APPROVAL OF MINUTES: A motion was made by Commissioner Garvin that the minutes be approved with the following corrections :, "Page 1 bottom portion "After hearing all those desiring to speak a motion was made by Commissioner Briggs and seconded by Comm- issioner Garvin; Page 3 motion above item No. 7 a motion was made by Commissioner Beckley; Page 4, paragraph 5 that a site develop- ment plan be required instead of presented and Page 7 item No. 10 a motion to adjourn by Commissioner Beckley, seconded by Comm- issioner Clemson. Motion seconded by Commissioner Briggs that the minutes be approved as corrected and carried by the following roll call vote: AYES: Commissioners: Beckley, Briggs, Garvin, Johnston NOES: Commissioners: None ABSENT :Commissioners: Clemson 5. PUBLIC HEARING: (continued from June 8, 1965) ZONE VARIANCE CASE NO, 65 -158 Baldwin Builders, Inc. 4116 North Baldwin Avenue El Monte, California Chairman Johnston announced that now was the time and place for continuing the public •hearing.Planning Director Cushman received the case as heard June 8th and commented on the proposed sign elevations. The exhibits placed for public and Planning Commiss- ion view was ordered marked Exhibit "C" and received in evidence. The exhibits were then viewed by the Commission. Appearing in favor: Mr. James Baldwin, applicant, 5559 Pal Mal Avenue, Temple City. Mr. Baldwin stated that he feels there is an adequate justification for the request of an enlarged sign because of the unique problem on the size and type of project being undertaken in reference to the Condominium. Questions were directed to Mr. Baldwin by the Commission regarding the height of the building being constructed which is approximately 28 feet' `f from the ground level. No one appeared in opposition. After hearing all those desiring to speak a motion was made by ,,r Commissioner Beckley that the public hearing be closed. Motion seconded by Commissioner Garvin and carried by the following roll call vote: AYES: Commissioners: Beckley, Briggs, Garvin, Johnston NOES: Commissioners: None ABSENT:Commissioners: Clemson Planning Commission Minutes Page Two June 22, 1965 A motion was made by Commissioner Beckley that the City Attorney be instructed to draw a resolution granting this variance on the plot plan as shown, for the real estate office location; that the 2 signs be approved with the exception that the sign on Temple City Boulevard be 8 x 10 and the sign on Broadway be reduced to 64 square feet because it is a residential area and these signs will give maximum advertising and will be more in line with the City approach; that the time limitation on this variance be one year from the adoption of the resolution or 15 days after the sale of the last unit, whichever occurs first and that the Comm- ission may, upon good cause shown by the applicant, extend the time limitation 6 months to a year; that the sales office be used only for the purpose of sales relating to the Temple Town House, the staff to review the lighting, that the bottom sign face be not less than 12 feet above finish grade. This motion died due to a lack of a second. A motion was made by Commissioner Garvin that the City Attorney be instructed to draw a resolution granting this variance as stated with restrictions that the double faced signs be limited to 50 square feet in accordance with the Zoning Ordinance Reg- ulations. Motion seconded by Commissioner Briggs and carried by the following roll call vote: AYES: Commissioners: Briggs, Garvin NOES: Commissioners: Beckley ABSENT: Commissioners: Clemson Assistant City Attorney Flandrick reviewed the conditions and presented the proposed resolution. RESOLUTION NO. 65- 157PC: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING A VARIANCE IN ZONE VARIANCE CASE NO. 65 ®158. Title to Resolution No. 65 -157PC was read by Assistant City Attorney Flandrick. A motion was made by Commissioner Briggs to waive further read- ing and adopt. Motion seconded by Commissioner Garvin and carr- ied by the following roll call vote: AYES: Commissioners: Beckley, Briggs, Garvin NOES: Commissioners: None ABSENT: Commissioners: Clemson ABSTAIN :Commissioners: Johnston 6. PUBLIC HEARING: ZONE VARIANCE CASE NO. 65 -156PC Louise Bracken 4857 Glickman Avenue Temple City, California Chairman Johnston announced that now was the time and place for the public hearing. Verification of public notice was given by the Secretary. Planning Director Cushman presented the original application. The Chairman ordered same marked Exhibit "A" and made a part of the record. The Planning Director then orally presented factual data pertaining to the case and his written report, substantially as given orally, was received in evidence by Chairman Johnston, marked Exhibit ''B ". The maps placed for public and Planning Commission view were ordered marked Exhibit "C" and received in evidence. The Exhibits were then viewed by the Commission. Planning Commission Minutes Page Three June 22, 1965 Appearing in favor: Jay Stringham, Valley Craft Construction, Inc., 10523 Lower Azusa Road, Temple City, representing the owner and applicant Mrs. Bracken. Mr. Stringham stated that he would like to have a 20.x 20 detached carport on the existing parcel for now since'the existing dwelling will probably be removed in the next 2 to 5 years and a new garage built in conj- unction with the new house; that he feels this request will not be detrimental to the surrounding area. No one appeared in opposition. After hearing all those desiring to speak a motion was made by Commissioner Briggs that the public hearing be closed. Motion seconded by Commissioner Garvin and carried by the following roll call vote: AYES: Commissioners: Beckley, Briggs, Garvin, Johnston NOES: Commissioners: None ABSENT: Commissioners: Clemson A motion was made by Commissioner Briggs that the City Attorney be instructed to draw a resolution granting this variance based on the fact that to deny it would be to deny a privilege enjoyed by others in the area and that the proposed carport be approved as shown on plot plan, Exhibit "A ". Motion seconded by Comm- issioner Beckley and carried by the following roll call vote: AYES: Commissioners: Beckley, Briggs, Johnston NOES: Commissioners: Garvin ABSENT: Commissioners: Clemson Assistant City Attorney Flandrick reviewed the conditions and presented the proposed resolution. RESOLUTION NO. 65- 158PC: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING A VARIANCE IN ZONE VARIANCE CASE NO. 65 -156. Title to Resolution No. 65 -158PC was read by Assistant City Attorney Flandrick. A motion was, made by Commissioner Beckley to waive further read- ing and adopt. Motion seconded by Commissioner Briggs and carr- ied by the following roll call vote: AYES: Commissioners: Beckley, Briggs, Johnston NOES: Commissioners: Garvin ABSENT: Commissioners: Clemson 7. PUBLIC HEARING: ZONE VARIANCE CASE NO. 65 -157 Norman E. Knight 5248 Sereno Drive Temple City, California Chairman Johnston announced that now was the time and place for the public hearing. Verification of public notice was given by the Secretary. Planning Director Cushman presented the original application. The Chairman ordered same marked Exhibit "A" and made a part of the record. The Planning Director then orally presented factual data pertaining to the case and his written report, substantially as given orally, was received in evidence by the Chairman, marked Exhibit "B ". Planning Commission Minutes Page Four June 22, 1965 Appearing in favor: Mr. Norman E. Knight, 5248 Sereno Drive, Temple City, owner- applicant. Mr. Knight stated that he pur- chased the property about one year ago and would like the re- quested time extension to complete the re- organization of the business, that the manufacturing building is hidden from view of the street, that they have maintained the restrictions placed upon them regarding the hours of operation being 8 :00 to 5 :00. Clarification was given on the dates of the 2 year time extension request. Planning Director Cushman stated that the 2 year time extension would be from September 3, 1965 to September 3, 1967. Appearing in opposition: William LaPalia, 6121 Prospero Drive, Glendora. Mr. LaPalia presented a notarized letter from Mr. and Mrs. Clyde Davis, 5234 Sereno Drive, Temple City, expressing their reasons why they feel this variance should not be granted, among those being that the work has been done on Saturdays and Sundays and sometimes until 7 :00 P.M.; that the existing build- ing for manufacturing purposes is a fire hazard and too close to the property line. Also appearing in opposition were the following: Mr. Glade Tolman, 5114 Sereno Drive, Temple City. Mr. Tolman stated that the public hearing should be discontinued until the next meet- ing of the Planning Commi ss i on saE= that the property owners out- side of the 300 foot radius could; be so notified and could attend the hearing and that he opposed to the Commission granting this request for a time extension. Mrs. Henry Noelte, 5231 Sereno Drive, Temple City. Mrs. Noelte stated that the hours approved in the previous variance case have not been respected, trucks load and unload before 8:00 A.M.; that the variance was granted strictly to the Frickers and non - transferable; the people in the area are opposed to the manufacturing and to the continuance of this variance. Mrs. J. Dutton, 5126 Sereno Drive, Temple City, Mrs. Dutton stated that she objects to the variance and also believed the previous variance was granted only to the Frickers and non- transerable. Mrs. Erma Tolman, 5114 Sereno Drive, Temple City. Mrs. Tolman stated that along with her husband who had previously sopken, she is against the granting of this variance. Mr. Edwin Kiefer, 4905 North Baldwin Avenue, Temple City. Mr. Kiefer also spole against the granting of this var- iance. Mr. Glade Tolman, 5114 Sereno Drive, Temple City. Mr. Tolman stated that the variance requested and approved was for a three year time limitation and believed non - transferable and that the hours of operation have not been complied with. Appearing in favor: Mr. Norman E. Knight, 5248 Sereno Drive, Temple City, owner - applicant. Mr. Norman Knight stated that no violation of the hours has occured and no Saturday and Sunday work has been done. Trucks do, on occassion, load in the early morning, but the noise is at a very minimum. He also stated that he was the manager for the Frickers when they applied for the previous variance and that he was aware of the time stip- ulation as a condition of variance. After hearing all those desiring to speak a motion was made by Commissioner Beckley that the public hearing be closed. Motion seconded by Commissioner Garvin and carried by the following roll call vote: AYES: Commissioners: Beckley, Briggs, Garvin, Johnston NOES: Commissioners: None ABSENT: Commissioners: Clemson Planning Commission Minutes Page Five June 229 1965 Discussion was held among the Commissioners regarding the time limitation and the surrounding neighborhood in conjunction with the manufacturing of greenhouses. A motion was made by Commissioner Garvin that the City Attorney be instructed to draw a resolution denying this variance and that Mr. Knight comply with the 3 year time limitation granted in the previous zone variance case by relocating the greenhouse manufacturing by September 3, 1965 and noted that facts required by Section 1802 of the Temple City Zoning Ordinance were not present. Motion seconded by Commissioner Briggs and carried by the following roll call vote: AYES: Commissioners: Beckley, Briggs, Garvin, Johnston NOES: Commissioners: None ABSENT: Commissioners: Clemson Assistant City Attorney Flandrick reviewed the conditions and presented the proposed resolution. RESOLUTION NO. 65- 159PC: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DENYING A VARIANCE IN ZONE VARIANCE CASE NO. 65 -157. Title to Resolution No. 65 -159PC was read by Assistant City Attorney Flandrick. A motion was made by Commissioner Briggs to waive further read- ing and adopt. Motion seconded by Commissioner Garvin and carr- ied by the following roll call vote: AYES: Commissioners: Beckley, Briggs, Garvin, Johnston NOES: Commissioners: None ABSENT: Commissioners: Clemson 8. PUBLIC HEARING: ZONE VARIANCE CASE NO. 65 -159 Richard K. & Samuel L. Haley 1033 Park Avenue South Pasadena, California Chairman Johnston announced that now was the time and place for the public hearing. Verification of public notice was given by the Secretary. Planning Director Cushman presented the original application. The Chairman ordered same marked Exhibit "A" and made a part of the record. The Planning Director then orally presented factual data pertaining to the case and his written report, substantially as given orally, was received in evidence by the Chairman, marked Exhibit "B ". The maps placed for public and Planning Commission view were ordered marked Exhibit "C" and received in evidence. The exhibits were then viewed by the Commission. Appearing in favor: Samuel L. Haley, owner - applicant, 1033 Park Avenue, South Pasadena. Mr, Haley stated that all existing dwellings, in the rear of the property, will be removed. The only dwelling that will remain is the story and a half front house, fronting on Baldwin Avenue. The house will be remodeled and have further landscaping done. Discussion was held regarding the front lot line, due to the fact that the dwellings were not shown on the plot plan. Assistant City Attorney Flandrick stated that the front lot line designation could be made as a condition of the variance. Planning Commission Minutes Page Six June 22, 1965 Appearing in opposition: Mr. Edwin Kiefer, 4905 North Baldwin Avenue, Temple City. Mr. Kiefer stated that they have lived in their home for seven years. He also stated that he is against the small parcelling in the area and would like the zone changed to R -3 as proposed so that _single small parcellings would be kept at a minimum. After hearing all those desiring to speak a motion was made by Commissioner Garvin that the public hearing be closed. Motion seconded by Commissioner Beckley and carried by the following roll call vote: AYES: Commissioners: Beckley, Briggs, Garvin, Johnston NOES: Commissioners: None ABSENT: Commissioners: Clemson A motion was made by Commissioner Beckley that we instruct the City Attorney to draw a resolution granting this variance based on the fact that the driveway is more than the normal request, that it is a lower grade of use in the area because of the pro- posed R -3 zoning in the future; it is what the Commission likes to see in the area due to existing circumstances; that the front lot line by decided upon by the Planning Director and then brought to the Commission for proposed development, that the one year time limitation be a condition for issuance of building permits and commencement of construction, and that the 25 feet needed for widening of Baldwin Avenue be dedicated for that purpose. RESOLUTION NO. 65 -1 OPC: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING A VARIANCE IN ZONE VARIANCE CASE NO. 65 -159. Title to Resolution No. 65 -160PC was read by Assistant City Attorney Flandric;;. A motion was made by Commissioner Briggs to waive further read- ing and adopt. Motion seconded by Commissioner Garvin and carr- ied by the following roll call vote: AYES: Commissioners: Beckley, Briggs, Garvin, Johnston NOES: Commissioners: None ABSENT: Commissioners: Clemson 9. COMMUNICATIONS a. Assistant City Attorney Flandrick presented Ordinance No. 65 -168 to the Commission for their review and possible adoption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADDING SECTIONS 1822 AND 1915 TO THE TEMPLE CITY MUNICIPAL CODE, RELATING TO PLANNING COMMISSION PROCEDURE. 1 Planning Commission Minutes Page Seven June 22, 1965 A motion was made by Commissioner Beckley that the Planning Commission recommend to the City Council the adoption of Ordinance No. 65-168. Motion seconded by Commissioner Garvin and carried by the following roll call vote: AYES: Commissioners: Beckley, Briggs, Garvin, Johnston NOES: Commissioners: None ABSENT: Commissioners: Clemson 10. ADJOURNMENT: A motion was made by Commissioner Garvin that the meeting be adjourned to the next regular adjourned meeting July 12th at 7:00 P.M. in the North Meeting Room.
