Lynwood, California, on the above date at 7:30 p: m. Chairman Robbins called the meeting to order. Commissioners Hill, Pryor, Raymond, Read, and Kanka answered roll ca11. PUBLIC H�S RI�TGS Variance - 12016 Long Beach Boulevard (79013] Secretary Gomez reported on the Liquor variance application which was con- . tinued from the previous meeting for Rafael Jimi nez. NIr. Gomez recom- mended denial based on an inability to make appropriate findings to warrant atlowing liquor to be served within 300 feet .of a residential zone. The public hearing was opened and anyone wishing to speak in favor of the application was requested to come forward. Jose Rodriguez, 9804 San VIiguel, South Gate, addressed the Commission as � the applicant's representative and interpreter. i I Commissioner Robbins inquired if the applicant had proof of purchase of the prop- erty and if he �vere buying the property where the restaurant is located. NIr. Gomez ' explained that escrow on the property being purchased for parking had been ex- --, I tended. The applicant stated he had already invested 510, 000 in the purchase. of } i the property adjacent to his restaurant. [80002] A report was presented on the application of Viola Putney and Charlotte Cantrell : .(Today's Child Care) for a Conditionai Use Permit to operafe a day care facility in an R-3 zone at 33'l6 Los Flores Boulevard. Staff; having found adequate•.parking_and,no significant,environmental impact,, recominended approval subject to certain conditions. '' The public. hearing was opened and..anyone wishing to speak in favor of the Conditional Use Permit•was requested to come forward. �Patricia Kabore, 13059 Cantrice,' Cerritos, addressed the.Commission to read a Letter from the parents indicating theEr approval of the facility and the need , ; for child care services in the neighborhood. Viola Putney, 3316 Los Flores, addressed the Commission stating her objections . •, to the condition �uhich wouid limit her to six (6) children. The City Attorney _clariffed the, ordinance and esplained that the Commission can specify a quantity � of children they think �vould be appropriate and they do not have to limit the num- z ber to sis. , � Commis�ioaer Raymond informed those present that if the applicant were licensed I for 10 children or less she would be licensed by the County and if she has more than 10, she must be licensed by the State. Furthermore, the State has a number of requirements that �vould preclude the care of 21 children as she e.Ypects to - have. The applicant was informed that the Iimit of 21 children was a masimum placed by the Fire Department for special events. Variance - 12015 Atlantic Avenue [80003] A report was presented on an application by Julius NTalwitz for a variance to serve liquor within 300 feet of a residentiat zone at the Family Circle Bar, 12015 South Atlantic �venue, Lynwood, in a CB-1 zone. __ The Secretary esplained that, although this bar has operated for 18 years, it has � been closed for 2 years. The ordinance states that any establishment closing for more than 90 days must comply with the Code. Further, staff has felt that findings necessary to grant a variance were not, appropriate in thi� case. The public hearing was opened and anyone. wishing to speak in favor o£the re- quest was asked to come for�vard. NIr. Julius Malwitz, 12015 South Atlantic Avenue, Lynwood, informed the Com- mission he lives in the back of the bar and that he was going to run it himself. Commissioner Raymond brought up the point that adequate parking is not pro- vided. City Attorney iVIurphy confirmed -- the applicant is subject to require- ments of the Code on parking unless a variance is granted for both the 300 feet and parking. There being no one else wishing to speak on this matter, .the public hearing was closed. Although there•were no conclusions made at the April 8. . . "" meeting, it appears to staff that some decisions.must be- made fairly.quickly regarding the•implementation of that , ' zoning. Some queries have been made,of staff In the interim.by citizens.who are interested in the, process that , �. will ensue to re-zone the properties to industrial. . ` II. Ai�1ALYSIS As previously-discussed, fhe General'Plan calls for in- dustrial zoning-on the properties along Wright.R"oad in the vicinity of the subject property. The fact that an industrial.building is nearing completion on the property ' ' was a matter of.further discussion by the Planning'Com- , � mission at the previous hearing. .. � � - Cbnditional Use Permit 2 . SUBJECT: Zone Change - Case Number 80004 DATE: Apri1 30, 1980 APPLICANT: William and La Verne Loving 11438 Spruce Street Lynwood, Caiifornia 90262 I. BACKGROUND I The subject property is on the east side of Spruce between Walnut and Platt. The zone immediately adjacent to the north is R-2; to the south and to the rear of the build- I ing (east) is R-l. The proponents are suggesting ihe con- struction of a 2-bedroom house with one 20 x 30 garage at the e�ctreme rear of the property. There is currently a singte garage on the south side of the existing house to � which there is a driveway off Spruce. Proposed access i to the new garage is along the northerty edge of the proper- iy. Elevations of the house to be constructed are not avail- , ' abLe since Mr. & Mrs. Loving wish to check for avaiL- abitity of the zone change before investing into expensive drawings that will detail the architecture of the building. II. A�IA LYSIS I The lot upon �vhich the zone change is requested exceeds the minimum 6, 000 square feet and therefore qualifies � for an R-2 zone. However, the proposed design of the tot leaves something to be desired. In the first pLace, 2 driveways out of one Lot are infeasible according to Code. � The desirable configuration would be for one driveway to service both units. Secondly, current Code requires that there be at least 25 feet of set back.at the rear; the pro- posed house is almost at the property line (no dimension is oiven for that set back). Thirdty, . the existing I home requires a double gar•age and there appears to be no space to construct it and maintain the 40%o land cover- I age requirement. , � The above-stated deficiencies in the plan submitted by � � NIr. & vIrs. Loving are only the functional Code-type of criticism. The primary decision that must be made is � in terms of intruding into an R-L neighborhood. Granted � • I I � _ ' . - � � - Case No. 80004 � that immediatety to the north of this property there is a tine running east - west, north of which lie R-2 zone properties; the properties to the south are primarily ' R-1. The contention can be made by the proponents that at the east end of the bLock facing Bullis there is one piece of property in an analogous position that is zoned R-2; it invades the R-1 zone that is south of the east-�vest tine separating the R-2 from the R-1. This argument can go either way. The property facing BuLLis coutd be con- strued to be intruding into the R-1 zone.
