City of Temple City
May 11, 1965
1. regular meeting of the Planning Commission of the City of
Temple City was held in the City Hall, 5938 Kauffman Avenue,
Temple City, California. The meeting was called to order by
Chairman Beckley at 7 :30 P.M.
2. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance to the Flag was
led by Chairman Beckley.
3. ROLL CALL: Present: Commissioners: Briggs, Clemson, Garvin,
Johnston, Beckley
Absent: Commissioners: None
Also Present: Woollett, R. Cushman, G. Whitnall,
Robert Flandrick, Asst. City Attorney
APPROVAL OF MINUTES: A motion was made by Commissioner Clemson
that the minutes of April 19, 1965, be approved as written.
Motion seconded by Commissioner Briggs and carried by the follow-
ing" roll call vote:
EYES: Commissioners: Briggs, Clemson, Garvin, Johnston
NOES: Commissioners: None
ABSTAIN :Commissioners: Beckley, due to absence at meeting
ABSENT: Commissioners: None
A motion was made by Commissioner Briggs that the Special Meet-
ing Minutes of May t•, '1965, be approved as written. Motion
seconded by Commissioner Clemson and carried by the following
roll call vote:
AYES: Commissioners: Briggs, Clemson, Garvin, Johnston,
Beckley
NOES: Commissioners; None
ABSENT: Commissioners: None
A motion was made by. Commissioner Johnston that the Special Meet-
ing Minutes of May 6, 1965, be approved as corrected per para-
graph three, line seven to read "deleted" instead of delayed.
Motion seconded by Commissioner Clemson and carried by the follow-
ing roll call vote:

A motion was made by Commissioner Briggs that the Adjourned Meet-
ing Minutes of May 10, 1965, be approved as corrected per page
two, paragraph one, to insert 10 It was moved by Commissioner
Briggs, seconded by Commissioner Clemson" that the Commission take
the first step to recommend to the City Council the repeal of
Ordinances 63 -103 and 63-104. Motion seconded by Commissioner
Clemson and carried by the following roll call vote:

5. PUBLIC HEARING: PRE ONING CASE NO. 1

Chairman Beckley announced that now was the time and place for
the public hearing. Verification of public notice and property
posting was given by tha secretary. Planning Director Cushman
presented the original application. The Chairman ordered same
marked Exhibit "A" and made a part of the record. The Planning
Director then orally presented factual data pertaining to the
case and his written report, substantially as given orally was
received in evidence by Chairman Beckley, marked Exhibit 'B ".
The maps placed for public and Planning Commission view were
ordered marked Exhibit "C" and received in evidence. The maps
were then viewed by the Commission.
Appearing in favor: Mr. B.B. Bender, et al., 1114 Rancho Road,
Arcadia, applicant and spokesman for 11 property owners in-
volved. Mr. Bender submitted a letter to the Commission stating
that zoning and annexation of this property will serve useful
purposes and aid in orderly development, harmonious to good
planning and that their intention is to market the entire parcel
as a single unit, with a major restaurant chain and retail
grocery operations as a possibility.
No one appeared in opposition.
Discussion was held regarding the letter and mentioned agreement
Mr. Bender stated that the agreement will not become effective
until annexation and zoning of the area is approved.
City Attorney Flandrick read the 2nd paracraph of the agreement
which is concerned with the Planning Commission stating that
"the owners agree that we will agree to offers to sell said
6 parcels as a unit for a period of 6 months from and after the
data that the proper approval is made for the commercial zoning
and that said owners shall not sell property separately but as
a single unit."
Commissioner Johnston asked if an appraisal had been made on
the property and if the owners had agreed to a fair market
value. Mr. Bender stated that this had been done and that the
owners had agreed to a fair market value.
Mr. Whitnall stated that if the classified area is zoned C-2,
the next step would be activate the potential to controlling;
the classification and require a "site development plan." ai'ar.
Whitnall stated that a "site development plan" cou l d be wored
out before annexation because pre zoning is not effective until
if comes under the jurisdiction of the City and that either
could be done such as zoning outright or potential, then depend
upon the "site development plan: being brought into the City
for review.
Appearing in favor: Mr. Robert C. Davidson, 807 Bank Street,
South Pasadena, Associate in the purchase of one of the subject
properties. Mr. Davidson stated that the property was acquired
in October of 1964 and the escrow was closed in early 1965.
Mr. Davidson also stated that they want to cooperate fully with
the Planning Commission and are open to any suggestions which
the Commission might have.
Also appearing in favor: Mr.B.B. Bender, at al., 1114 Rancho
Road, Arcadia, applicant and spokesman for 11 property owners.
Mr. Bender stated that if this request is approved by the Plann-
ing Commission the large restaurant chain will be contacted
again and that they do intend to develop this property as one
large unit.

After hearing a l l those desiring to speak a motion was mad by
Commissioner Brigs that the public hearing be closed. i\iotion
seconded by Commissioner Clemson and carried by the following
roll call vote:

motion was made by Commissioner Briggs that the City Attorney
be instructed to draw a resolution pre zoning the subject prop-
erty to a potential C -2 in anticipation of possible annexation
to the City of Temple City on the basis that the area is ideal
for C -2 and thins mentioned are needed to service the area
and would be best f i c i a 1 to the community as well as to tha City
and that the potential C -2 would give the croup bargaining
power they desire and still protect the City from individual
lot development. Motion seconded by Commissioner Garvin also
for the above stated reasons.
Discussion was held regarding the basic zoning to be approved
along with the potential zoning.
A motion was made by Commissioner Briggs that the motion be
amended with the basic zoning being R -1. Notion seconded by
Commissioner Garvin and carried by the following roll call vote:

6. DISCUSSION AND RECOMMENDATION PROPOSED ORDINANCE NO. 65 -158:
This item was removed from the agenda in order that the Comm-
ission would have more time to review the ordinance and will
be placed on the agenda for the next regular meeting May 25th.
LONE VARIANCE CASE NO. 65 -149
First Baptist Church
5946 North Rowland, Temple City
Planning Director Cushman read a letter from the 1st Baptist
Church directed to the Planning Commission stating that the
Church withdraws its application in -.one Variance Case No. 65-
149PC to establish, operate and maintain a parking lot, having
a minimum of 26 parking spaces for the 1st Baptist Church, and
therefore closing the case.

A motion was made by Commissioner Johnston that the Planning
Commission accept the letter of withdrawal from the 1st Baptist
Church and that tha case hereby be closed. Motion seconded by

10. COMMUNICATIONS
a. Discussion was held on the setting of a Public Hearing for
the purpose of formalizing Ordinance 65 -151 and Ordinance
65 -153 by reference incorporating these ordinances into the
'Zoning Ordinance.
A motion was made by Commissioner Johnston that the Planning
Commission recommend to the City Council the exclusion of
Section 701 sub paragraph 8 (1) and Sections 1600 and 1601
to exclude any comment by reference or adoption by reference
Ordinances 65 -151 and 65 -153. Motion seconded by Comm.
issioner Clemson and carried by the following roll call vote:

b. The requested Time Extensions on T._one Variance Cases No.

A motion was made by Commissioner Clemson that the Commissiq'
acknowledge receipt of these requests from Marty Di Gorgio
Zone Variance Case No. 64 -79 and William 1 . Dennis, Zone
Variance Case No. 64 -92. Motion seconded by Commissioner
Briggs and carried by the following roll call vote:

RECESS: A motion was made by Commissioner Clemson that the
