A regular meeting of the Planning Commission of the City of Temple City was held in the City Hall, 9664 E. Las Tunas Drive, Temple City. The meeting was called to order by Vice - Chairman Johnston at 7:30 p.m. 2. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance to the Flag was led by Vice - Chairman Johnston. 3. ROLL CALL: Present: Commissioners: Briggs, Erickson, Johnston Absent: Commissioners: Beckley, Harker Also Present: Cushman, Shatford, Woollett. 4. APPROVAL OF MINUTES: City Manager Woollett requested a change of wording on Page 3, paragraph 2, line 4 to remove the words "in violation" and insert "violated." Commissioner Erickson moved that we approve the minutes of November 4, 1963, as amended, seconded by Commissioner Harker, and carried by the following roll call vote: AYES: Commissioners: Briggs, Erickson, Johnston NOES: Commissioners: None ABSENT: Commissioners: Beckley, Harker 5. CONTINUATION: SPECIAL USE PERMIT CASE NO. 63 -65 Roland R. & Gladys Hart 9021 E. Pentland, Temple City A brief resume of the case was presented by Planning Advisor Cushman, City Attorney Shatford apprised the Commission that he had prepared a resolution to cover this case and presented pertinent facts from the resolution to the Commission members. The City Attorney also brought to the attention of the Commission the preparation of an agreement for road dedication purposes in connection with this case. Discussion followed among members of the Commission. A motion was made by Commissioner Erickson that we adopt Resolution 63- 50PC, seconded by Commissioner Johnston and carried by the follow- ing roll call vote: AYES: Commissioners: Erickson, Johnston NOES: Commissioners: Briggs ABSENT: Commissioners: Beckley, Harker 6. CONTINUATION: ZONE VARIANCE CASE NO. 63 -66 Noel J. Baldwin 5017 Baldwin Avenue, Temple City A ruling was given by City Attorney Shatford that in this particular case he had investigated this matter and will make a ruling that the Commission can proceed with this case on a lot split basis without consideration of the other parcels, they having been properly deeded out, and that we now have the ques- tion as to whether or not you want to permit the separation of the middle property of the three that are located on this one parcel. It was further suggested by City Attorney Shatford that where we have a question of this type, it would be his recommend- ation that we hold this matter over until the next meeting, at which time we will have all the Commission present. Planning Commission Minutes Page 2 November 18, 1963 Vice - Chairman Johnston gave a brief review of the case from the previous meeting. Mr. Noel Baldwin, 5041 N. Baldwin, owner - applicant, appeared before the Commission to answer questions directed to him in regard to the subject property. Discussion followed among members of the Commission. City Attorney Shatford's recommendation that this matter be held over to the next meeting was discussed at this time. A motion was made by Commissioner Briggs that we hold this matter over to the next meeting. Motion seconded by Commissioner Erickson, and carried by the following roll call vote: AYES: Commissioners: Briggs, Erickson, Johnston NOES: Commissioners: None ABSENT: Beckley, Harker 7. PUBLIC HEARING: ZONE VARIANCE CASE NO. 63 -68 Frances T. Twisselmann 10150 Green Street, Temple City Vice - Chairman Johnston announced that now was the time and place for a public hearing. Planning Advisor Cushman was requested to present the factual data pertinent to the case. Applicant is requesting a variance to create three parcels, all of more than 5,000 square feet, but two of which would not have street front- age as required by City Ordinances 63-103 and 104. Appearing in favor of the variance: Frances Twisslemann, 10150 Green Street, owner - applicant. Harry Hilderbrand, 5104 Glickman, neighbor of Mrs. Twisslemann. No one appeared in opposition. A motion was made by Commissioner Erickson that the public hear- ing be closed, seconded by Commissioner Briggs, and carried by an oral vote. Considerable discussion followed among members of the Commission, City Manager, Planning Advisor, and City Attorney in regard to the present development of the property, fencing and shrubbery, existing road widths and possible future dedication, etc. A motion was made by Commissioner Erickson that we grant the request for a variance subject to the applicant agreeing to dedicate at such time as is requested by the City or her property will be counted in favor of dedication of 25 feet of property which fronts Green Street at such time as the City shall request same or at such time as the majority of the property owners or any of the property owners prepare a petition, your property shall be counted in favor of the petition for street widening purposes; that you will agree as a condition that you will cause to be executed with the other seven property owners whose names the City Attorney will acquire and that you will further agree and the property will be bound to abide by the ordinance of the City of Temple City relating to setback and height of bushes and fences on the corner, and that the City Attorney be requested to prepare a resolution to this effect. Motion died for lack of a second. After further discussion, a motion was made by Commissioner Briggs that we restate the above motion and that a non - severance clause Planning Commission Minutes Page 3 November 18, 1963 be provided in the resolution. Motion seconded by Commissioner Johnston and carried by the following roll call vote: AYES: Commissioners: Briggs, Johnston NOES: Commissioners: Erickson ABSENT: Commissioners: Beckley, Harker 8, PUBLIC HEARING: ZONE VARIANCE CASE NO. 63 -69 Don G. Petty, et al 5305 Arden Drive & rears of 10233 and 10243 Green Street, Temple City Vice - Chairman Johnston announced that now was the time and place for a public hearing. Planning Advisor Cushman was requested to present the factual data pertinent to the case. Applicant is requesting a zone change from A -1 -1 Acre to R -1 -5000; area to be coterminous with Tentative Tract No. 29148. Appearing in favor: Jack Weber, developer of subdivision. No one appeared in opposition. A motion was made by Commissioner Erickson that the public hear- ing be closed, seconded by Commissioner Briggs, and carried by the following roll call vote: AYES: Commissioners: Briggs, Erickson, Johnston NOES: Commissioners: None ABSENT: Commissioners: Beckley, Harker Discussion followed among members of the Commission, City Manager and Planning Advisor in regard to the surrounding property and zoning of a nearby tract. A motion was made by Commissioner Erickson that we recommend to the City Council that this zone change be granted and that the City Attorney prepare a resolution to this effect. Motion seconded by Commissioner Briggs, and carried by the following roll call vote: AYES: Commissioners: Briggs, Erickson, Johnston NOES: Commissioners: None ABSENT: Commissioners: None 9. TENTATIVE TRACT NO. 29148: Jack Weber, Developer Planning Advisor Cushman presented the Subdivision Committee report to the Commission. After a general review of the report, the following changes were suggested: DESIGN Item 3. Delete the complete second paragraph of this item. Item 4. Change the footage to read 52 instead of 60. Item 6, Change to read: The City Subdivision Ordinance requires a minimum dedication for all streets of 54 feet with a minimum pavement width of 36 feet; however, because of the limitations of the tract and in order to obtain suitable lot depths, it is recommended that the 40 foot dedication for Freer Street be accepted and further that 36 feet of pavement be provided, and require a 35 foot radius on the cul-de-sac." 1 1 Planning Commission Minutes November 18, 1963 Page 4 Item 7: Change to read: "Provide a 5 foot utility, sidewalk and planting easement across the frontage of those lots abutting Freer Street and Arden Drive." Item 8: Add: " and energy until the subdivision can be brought into the lighting district." Item 9: Change to read: "Provide sidewalks on both sides of Freer Street adjacent to the curb and gutter." Noel Tangletti, Hillcrest Engineering, appeared before the Commission to answer questions in regard to street width. A motion was made by Commissioner Erickson that we recommend to the City Council the approval of Tentative Tract 29148 with the conditions as amended. Motion seconded by Commissioner Briggs, and carried by the following] roll call vote: AYES: Commissioners: Briggs, Erickson, Johnston NOES: Commissioners: None ABSENT: Commissioners: Beckley, Harker 10. RESOLUTION NO. 63 -49PC: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING TIME LIMITED VARIANCE TO GABRIEL G. JANUS TO CONTINUE USE OF NON-CONFORMING SINGLE FAMILY DWELLING AS DUPLEX UNTIL DECEMBER 15, 1963. Title to Resolution No. 63.49PC was read by City Attorney Shat - ford. A motion was made by Commissioner Briggs that we dispense with further reading and adopt. Motion seconded by Commissioner Erickson and carried by the following roll call vote: AYES: Commissioners: Briggs, Erickson, Johnston NOES: Commissioners: None ABSENT: Commissioners: Beckley, Harker '11. DISCUSSION ITEM: Recommendation of New Zoning Map to the City Council. City Manager Woollett apprised the Commission that the Planning Consultants have prepared a new proposed map as a result of the hearings held before the Planning Commission. The City Manager presented the map to the Commission at this time. After discussion, a motion was made by Commissioner Briggs that we recommend to the City Council adoption of this map and that transmission of all documents, etc. be made to the City Council. Motion was seconded by Commissioner Erickson, and carried by the following roll call vote: AYES: Commissioners: Briggs, Erickson, Johnston NOES: Commissioners: None ABSENT: Commissioners: Beckley, Harker A ruling was made by City Attorney Shatford that since the map has been officially approved and recommended to the Council, it can now be placed on public exhibit. 12. COMMUNICATIONS: a. Mrs. Lillian Goose, 5063 Sereno, Temple City, appeared 1 1 1 Planning Commission Minutes Page 5 November 18, 1963 before the Commission and presented questions in regard to the proposed map. Mrs. Goose was advised that she would be required to take any further requests in regard to the map to the City Council as the Planning Commission had completed their hearings. b. Plot Plan #433 - Mrs. Martin Nelson, 5946 Sultana. Mrs. Nelson explained to the Commission that her six month period had expired and inquired as to how she may extend the time on her plot plan application. Mrs. Nelson was advised that she would be required to file a zone variance. c. Howard Mansor, 5063 Sultana, Temple City, appeared before the Commission and presented questions to the Commission in regard to Pentland Street and the traffic problem that will be created by granting the special use permit for a nursery (see Item 5 of minutes). Mr. Mansor was informed that since the public hearing had been closed and the resolution granting the special use permit had been passed, that his only recourse would be to file an appeal to the City Council. d. City Manager Woollett announced that a Coordinating Council meeting would be held on Tuesday, November 26, at which time there will be a presentation of a synopsis of the master plan and of the proposed new zoning map. Also, at that time, the Superintendent of Schools will make a presentation indicating in his opinion what effect this new zoning will have on the potential growth of the schools. e. Stanley Knapp, 5062 Sultana, Temple City, appeared before the Commission re widening the street on Sultana and the procedure to be followed to get something done. City Attorney Shatford explained the process in some detail to Mr. Knapp. f. Plot Plan #435: Request for a four -month time extension was received. Need additional time to permit plan check, loan approval and start of construction. A motion was made by Commissioner Briggs that we grant this request, seconded by Commissioner Erickson, and carried by the following roll call vote: AYES: Commissioners: Briggs, Erickson, Johnston NOES: Commissioners: None ABSENT: Commissioners: Beckley, Harker 13. ADJOURNMENT: Commissioner Erickson moved to adjourn, seconded by Commissioner Briggs, and carried unanimously. Meeting adjourned at 9:52 p.m, to the next regular meeting on December 2, 1963.
