of Commerce Budget. City Manager Adame gave a summary relative to thia item, stating . the amount of the budget request from the Chamber is for $100,000 dollars for the accountable year 1993. Due to the fact the City is on a fiscal year basis, accommodations had already been made for this fiscal year and the amount =equested if it were taken on a SQ$ basis would be available based on the appropriation for this fiscal year. Asked Councilmember Wells for additional remarks. _ Councilmember Wells, stated she had served with the organizing committee and they had come up with some recommendations relative to the Chambers involvement, Stated the Chamber had come up with some productive recommendation for the City. Stated Chamber had made a commitment to become more involved with the Council and the Community. Stated the Chamber was going to become more aggressive towards bringing smaTl businesses into the Chamber. Also diecussion towards combining programs. Stated the Miss , Lynwood Pageant had not done very well, so a possibility was to combine it with the Youth Education Program. Stated the Chamber had requested to receive one fourth (1/4) of the money at this time, and the Chamber would come back with the total budget for the remaining funda. Stated the $30,000 and the recommendations for staffing ae well as their commitment is needed in the City. Councilmember Syrd discuesed bringing new businesses into the City. City Manager Adame, stated he had spoken with outgoing President Leighton Hull, relative to structuring specific recommendations, for which would be allocated an additional $30,000, two apprentice type positions, and performance based contracts with the Cities input, for promotional activities, between the City and the Chamber. This would allow both an evaluation for the .additional supplement revenue to the organization based on performance, which would be evaluated for future funding. Rather than subsidizing 100$ positions, these funds would be set aside to have a specific purpose of promoting the City and being . involved in entrepreneurial activities with the Chamber and achieving growth in its membership. , It was moved by Councilmember Wells,-seconded by Councilmember r Byrd to approve the Chambers request, as recommended and modified � . by staff. I Councilmember Heine questioned for information only the amount. � City Manager'Adams stated it would be $100,000, and provisions I had been made during the fiscal year for the next six months, and 4 staff recommende appropriation with the 93/94 fiscal year for the I second half at the appropriate time. 1 1�► IT�I � Q + I � � : Councilmember Rea stated that he agrees supporting the Chamber, however,�he feels the Chamber to have too many faulta and failings with the current administration, for the city to commit funding and resources. Stated the Chamber needs to,identify its own problems, and find reasoning within the administration. Councilmember Wells stated upon meeting with the Chamber that it is incumbent among the Council to solicit new business, as well as to include the Chamber in more activities. Councilmember Heine stated he is a representative for the Ghamber and was not included in this discussion. City Manager Adams stated there had been a committee appointed by the Chamber President - . PUBLIC ORAL COMMUNICATIONS Leighton Hull, outgoing President for the Chamber of Commerce, . thanked Council for meeting on the issues, and spoke of the attempts to involve outside people from the Chamber. Stated the Chamber may not have been ae diligent as they should have, however they are making the attempt to correct these problems. The eafeguard that was put in the letter was a request of a total budget but approving twenty-five percent now so that the Chamber could come back with more specific, well defined programs. City Manager stated, based on this information, he recommends modifying to accommodate the 25$ level, with the Chamber bringing back performance based contracts, so opposed to approving $100,000 that the Council approve $25,000. Councilmember Wells questioned whether or not Council could approve $100,000 and only allocate $25,000. City Manager Adame etated that what was actually being sought was 'for there to be a level of accountability. It was moved by Councilmember Wells, seconded by Councilmember to '- accept the chambera request and bring back to the City with Modifications. PUHLIC ORAL COI�II�ltJNICATIONS Dr. Floyd epoke in support of the Chamber. Also stated the Chamber President had never heard of the Lynwood Plan. Spoke regarding working with the Council and the Chamber on the Lynwood Plan. Michael Hite, incoming Chamber President, spoke regarding volunteers for the Chamber as well as the organizations representation of the City. Stated he is committed to doing the best job he can. 'City Manager Adams stated the project is aimed at enhancing Citizen Participation, expanded Block Club efforts and to develop framework to institutionalize block club programs. Cynthia Green-Geter gave a presentation on the Neighborhood Services Project. Community involvement and direct input. Spoke of Service programs already in place. Stated the Block 2 s � Council would be a direct conduit to the City Council, there to hear concerns of the Block Club, and address iesues brought before them. The goal of the project is to establish a block _ club on e'very street in Lynwood. Also would like to see some sort of Block Social. City Manager Adams epoke regarding overall services and interfacing with citizens in the form of workshops. Also spoke relative to the Block Watch programs, Block Socials, ' Beautifications, °How to be a Coordinator" and the complimentary level maximizing citizen participation. After further discussion , It was moved by Councilmember Wells, seconded by Councilmember - Byrd to approve, THE LYNWOOD SERVICES PROJECT AND TO INCLUDE THE . Councilmembers Byrd, Heine, Wells and Richards anewered the roll call. - It was moved by Councilmember Heine, seconded by Councilmember Byrd and carried to excuse Councilmember Rea. Also present were City Manager Adams, Deputy City Attorney Barnes, City Clerk Hooper and City Treasurer Pygatt. City Clerk Hooper announced the Agenda had been duly posted in accordance with The Brown Act. It was moved by Councilmember Byrd, seconded by. Councilmember Heine and carried to approve the minutes o£ January 5, 1993 with corrections. It wae moved by Councilmember Wells, seconded by Councilmember Byrd and carried to approve the Proclamation for World Literacy � Crusade. + It was moved by Councilmember Wells, seconded by Councilmember Byrd and carr,ied to adjourn to the Lynwood Redevelopment Agency at 7:39 p.m. � Council reconvened at 7:40 p.m. PUBLIC ORAL COMMUNICATIONS - A(iBNDA ITEMS ONLY , Eugene Wilson 4013 Woodlawn questioned item #15, Meeting Decorum, - what it is about and why. Mayor Richards explained that the written rules would be discussed. Diecussion pursued between Mr. Wilson and mayor Richards relative to this item. Jerrell Hunter questioned Item #11 Amendment to the claseification P1an, and asked Council the name of the employee �, that would hold this position. � Deputy City Attorney stated the name would be a matter of public record. Mr. Hunter apoke of favoritism. Also questioned the required qualifications and the amount of the salary. Robert Henning questioned Item #12 relative to the Dia1-A-Ride Vans. Asked Council whether or not the City could afford to give . ` away City equipment, feels it should be auctioned off. Also spoke regarding Item #15, meeting decorum. Feels Roberts Rules � of Order is missing within the item and stated they had never been adopted by Council. Feels Council should adopt Universal rules. Mayor Richards stated all meeting decorum would be in provision with The Brown Act. Benjamin Miranda spoke regarding item #15 Meeting Decorum. Also spoke of civil rights fought for by Martin Luther King. Stated � Council needs to concentrate on Rebuild Lynwood. 1 i�QY ITSl1� � � � � � Patricia Carr spoke on Item #15 and questioned the preprinted ' form that is supposed to be submitted to the City Clerks Office before 8:00. Also the prearrangement for items to be discuesed. Stated agendas are not available until Thursdays and the agenda for thia particular meeting was not available at all, because City Hall was closed on Friday and Monday, Wants rules to be , fair to everyone. City Manager Adams stated the Agenda had been posted Thursday at 10:00 in the City Hall. Also the full agenda is available for public view at both Fire Stations as well as the Library. Councilmember Heine spoke in opposition to several items listed that are related to item #15 Meeting Decorum. Councilmember Wells spoke on the 8:00 time limit for signing up with the City Clerk for Special Request for Discussion with Council. Councilman Heine spoke in opposition to several key parts in Roberts Rules of Order. ' Mayor Richards discussed the difference between Rules of Order and Rules of Decorum. Councilmember Byrd stated the main issue needed is respect, and that point being the primary before any fort of rules. 2 • � Item #16 New Years Gun Discharge was diecussed by Councilmember Heine relative to State laws overriding any City Ordinance. Councilmember Byrd stated current laws either City or State " needed.to be enforced. Mayor Richards asked for preference from Council relative to committees, to be brought back at the next meeting. City Clerk Hooper etated the Sanitation District needed an Alternate as soon as possible. It was moved by Councilmember Wells, seconded by Councilmember ' Byrd and carried to name Councilmember Heine as the alternate to the County Sanitation, retroactive to the last meeting date. " Councilmember Heine also questioned the position relative to HUB. Cities. Mayor Richarde stated he would like to hold that position pending further etudy relative to the program. PUSLIC ORAL COMMUNICATIONS Robert Henning, spoke regarding the New Years Eve gun shots. Stated he would not like to see Council sending the Sheriffs into - a situation Tike this but better to utilize the services of the Block Watch Captains. Rev. Floyd spoke relative to Item #15 and Council becoming involved with Private Business. Stated the Public does not receive the agenda at any specific time. William Steck spoke regarding graffiti and the increasing problems since last years Civil Unrest. Stated it is time we do something. City muet take some sort of action to rid the City of w hoodlums. : Margaret Araujo thanked Council members that supported the Commiesioners workshop. Stated the workshop was very " enlightening and the Commiseionera that had attended had had the opportunity to meet so many other representatives from surrounding cities. Spoke regarding problems at Juliene Liquor on Long Beach Blvd. Also made comments regarding condemned apartments. Stated she felt the new Community Development poaition ahould be awarded to someone bilingual. Jerrell Hanter spoke regarding item #15 and the authority of the Mayor relative to Council mattere. Also spoke of negative comments made by Councilmembers. Spoke of Council having a fair. understanding relative to concerne of the community. Also spoke in oppoeition to unfair appointments to jobs within the City. Benjamin Miranda 3893 LeSage spoke relative to a report filed regarding an empty house on Ira St. behind his house, and the overgrown tree falling onto his property. Daniel Garcia 10733 San Jose spoke regarding graffiti probTems on his block and poesibly involving the youth and young artists to paint murals. Also spoke regarding rupture in the street and Public Works correcting the problem. Patricia Carr 3842 LeSage questioned issues relative to the Day Care Ordinance. Also questioned why a Public Hearing was not held on the matter of Richard. Gilehaw. Spoke in opposition to the Meeting Decorum item and stated she would rather deal with issues rather than arguments. Lynwood Resident (Name Inaudible) 3935 LeSage spoke on Item #13, what it means to the City and how it affects the residents. 3 � � City Manager Adame gave a description on flood insurance for the residents. COUNCIL ORALS Councilmember Heine spoke relative to Block Watch Captains being. involved. Stated the only ones that can take action are the Sheriffs. Also made statements for residents relative to what measures are currently being taken to resolve this matter. Informed residents on how to obtain delegated areas for flood insurance. Aseistant City Manager Gonzales clarified information on the AR Flood Control. ' City Manager Adams anawered questions presented by residents relative to the Finance Authority. Jerrell Hunter spoke regarding pilot program to maintain targeted . areas and supplying paint to those residents that are hit hard by graffiti. Councilmember Byrd spoke about the Southern Christian Leadership Dinner he had attended and stated he feels Council should become - involved with Public Business as well as the Publics Interest. Also spoke regarding graffiti problems. Councilmember Wells spoke on a meeting with Willard Murray on Monday, February 5 and 6th. Also epoke on the kickoff for Affordable Living in the City at 10:00. Mayor Richards wiehed everyone a belated Martin Luther Kings Birthday. It was moved by Councilmember Heine, seconded by Councilmember Byrd and carried to adjourn to Closed Session at 9:00. Council reconvened at 9:30. Deputy City Attorney Barnes etated Council had met in Closed Session to diecues and take action on Real Estate Negotiations; no votea neceseary. It was moved by Councilmember Byrd, seconded by Councilmember Wells that this meeting be adjourned in memory of Salvador Frutos, the grandfather of Patricia Alvarez and Lupe Morando, employees in the City Managers Office, and Mr. Gregory Woodson of the Southern California Edison Company that had passed away recently. Meeting was adjourned at 9:45. (See attached map, Exhibit A) OBJECTIVE: To have the City Council adopt a resolution declaring the intention to conduct a public hearing to determine if a public nuisance is being maintained on the subject properry. The hearing date shall be set for March 2, 1993. FACTS: Chronology of events is as follows: _ 11-10-92 Upon routine inspection, observed vacant property with all windows broken or � removed. Also observed discarded furniture and large amounts of trash sirewn throughout the lot and on the public sidewalk. 11-11-92 Mailed warning notice to east owner of record. (Wayneed Saleem,10850 Atlantic Avenue, Lynwood) 11-18-92 Follow-up inspection conducted. Observed property to be in the same condition as on 11-10-92. Attempted to contact owner through Arrow Realty (10850 Atlantic Avenue, Lynwood) informed that property was lost in foreclosure and that Mr. and Mrs. Saleem no longer worked with Arrow Realty. ll-23-92 Obtained new owner's information through Dataquick services. Mailed notice to Transamerica Financial of Lancaster, CA. 12-07-92 Follow-up inspection conducted-no action taken. 1-19-93 Inspection wnducted in preparation for submission of site as a nuisance to City Council. At the site were two Sheriff officers who stated they have had several phone calls regarding drug dealings at the abandoned site. Conditions have not , been abated. BACKGROUND: Staff has received several complaints regazding the conditions at this site. All attempts to obtain compliance from the current property owner have been unsuccessful. Staffs phone calls to the company listed as the properry owner have been unsuccessful. It is appazent that the property is currently in an abandoned state which is in violation of the Lynwood Municipal Code and the present accumulation of junk, trash and debris on site presents a potential hazard to the City. Due to its abandoned state the site has become breeding ground for illegal operations and a threat to ' the surrounding property owners and residents. On November 20, 1992, .the City Council approved the draft Housing Element Revision for submittal to the State Department of Housing and Community Development Department for final review. 2. On December 15, 1992, the City Council approved submittal of . the Comprehensive Housing Affordability Strategy (CHAS) Annual Plan and Performance Report to the Department of Housing and Urban Development (HUD). 3. On January 14, 1993, the City convened the initial meeting of the Partnership for Affordable Living (PAL) Program which will address housing issues identified in the CHAS and Revised Housing Element of the City's General Plan. 4. There is a present need to contract for consultant services ' in order to prepare a long term 20 Year Housing Plan to be used in conjunction with the City's Partnership for Affordable Livirig (PAL) Program and Housing Task Force, the City's ' General Plan, Comprehensive Housing Affordability Strategy (CHAS), and other housing activities.. The proposed Plan will be developed commensurate with the City's long term planning goals and serve as the basis for future planning work relative to annual updates of the General Plan Housing Element and the CHAS. 5. On January 13, 1993, the City received a proposal from Yina Moore Davis (YAM Design and Development) which provides a detailed scope of service for preparation and implementation of a 20 Year Housing Plan for the City of Lynwood. The plan production would commence on February 1, 1993, and be completed by June 30, 1993. The consultant services would � provide an integrated goals statement contained in three major elements: A'Iw✓enty Year Housing Plan, an Implementation Plan and the Partnership for Affordable Living Task Force. In addition, Ms. Moore would be responsible for overatl coordination of final revisiona to the City's Housing Element Revision to bring the Housing Element into compliance with State guidelines and coordinate long range planning with the City's CHAS. 6. On Wednesday, January 13, 1993, SCAG presented an overview of the �Regional Comprehensive Plan at the Southeast Mayors and Councilmembers Association (SEMCA) meeting. It was proposed that " SEMCA provide the decision making forum for developing and adopting a subregional plan for the southeast Los Angeles County subregion. FACTS The first action is to distribute a model resolution (attached) to each southeast area city council to use as a means of expressing its participation in the subregional planning process. The second action would establish a Study Committee of elected officials. The Study Committee will provide policy direction to the subregional planning process and coordinate the preparation and approval of the southeast area subregional plan that will be submitted to SCAG for inclusion in the Regional Comprehensive Plan. The subregional planning process will be initiated by the seven (7) elected officials representing the southeast area on the SCAG Executive Committee. The Study Committee will expand as additional elected officials are appointed by other southeast area cities. The actual work to develop the technical and policy components of the subregional plan will be performed by a consultant that will be selected and directed by the Study Committee and Technical Committee. SCAG will provide the funds, and administer the consultant contract. RECOI�NDATION The City Council adopt the attached resolution for inclusion in the Southeast Area Subregional Planning Process. Utility User's Tax Exemption .Resolution No_ 90-191, Section 5 states that the Tax Administrator shall review and certify � each eligible applicant for waiver of Utility User's Tax. � The criteria for exemption is as follows: a. Senior citizen status-65 years of age or older.. b. Use of Cogeneration (any technology for providing energy will be exempt from utility user's tax for portion of power produced by cogeneration) To date there have been no exemptions given for employing cogeneration technology. However, eight hundred nighty three (893) senior citizens have been certified as,exempt by the Tax . Administrator. 3.) A special exemption noted in Resolution 90-197 is cable services. The estimated loss in revenue for 1992 due to this exemption is as follows: ' a. Cable TV -.$92,330.00 4.) For your review, the attached list provides name, address, and birthdate of all senior citizens certified as exempt by the Tax Administrator (893 Exemptions). 5.) The Tax Administrator and staff have reviewed and determined that all applicants noted on exemption list have met the criteria for exemption as established by Resolution No. 90- 191.
