GOV BOARD OF HEALTH MEETING WEDNESDAY JUNE 5 , 2019 AT 7 : OOPM TOWN HALL, ROOM A Board members present : Carmen Scherzo, DVM, Chairman; Annette Graczewski , MT (ASCP), Vice Chairman ; Joe Ford ; Penny Hausser Holeman, MPH , MA , MS and Lucas Dinwiddie Others present : Nancy Ellis Ice , CHO , RS , MPH, Health Director and Tammi Mason , Senior Department Assistant 1 . Chairman ' s announcements The Board of Health has changed the dates that dogs are allowed on beaches . Dogs will be prohibited from May 15t11 through September 15t" . Congratulations to Joe Ford , Penny Hausser Holeman and Lucas Dinwiddie for being re-elected/elected to the Board of Health . The Town of Brewster has openings on a number of committees . For more information, consult the Town website . Talked about recusing yourself from a discussion (explained how to do it) . Only necessary when there is a personal conflict. 2 . Re- organization of the Board Joe Ford read a statement with regards to the Chairman position and thanked Dr . Scherzo for his time as Chairman . Mr. Dinwiddie asked about new members voting at their first meeting. Ms . Hausser Holeman thanked Dr. Scherzo for his service on the Board and stated that she would like to see him stay on as Chairman . Motion : Nominate Annette Graczewski as Chairman Motion : Joe Ford Second : Lucas Dinwiddie Vote : 3 -2 -0 Action : Motion carried Mr. Ford asked that Dr. Scherzo continue on as Chairman for this meeting . Motion : Nominate Carmen Scherzo as Vice Chairman Motion : Annette Graczewski Second : Joe Ford Vote : 5 -0- 0 Action : Motion carried Motion : All the committee members will remain the same with Ms . Hausser Holeman on the Recycling Commission, Mrs . Graczewski on the WQRC and Dr. Scherzo on the Dog Park Development Committee . Motion : Joe Ford Second : Annette Graczewski Vote : 5 -0-0 Action : Motion carried 3 . Gabrielle Sakolsky — update on mosquito control Ms . Sakolsky was present to give an update on mosquito control . Anyone can contact them and they would send a crew to the property . There were twice the number of positives for West Nile Virus then last year. As for EEE-the species that carries this is still large . There were positives last fall . Asian Tiger Mosquitos are aggressive daytime biters . This is a potential vector for Zika. Mr. Dinwiddie asked if the start date was the same every year . Ms . Dan Speakman Construction — State variance request for 15 Pine View Drive David Mason, RS designed the plan . It is a repair of an existing failed system . They are requesting a variance to allow the SAS to be more than 3 ' fi•om the final grade as shown on the septic plan . Mr . Mason stated that he was unable to reduce the grade . This system will have a vent and they will keep the existing septic tank which is working fine . Mrs . Graczewski asked about a second tank . Mr. Mason stated there would not be a second tank Dr. Scherzo asked about a geo grid . David Mason stated yes . Ms . Hausser Holeman asked about wells on abutting properties . Mr. Mason stated that all the wells were shown on plan . Motion : Finding this system will have a vent and will be an improvement over what is currently there, approve the variance as requested . Motion : Joe Ford Second : Annette Graczewski Vote : 5 -0-0 Action : Motion carried 5. Ryder & Wilcox — State and Local variance request for 26 Wampum Drive Stephanie Sequin was present. This is a 28 , 600sf lot. It has a mixed use 2 story building on property from 1995 . There is a wetland (which is technically a drainage ditch) which is mostly dry . Most of property is within 100 foot buffer to the drainage ditch. The new owner would like to move her bakery into this location . It would be a bakery with limited food service . There are no washable items , the ware is all paper products . For zoning reasons , it is considered a bakery/limited food service which title 5 states is a fast food restaurant. The flow would be for 20 seats or 480 gallon per day flow . A grease trap will installed . Mrs . , Ice spoke about 2 other variances that would be needed . (# ' s 2 & 3 ) The following variances are being requested : 1 . To allow the proposed SAS system to be 87 ' fi•om a wetland 2 . To allow the proposed reserve area to be 77 ' from a wetland 3 . To allow an increased design flow for a commercial use in an Environmentally Sensitive Area 4 . To allow the proposed SAS to be 41 " below finished grade 5 . To allow a design flow of 480 gpd Conservation Commission has already approved this . Dr . Scherzo stated that the water is flowing away from the ditch . Sarah Wilson— variance request for 382 Satucket Road (Leaching Facility Setback regulation) Sarah Wilson, Trustee of property was present. Jim Wilson also present. This system consists of a 1500 gallon tank, a d-box (which needs to be replaced) and 2 leach pits . The leaching pits are 157 feet from the pond . The system is high above the bluff with no real place to move it. One way would be closer to the well and the other way would be in the woods, with hills . The system is functioning properly . The owners may put it up for sale but are not sure as of yet . The groundwater flow is up gradient of pond . The septic system is draining towards pond . The system was installed in 1985 . Mr. Ford, Mrs . Graczewski and Ms . Hausser Holeman would all like to see the system upgraded . BOH 6/5/ 19 Minutes Page 3 Mr . Dinwiddie asked if the system could go back in the same spot , Dr . Scherzo stated that it would be better to move it. Motion : Deny the variance request to keep the existing leaching facility in its current place . Motion : Joe Ford Second : Annette Graczewski Vote : 5 -0-0 Action : Motion carried 7. Guapo ' s Shore Shack — variance from Federal Food Code Kyle Parker was present. He explained to the Board that he had a flood and was in the process of rebuilding. He wants to gain space in the interior and would like to put the walk in cooler outside . Mrs . Ice stated that in re400king at the food code , it wouldn ' t be a variance . What they are looking for is just BOH approval to put the walk in outside . Mrs . Graczewski has no concerns with this plan . Motion : Allow the walk in cooler to be outside . Motion : Joe Ford Second : Penny Hausser Holeman Vote : 5 -0-0 Action : Motion carried 8 . Chester Robinson — variance request for 224 W. H. Besse Cartway (Leaching Faeility Setback regulation) Chester Robinson, owner was present. This system is from 1995 and is in good working condition, it is not in zone II and he believes it would not be economically feasible to move back any further. Mrs . Graczewski mentioned that this did come before the Board for sub division approval . During that meeting, the engineer had stated that there would be room to move the system outside of 300 feet. This is a seasonal house that is not insulated, with an outdoor shower. There is not a lot of water usage there . Groundwater does flow towards pond . Mr. Ford recused himself from this request. Motion : Finding that the engineer stated that the system had room to be moved, deny the variance . Motion : Annette Graczewski Second : Penny Hausser Holeman Vote : 4-0 -0 Action : Motion carried 9. Richard Hatfield — variance request for 55 Cahoon Road (Leaching Facility Setback Regulation) Richard Hatfield, owner and Tony Catallene , Realtor were present. This is a year round home with a functioning septic system that was installed in 2005 . The leaching is as far away as possible . Motion : Finding that this system was installed in 2005 and is in good working condition and is as far away as possible from the pond, approve the variance as requested . Motion : Annette Graczewski Second : Penny Hausser Holeman Vote : 5 -0-0 Action : Motion carried 10. Discuss the addition of a " Citizens forum " to the Board meetings Dr. Scherzo thinks this would give the citizens direct access to the board . Mr . Dinwiddie also thinks it would be a good idea . Motion : Add Citizens Forum to the work meeting at the end of the agenda , unless there are no residents present for hearings . If this is the case then it can be moved up to the beginning of the meeting. There will be a 3 minute time limit BOH 6/5/ 19 Minutes Page 4 and the citizen will be told that the Board cannot address what the citizen is bringing up at that time . Let the Select Board liaison know so that she can let the rest of the Board know . Motion : Joe Ford Second : Annette Graczewski Vote : 5 -0-0 Action : Motion carried 11 . Topics the Chairman did not anticipate There will be 1 meeting in July on the 171x' . Informational items were noted. Meeting adjourned at 8 : 30PM
