A regular meeting of the Planning Commission of the City of Temple City was held in the City Hall, 5938 N. Kauffman Avenue, Temple City. The meeting was called to order by Chairman Beck- ley at 8:02 p.m. 2. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance to the Flag was led by Chairman Beckley. 3, ROLL CALL: Present: Commissioners: Briggs, Clemson, Johnston, Beckley Absent: Commissioners: Erickson Also Present: Shatford, G. Whitnall, Woollett 4. APPROVAL OF MINUTES: A motion was made by Commissioner Briggs that the minutes of May 18 be approved as written, seconded by Commissioner Clemson and carried by the following roll call vote: AYES: Commissioners: Briggs, Clemson, Johnston, Beckley NOES: Commissioners: None ABSENT: Commissioners: Erickson 5. PUBLIC HEARING: Reopened: ZONE VARIANCE CASE NO. 64 -93 Byron J. & Caroline S. Hayes 4040 Cloverly Avenue, Temple City At the request of the Planning Commission, new plans were presented by the applicant for consideration. Mr. Hayes explain- ed that he was submitting three alternate plans, but that he definitely preferred Plan B over A or C. ° Mr. Harold Kreeble, 4823 Fiesta, appeared in behalf of the applicant. A motion was made by Commissioner Briggs that the public hearing be closed. Motion seconded by Commissioner Clemson and carried by the following roll call vote: AYES: Commissioners: Briggs, Clemson, Johnston, Beckley NOES: Commissioners: None ABSENT: Commissioners: Erickson Discussion followed among members of the Commission, City Manager and City Attorney in regard to lot sizes and whether it would be possible for the Commission in acting on something like this to indicate where the parcel line should be without requir- ing that the applicant actually divide the property at this time. City Attorney Shatford stated that it would be possible and that this could be made a condition of the resolution. A motion was made by Commissioner Briggs that we instruct the City Attorney to draw a resolution granting this request for a variance and to consider the proposed line of severance and other stipulations that were discussed at this time. PUBLIC HEARING: Reopened: ZONE VARIANCE CASE NO. 64 -94 Ralph C. & Anna C. Spellman 4900 N. Cloverly, Temple City At the request of the Commission, Mr. Spellman presented revised plot plans for consideration and answered questions directed to him. A motion was made by Commissioner Briggs that the public hearing be closed, seconded by Commissioner Johnston and carried by the following roll call vote: AYES: Commissioners: Briggs, Clemson, Johnston, Beckley NOES: Commissioners: None ABSENT: Commissioners: Erickson Discussion followed in regard to a possible future severance line,and it was the general feeling that this case should be handled in the same manner as the previous one. A motion was made by Commissioner Briggs that we instruct the City Attorney to draw a_ resolution granting this request for a variance, that there be a one -year time limit applied, and that a line of possible severance be indicated on the plot plan. Motion seconded by Commissioner Clemson and carried by the following roll call vote: AYES: Commissioners: Briggs, Clemson, Johnston, Beckley NOES: Commissioners: None ABSENT: Commissioners: Erickson 7. PUBLIC HEARING: Reopened: ZONE VARIANCE CASE NO. 64 -96 William E. & Ervina C. Graham 5434 Temple City Boulevard, Temple City City Manager Woollett informed the Commission that this appli- cant had not submitted the requested revised plot plan and that he felt the matter should be carried forward. A motion was made by Commissioner Johnston that this matter be carried over to the next meeting and that Staff check into the situation. Motion seconded by Commissioner Briggs, and carried by the following roll call vote: AYES: Commissioners: Briggs, Clemson, Johnston, Beckley NOES: Commissioners: None ABSENT: Commissioners: Erickson S. PUBLIC HEARING: ZONE VARIANCE CASE NO. 64 -98 Louis E. & Rose Marie Allen 8057 Hermosa Drive, Temple City Chairman Beckley announced that now was the time and place for a public hearing. Verification of public notice and property posting was given by the secretary. City Manager Woollett was requested to present the factual data pertaining to the case. Applicant is requesting a variance to create a second parcel of less than the required area. Appearing in favor: Louis E. Alien, 8057 Hermosa Drive, owner - applicant. No one appeared in opposition. Motion seconded by Commissioner Johnston and carried by the following roll call vote: AYES: Commissioners: Briggs, Clemson, Johnston, Beckley NOES: Commissioners: None ABSENT: Commissioners: Erickson Discussion proceeded after a thorough review of the subject plot plan. It was the general feeling that we would not be justified in granting the creation of a Iot this small, that the subject parcel was not surrounded by lot splits, and that further time should not be taken on this matter. A motion was made by Commissioner Johnston that the City Attorney be instructed to draw a resolution denying this request for a variance. Motion seconded by Commissioner Briggs, and carried by the following roll call vote: AYES: Commissioners: Briggs, Clemson, Johnston, Beckley NOES: Commissioners: None ABSENT: Commissioners: Erickson At this point a general discussion ensued in regard to, whether or not we could set a definite limit on applications to be filed containing lots of less than the required area. It was suggested that this discussion be continued at the close of the meeting. 9. PUBLIC HEARING: ZONE VARIANCE CASE NO, 6499 Hayao or Grace Yoshimura 6151 Sultana, Temple City Chairman Beckley announced that now was the time and place for a public hearing. City Manager Woo l l ett was requested to present the factual data pertaining to the case. Applicant is requesting a variance to create a second parcel having the required area, but lacking the required street frontage. Appearing in favor: Grace Yoshimura, 6151 Sultana, owner- appli cant; Howard Imlay, 614E Rosemead, property owner directly behind the applicant's property. No one appeared in opposition. A motion was made by Commissioner Johnston that the public hear- ing be closed. Motion seconded by Commissioner Briggs, and carried by the following roll call vote: AYES: Commissioners: Briggs, Clemson, Johnston, Beckley NOES: Commissioners: None ABSENT: Commissioners: Erickson Discussion followed among members of the Commission. It was the general feeling that this application would be the best use of the land due to the fact that the existing house is at the back of the property, and the construction of a house on the front portion would better align this lot with the surrounding parcels. There was considerable discussion on driveway width, and it was the general consensus of opinion that the driveway should be widened as much as possible. It was also noted that there were lot splits on .both sides of the subject property. A motion was made by Commissioner Johnston that we instruct the City Attorney to draw a resolution granting this request for a variance with driveway width changed according to the plot plan. PUBLIC HEARING: ZONE VARIANCE CASE NO. 64 -100 Herman W. or Alice G. Frank 4932 Arden Drive, Temple City Chairman Beckley announced that now was the time and place for a public hearing. City Manager Woollett was requested to present the factual data pertaining to the case. Applicant is request- ing variance to create two additional parcels having the required area, but lacking the required street frontage. Appearing in favor: Louis Richardson, 14112 La Rica, Baldwin Park, representing the owner - applicant. Questions were directed to Mr. Richardson in regard to the 15 foot easement adjacent to the north side of the subject parcel. No one appeared in opposition. A motion was made by Commissioner Briggs that the public hearing be closed. Motion seconded by Commissioner Johnston, and carried by the following roll call vote: AYES: Commissioners: Briggs, Clemson, Johnston, Beckley NOES: Commissioners: None ABSENT: Commissioners: Erickson Discussion followed which consisted mainly of a further discus- sion of the 15 foot easement, its availability, condition, etc. Mr. Frank, owner of the subject property, appeared at this time and stated that the property was available for sale, and that he would purchase it if this was the only way in which the variance would be granted, however, he would prefer to keep his parcel as is. The 15 foot easement is presently covered by weeds, huge trees and an abandoned, filled -in well. The possi- bility of creating a cul -de -sac street was also discussed. City Manager Woollett brought to the attention of the Commission the fact that a proposal had been received concerning a possible use of the school site immediately adjoining the subject property that could materially affect consideration of this case. He suggested, for this reason, that we hold this matter over to the next meeting and that we ask the applicant to indicate to us by whatever necessary research is required which way the property would go or, in fact, had gone (meaning the easement). A motion was made by Commissioner Briggs that we reopen the public hearing. Motion seconded by Commissioner Johnston, and carried by the following roll call vote: AYES: Commissioners: Briggs, Clemson, Johnston, Beckley NOES: Commissioners: None ABSENT: Commissioners: Erickson After further discussion in regard to the matter of whether the applicant or the City should secure the additional information required on the easement, a motion was made by Chairman Beckley that this matter be held over to the next meeting and that the staff be of guidance to the applicant to insure that the necessary information is obtained. PUBLIC HEARING: ZONE VARIANCE CASE NO. 64 -113 Donald G. & Olive E. Roberts 4915 -19 Arden Drive, Temple City Chairman Beckley announced that now was the time and place for a public hearing. City Manager Woollett was requested to present the factual data pertaining to the case. Applicant is request- ing a variance to establish a third parcel having the required area, but lacking the required street frontage. Appearing in favor: Charles Gould, 10103 Lower Azusa Road, El Monte, representing the owner - applicant. Mr. Gould requested that this case be held over to the next meeting to allow the applicant time to submit a revised plot plan. A motion was made by Commissioner Johnston that this matter be carried over to the next meeting. PUBLIC HEARING: ZONE VARIANCE CASE NO. 64 -101 Joseph & Teresa Dingrando 4850 Glickman, Temple City Chairman Beckley announced that now was the time and place for a public hearing. City Manager Woollett was requested to present the factual data pertaining to the case. Applicant requesting a variance to establish a second parcel having the required area, but lacking the required street frontage. Appearing in favor: Louis Richardson, 14112 La Rica, Baldwin Park, representing Mrs. Dingrando, owner - applicant. No one appeared in opposition. A motion was made by Commissioner Johnston that the public hear- ing be closed. Motion seconded by Commissioner. Briggs, and carried by the following roll call vote: AYES: Commissioners: Briggs, Clemson, Johnston, Beckley NOES: Commissioners: None ABSENT: Commissioners: Erickson Discussion followed among members of the Commission in regard to the possible creation of a community driveway, size of lot, and the fact that only one house existed on the property at the present time. It was the general feeling that this request should be granted. A motion was made by Commissioner Johnston that the City Attor- ney be instructed to draw a resolution granting this variance based on the plot plan as presented. PUBLIC HEARING: ZONE VARIANCE CASE NO. 64 -127 First Baptist Church 5946 N. Rowland, Temple City Chairman Beckley announced that now was the time and place for a public hearing. City Manager Woollett was requested to present the factual data pertaining to the case. Applicant is requesting a variance to establish, operate and maintain additions to an existing church in the R -2 zone. Appearing in favor: Mr. Stewart, 1129 S. 9th, Arcadia, Chairman of Building Committee. Mr. Stewart explained the location and nature of the additions proposed and the parking situation. Discussion centered on the available parking and parking require- ments for this use. Planning Consultant Whitnall apprised the Commission that the ordinance stipulates one parking space for each four seats, or 22 inches of pew as representing the equiva- lent of one seat. He also explained that an existing establish- ment can be deficient on parking as a non - conforming use, and that it would not be necessary to bring the parking up to the requirements of the present ordinance. Only additional parking would be required to serve the additional buildings. Mr. Stewart stated that in addition to the property shown on the plot plan, the church also owns another parcel across the street on Baldwin. Kenneth Dunkleburger, Pastor of First Baptist Church, appeared before the Commission at this time to present further informa- tion in regard to use of present buildings and intended use of new buildings. Also appearing at this time was Mrs. James McLaughlin, owner of property immediately adjoining the church property. After further discussion, it was the general feeling of the Commission that they were not sure what the intended purpose of the variance was, and that they were in definite need of more facts before arriving at a decision. City Attorney Shatford indicated that there were two legal issues involved. First, Gordon Whitnall's opinion is that if they have a non - conforming use and add additional facilities, that you do not consider the non - conforming part. Second, from a factual legal standpoint, we do not have the facts to make a decision. These two issues need to be clarified. A motion was made by Commissioner Johnston that this matter be held over to Monday, June 3, at 7 :15 p.m. Motion seconded by Commissioner Briggs, and carried by the following roll call vote: AYES: Commissioners: Briggs, Clemson, Johnston, Beckley NOES: Commissioners: None ABSENT: Commissioners: Erickson 14. RESOLUTION NO. 64 -84: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING APPLICATION FOR A ZONE VARIANCE IN ZONE VARIANCE CASE NO. 64 -107 OF ROBERT E. GRAY PERTAINING TO THE REAL PROPERTY LOCATED AT 5021 CLOVERLY AVENUE, TEMPLE CITY, SUBJECT TO CERTAIN CONDITIONS. Title to Resolution No. 64 -34 was read by City Attorney Shatford, A motion was made by Commissioner Johnston that we waive further Planning Commission Minutes Page Seven June 1, 1964 reading and adopt. Motion seconded by Commissioner Clemson, and carried by the following roll call vote: AYES: Commissioners: Briggs, Clemson, Johnston, Beckley NOES: Commissioners: None ABSENT: Commissioners: Erickson 15. RESOLUTION NO. 64 -85: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING APPLICATION FOR A ZONE VARIANCE IN ZONE VARIANCE CASE NO. 64 -97 OF RICHARD F. WALTER PERTAINING TO THE REAL PROPERTY LOCATED AT 6161 N. ENCINITA AVENUE, TEMPLE CITY, SUBJECT TO CERTAIN CONDITIONS. Title to Resolution No. 64 -85 was read by City Attorney Shatford. A motion was made by Commissioner Briggs that we waive further reading and adopt. Motion seconded by Commissioner Clemson, and carried by the following roll call vote: AYES: Commissioners: Briggs, Clemson, Johnston, Beckley NOES: Commissioners: None ABSENT: Commissioners: Erickson 16. COMMUNICATIONS: a. City Attorney Shatford presented Resolution No. 63 -50PC and stated that the applicant had requested certain changes be made to the Resolution. Resolution will be amended to change the time referred to in Section 2, Item a, to 7 :00 a.m., rather than 7:30 a.m.; and Section 2, Item d, change to read wheeled equipment..,..," rather than "equipment." A motion was made by Commissioner Johnston that the resolu- tion be amended pursuant to the corrections mentioned above. Chairman Beckley asked City Attorney Shatford if it would be possible to get copies of the resolution prior to the meet- ing. City Attorney Shatford said that he would make every possible effort to prepare the resolution at an earlier date in the future. c. City Manager Woollett read a communication from the El Monte School District in regard to obtaining an appraisal on a school site located at 4949 Hallowell, Temple City. The School District needs approval of the Planning Commission before they can apply to the State for location of a school in this area. It was suggested that the staff prepare a letter in behalf of the Planning Commission. A motion was made by Commissioner Beckley that we instruct the Staff to prepare a document to be mailed to the El Monte School District indicating whether there are any known factors which would have a bearing on location of a school in this area. At this point, the discussion returned to the lot size problem previously started as a discussion matter in Item 8 of the minutes. The question raised was as to whether or not it was possible to make a decision in regard to acceptable lot sizes? City Manager tioollett stated that the staff would counsel with people when asked, and when it appears appro- priate, indicate what actions of the Commission or Council have been to help determine whatever technique the applicant should use. e. Lewis E. Allen, Case No, 64 -93, above, reappeared at this time and stated that he definitely felt that the City should provide some definite rules to set standards of limits for variances. 17. ADJOURNMENT: Commissioner Briggs moved to adjourn, seconded by Commissioner Johnston, and carried unanimously.
