A RESOLUTION OF THE TOWN OF FRASER, COLORADO PROVIDING FOR TEMPORARY
RELIEF FOR BUSINESSES FROM CERTAIN REQUIREMENTS OF CHAPTER 19 OF THE
TOWN CODE RELATING TO ZONING REQUIREMENTS.
WHEREAS, the Board of Trustees of the Town of Fraser, Colorado, pursuant to
Colorado statute, is vested with the authority of administering the affairs of the Town of Fraser,
Colorado; and
WHEREAS, on March 10, 2020, Governor Jared Polis, by Executive Order, declared a
statewide disaster emergency due to the presence of COVID-19 in the State of Colorado. The
Executive Order identifies the potential for community spread, and, activates disaster response
and recovery efforts applicable to state, local and intergovernmental disaster emergency plans;
and
WHEREAS, on March 11, 2020, the World Health Organization declared COVID-19 a
global pandemic; and
WHEREAS, on March 13, 2020, President Donald Trump declared a national
emergency in response to COVID-19; and
WHEREAS, on April 1, 2020, the Fraser Board of Trustees declared that there exists in
Grand County and the Town of Fraser a disaster emergency; and
WHEREAS, on April 27, 2020, Governor Jared Polis, by Executive Order, declared the
State has entered the Safer-at Home phase of recovery; and
WHEREAS, on May 13, 2020, Grand County Board of County Commissioners submitted
a written application to CDPHE to seek a variance from the state's "Safer-at-Home" public
health order to allow businesses to begin reopening; and
WHEREAS, the Board of Trustees recognizes that Fraser restaurants, brew pubs,
taverns, bars, and similar establishments have been hard hit by COVID-19 and there is a
growing need to reopen them to get back to work, collect sales taxes, begin to rebuild tourism,
and uplift the community; and
WHEREAS, given the challenges these businesses face and their importance to our
community, the Board of Trustees would like to provide these businesses temporary relief from
certain requirements of the Land Development Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of the Town of Fraser,
Colorado as follows:
1. Existing restaurants, brew pubs, distilleries, and similar establishments that are
authorized by state or county health orders to begin reopening are encouraged to
consider expanding their outdoor seating areas and the parking requirements are
temporarily suspended to allow use of those areas for outdoor seating. Outdoor seating
areas shall be clearly delineated from parking areas.
2. The requirements of the Town Code as relates to temporary signage for existing
businesses are temporarily suspended provided that such signage does not obstruct any
public sidewalk, trail, or street.
3. Businesses are encouraged to contact Town Staff for assistance with any proposals that
may assist with reopening in compliance with the guidelines of state or county health
orders.
4. Staff is hereby directed to work with county and state entities to facilitate other provisions
that may assist businesses with reopening in compliance with the guidelines of state or
county health orders (such as relaxation of state liquor law requirements relating to
modification of premise).
5. After the expiration of the provisions of this resolution, businesses must comply with any
requirements of the Town Code that have been temporarily suspended.
The provisions of this resolution shall expire on October 15th, 2020, unless extended or
otherwise amended by the Fraser Board of Trustees.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
on the 20th day of May 2020.
