Board members present: Annette Graczewski , MT (ASCP) , Chairman ; Carmen Scherzo , DVM , Vice Chairman ; Joe Ford
and Lucas Dinwiddie
Board members absent: Penny Holeman , MPH , MA , MS
Others present: Nancy Ellis Ice , CHO , RS , MPH , Health Director and Tammi Mason , Senior Department Assistant
1 . Chairman 's announcements
There was talk about moving Citizen ' s forum to the beginning of the meeting .
Motion : Move citizen ' s forum to the beginning of the meeting .
Motion : Joe Ford Second : Carmen Scherzo
Mr. Ford withdrew the motion .
Mrs . Graczewski asked if the Board would be willing to move item # 10 to the beginning of the agenda .
Motion : Joe Ford Second : Lucas Dinwiddie Vote : 4- O-O Action : Motion carried
10 . Health Director Discussion & possible vote
Mrs . Graczewski gave the Board some information on this process and asked if there were any citizen ' s that wished to
speak about this .
Colette Williams , resident , spoke in favor of Sherrie McCullough
Stephen Freiner, resident, spoke in favor of Sherrie McCullough
Emily Sumner, resident , spoke in favor of Sherrie McCullough
Dr. Scherzo gave a brief statement about his opinion regarding both candidates and then stated his full support was with
Amy von Hone .
Mr. Ford read a section from the Select Board 's policy regarding hiring from within . He then stated his opinion about both
candidates and then stated his full support was with Sherrie McCullough .
Mr. Dinwiddie stated his opinion about both candidates and then stated his full support was with Amy von Hone .
Mrs . Graczewski state her opinion about both candidates and then stated her full support was with Amy von Hone .
Motion : Appoint Amy von Hone as the new Health Director subject to negotiations and a background check .
Motion : Lucas Dinwiddie Second : Carmen Scherzo Vote : 3 - 1 - 0 Action : Motion carried
Mrs . Graczewski asked for a second vote .
Mr. Dinwiddie , Dr . Scherzo and Mrs . Graczewski voted in favor of Amy von Hone and Joe Ford voted in favor of Sherrie
McCullough .

2 . Victory Staley, Building Commissioner - meet and greet with the Board of Health
Mr. Staley came to the Board to introduce himself and explain what his role was . He spoke about new language in the
building code that has to do with septic systems and building permits . Dr. Scherzo asked him to speak about the WQRC .
Mr. Staley spoke about who was on the committee and what it was that they do .
3 . Ocean Edge - Food Establishment permit application
Philip Flath , Executive Chef was present . He explained that they would like to have a cart at the front desk area to have
coffee and pastries for their clients . Currently there is no name for this .
Motion : Approve the cart pending all of the Assistant Health Director' s recommendations are met.
Motion : Joe Ford Second : Lucas Dinwiddie Vote : 4- 0 -0 Action : Motion carried
4 . Horsley Witten Group - update on Kings Landing Wastewater Treatment Facility
The owner and operator could not attend so this will be placed on the August 71h agenda .
5 . J . M . O ' Reilly & Associates - update on White Rock Commons Wastewater Treatment Facility
John O ' Reilly was present. He noted that tweaks made to system have been working and it seems to be functioning
better . There are only 9 homes hooked up to it currently . It is not fully occupied yet.
The Board asked that he come back again in 6 months for another update .
6 . Punkhorn Services - Title 5 variance request for 153 Brier Lane
Terry Hayes , RS was present. He is requesting to use a sieve analysis in lieu of a perc test.
Mrs . Ice stated that technically this is not a variance , it is allowed under Title 5 .
Motion : Approve the use of a sieve analysis in lieu of a perc test.
Motion : Joe Ford Second : Lucas Dinwiddie Vote : 4-0-0 Action : Motion carried
7 . J . M . O ' Reilly & Associates - local variance requests for 425 Crowell 's Bog Road
John O' Reilly , Engineer was present. This is a cottage with a cesspool . They would like to put a new Title 5 in but it would
be closer than 300 feet to the pond . The lot is 93 , OOOsf. The separation to groundwater is over 20 feet. They are
requesting a variance to allow the proposed SAS to be 178 ' from Sheep' s Pond and the reserve are to be 191 ' from
Sheep' s pond . The pond water travels towards Crowell Is Bog Road . The effluent won ' t run towards sheep pond .
They will be adding a 4'h bedroom . Mrs . Graczewski asked how far away the cranberry bog across the street was . Mr.
O ' Reilly state that it is170 feet from Crowell ' s Bog Road .
Motion : Finding that groundwater is flowing away from Sheep ' s Pond and this will be an improvement over what it there
currently , approve the variances requested .
Motion : Joe Ford Second : Lucas Dinwiddie Vote : 4-0 -0 Action : Motion carried
9 . APT - Food Establishment Permit application
The owner/operator was not present. Mr. Ford questioned why this was coming to board . Mrs . Ice stated that even
though the Coffee Shop is licensed , this really is a separate restaurant .
Mrs . Graczewski spoke about " Kimchi " cooking and asked if it requires a HACCP plan . She would like Mrs . Ice to follow
up on this .

Motion : Approve the Food Establishment permit pending all of the Assistant Health Director' s recommendations are done
and Mrs . Ice will check on whether or not the " Kimchi " cooking needs a HACCP plan .
Motion : Lucas Dinwiddie Second : Joe Ford Vote : 4 -0- 0 Action : Motion carried
'The operator showed up late and Mrs . Graczewski told her that she need to do a HACCP plan and submit it for the
Boards approval . The Board gave her 2 weeks to get the plan in
11 . Discussion on the draft Marijuana regulations
The Board tabled this previously but now there are places moving towards opening so Mrs . Graczewski asked that this
come back before the board to look at again . She spoke a lot about the THC part of the Marijuana regulations
Mrs . Ice stated that Sherrie McCullough is part of a group that is looking into this and is not sure what will come of it.
Motion : Continue this discussion until the new Health Director gets situated .
Motion : Joe Ford Second : Lucas Dinwiddie Vote : 4- 0 - 0 Action : Motion carried
Mrs . Ice suggested that Town Counsel review the proposed regulations again .
12 . Topics the Chairman did not anticipate
Dr. Scherzo asked that the citizen ' s forum be put on one of the next agendas to discuss .
