HomeMy Public PortalAbouto 99:16No. 99-16 Councilman Presents the following Ordinance Seconded by Councilman ORDINANCE AMENDING CHAPTER 160 OF THE CODE OF THE BOROUGH OF CARTERET WHEREAS, the Carteret Planning Board (the "Planning B " oard ) has recommended certain modifications to Chapter 160 of the Code of the Borough of Carteret, the Land Development Ordinance (the "Ordinance"); and WHEREAS, the Mayor and Council of the Borough of Carteret have reviewed the proposed modifications and determined them to be appropriate. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Carteret that Chapter 160 of the Code of the Borough of Carteret be amended as follows: 1. Article XIV - Design and Performance Standards: Section 160-91 Sidewalks is amended by adding a new sentence after the Iast word which shall read: "All service walkways or patios shall have a minimum distance of twelve (12) inches to each side and rear property line so as to serve as a buffer and to allow for proper drainage. 2. Article XV - Section 160-119 Yards Subsection A is amended by adding a new sentence after the last word which shall read: "All driveways shall have a minimum distance of twelve (12) inches to each side and rear property line between any driveway and the adjoining property of another so as to serve as a buffer and to allow for drainage" 3. Article XV -Miscellaneous Provisions: Section 160-98. Accessory Buildings is deleted and replaced with a new Section 160-98 which shall read in its entirety: § 160-98 Accessory Buildings A. No accessory building or structure shall have a ground floor area greater than ½ the ground floor area of the main building or structure on the same lot. B. Each individual property shall be limited to one accessory building/shed no larger than 12 feet by 15 feet, with a maximum height of 14 feet. C. No accessory building shall be allowed in the front yard area or within the front yard setback. Included in the definitions of accessory structure shall be swimming pools, attached or open decks (without walls or roof). NO. 99.16 PAGE Do Al1 accessory buildings or structures shall be located a distance from any main building situated on the same lot, and from side and rear lot lines, equivalent to the height of the accessory structure. All accessory buildings located in the R-25 and R-50 zones as depicted on the Borough of Carteret zoning map shall have a minimum distance of four (4) feet to each side and rear property line. Accessory buildings or structures on corner lots shall not be erected nearer to any street sideline than the front yard setback required on the lot adjacent to the rear line of the lot upon which the accessory building is located Satellite dish antennas. A satellite dish antenna with a diameter greater than two feet may not be mounted on any building or structure, but must be mounted at ground level in the rear yard of the lot and must meet the setback requirements for accessory structures as set forth herein. All satellite dish antennas with a diameter in excess of five feet must be screened with a solid wall or fence at least six feet in height. Any proposed wooden deck attached to a home or to a swimming pool shall not be higher than a four foot platform with 42 inch railing" .
