HomeMy Public PortalAbout1995-10-13 Special Meeting (3)COUNCIL MINUTES SPECIAL MEETING - OCTOBER 13, 1995 A special meeting of the Bal Harbour Village Council was held on Friday. October 13. 1995. in the Council Chamber at Bal Harbour Village Hall. The meeting was called to order at 4:12 p.m. by Mayor Spiegel. The roll was called and those present were: Mayor Estelle Spiegel Assistant Mayor Matthew B. Blank Councilman James E. Boggess Councilman Sol M. Taplin Also present: Alfred J. Treppeda. Village Manager Jeanette Horton. Village Clerk Steven Zelkowitz. Representative of Village Attorney Absent: Councilman Andrew R. Hirschl As a quorum was determined to be present. the meeting commenced. 2. Discussion of Collins Avenue Project Phase 2: Mr. O'Leary addressed the Council and explained the work on Collins Avenue is progressing. He is very pleased with the work the contractor has been doing. very few problems have occurred. He then proceeded to explain the tasks that were done after the contract was awarded to Vila & Son. A number of additions and conflicts have arisen on the project. These items constitute additional work for Vila & Son Landscaping, which are as follows: 1. Add Eight Date Palms a) The Admiralty has a paved area that formerly housed a bus shelter. This shelter was removed years ago and it was requested by the Admiralty Management that the brick plaza be removed and replaced with an aggregate sidewalk and lawn area. This would allow the planting of two Date Palms that could not be planted previously. b) The Bal Harbour Shops requested that the Village re - space the Date Palms so they fall between their Seagrape trees. This tighter spacing meant the addition of three Date Palms as well as the removal of additional sidewalk area. cl The Bal Bridge South. in order to preserve one of their existing trees. requested that IUb the Village shift the Northern most Date Palm slightly to the North. This meant that this palm. which is the first one visible while traveling South. no longer aligned with a companion palm on the East side. Accordingly, it is recommended that one Date Palm be added on the East side in front of the Kenilworth House. d) The Fairfield Manor has a brick paved area that formerly was a seating area. It is recommended that this paving be removed. and two palms be re - spaced. and one Date Palm added in this area. In addition. a new aggregate sidewalk will be added as well as new lawn between sidewalk and curb. e) Due to what he perceived as a conflict with underground utilities. one Date Palm was eliminated from in front of the Sheraton Ba1 Harbour at the very beginning of the design. After conducting a test excavation it was determined that the utilities in question were abandoned. Therefore, it is his recommendation that the one missing Date palm be added in front of the Sheraton Bal Harbour. 2. Utility Conflicts As the contractor began to excavate the planting holes. conflicting utility lines were discovered. Some conflicts are as minor as re - routing a small irrigation line and some are as major as moving a 12" water 1ine. 3. Haulover Bridge As directed by the Village council. Mr. O'Leary met with Assistant Mayor Blank and based on their discussion the following work was recommended: al Add 85 linear feet of concrete curb. regrade, and add crushed gravel to the Northern most edge of the parking lot. This should eliminate the erosion of soil and gravel onto the parking lot. bl In order to alleviate a drainage problem along the Northwest corner. eliminate two parking stalls. remove the paving. regrade the area. and add lawn and landscaping. Special Council Meeting 10/13/95 c) Add new paving to alleviate the drainage problem at Mr. Looby's gate area. dl It was determined not to restore any of the existing asphalt. but due to the unevenness of the asphalt in this area. need to add a concrete border adjacent to the decorative pavers. 4. Vegetation on Private Property Property owners that have vegetation conflicting with the Date Palms have been contacted. All residents have been very cooperative and agreed to have trees either relocated or removed, at Bal harbour's expense. If these trees are not removed some Date Palms would have to be eliminated and therefore destroy the spacing in front of these buildings. 5. Decorative Sidewalk Based on his meeting with the Public Works Director. it was felt that certain areas of the decorative sidewalk that have been damaged over the years should be replaced. This would allow the Village to take advantage of the fact that the contractor will be doing this type of work on the project. Mr. O'Leary explained he has met with the contractor to discuss this additional work and has arrived at a cost estimate which is based on unit prices previously bid. as well as prices which were negotiated and appear to be reasonable. The cost estimated for change order number one is as follows: Eight Additional Date Palms. Pavement Removal and Restoration Utility Conflicts Haulover Bridge Vegetation on Private Property Decorative Pavement Restoration Additional Light Fixtures Purchase Total $42,12-.8- $11.531.60 S 7.666.00 $ 4.600.00 $ 1.715.20 } 7,191.68 S-4.832.05 Special Council Meeting 10/13/95 3 Mr. O'Leary further explained this change order would not include an additional 22 trees he would recommend. He then proceeded to explain where the additional 22 trees would be planted. The Manager of the Admiralty requested that the Council approve the removal of the paved area in front of his building, and replace it with an aggregate sidewalk and lawn. Assistant Mayor Blank recommended there should be on file inspection of all the area that are effected by the change request. He further stated he would like to tour the area that is affect by the change order. Councilman Taplin stated he would also like to tour the area. Councilman Boggess suggested approval subject to the tour taken by Assistant Mayor Blank and Councilman Taplin, and any problem the Village Manager can delete from the change order. Councilman Boggess withdrew his motion. The Bal Harbour Shops offered a golf cart for the tour and Mr. Treppeda will coordinate and notify Assistant Mayor Blank and Councilman Taplin. A motion was offered by Councilman Boggess and seconded by Mayor Spiegel to approve S150.000.00 for the additional trees and subject to the tour that will be taken by Assistant Mayor Blank and Councilman Taplin. The motion carried with the vote as follows: Mayor Spiegel aye; Assistant Mayor Blank aye; Councilman Boggess aye. Councilman Hirschl absent: Councilman Taplin aye. Mr. O'Leary advised the Council that the shields are in and requested a lighting demonstration be held on Tuesday evening. October l7th. He further advised that Mr. Treppeda will coordinate the time with the Council. 3. Executive Session: The purpose of this session is to discuss the litigation of Case Number 04-00623 Village of Bal Harbour v City of North Miami. The following people were in attendance: Mayor Estelle Spiegel Assistant Mayor Matthew B. Blank Councilman James E. Boggess Councilman Sol M. Taplin Alfred J. Treppeda, Village Manager Gerald Richman, Attorney Floyd Pearson Richman Greer et al At this time the Executive Session commenced and the Village Clerk left the meeting. Mayor Spiegel reconvened the Special Meeting of the Bal Harbour Village Council at 5:45 p.m.. The roll was called and those Special Council Meeting 10/13/95 4 Mr. O'Leary further explained this change order would not include an additional 22 trees he would recommend. Mr. Treppeda explained that at the end of fiscal year 1994/95 the projected balance is $3.901.383, of which $1,609.596 is unappropriated. Reserved is S1,000,000 for Beach Renourishment and $1.291,787 for Phase iI Landscaping Project. 5. Adjourn: There being no further business to come before the Council. a motion was offered by Councilman Boggess and seconded by Councilman Taplin to adjourn.
