HomeMy Public PortalAboutResolution 2020-06-01 Approving Monor Subdivision Final Plan and Conditional Use Permit For Retreat at Ptarmigan TOWN OF FRASER RESOLUTION NO. 2020-06-01 A RESOLUTION APPROVING THE MINOR SUBDIVISION, FINAL PLAT AND CONDITIONAL USE PERMIT FOR RETREAT AT PTARMIGAN - REPLAT OF LOT B, THE ROCKIES AT PTARMIGAN TOWNHOMES, RECORDED AT RECEPTION #2008-005666, A PART OF THE NORTHWEST QUARTER OF SECTION 20, TOWNSHIP 1 SOUTH, RANGE 75 WEST OF THE SIXTH PRINCIPAL MERIDIAN, TOWN OF FRASER, COUNTY OF GRAND, STATE OF COLORADO WHEREAS, at a regular meeting of the Fraser Planning Commission held on May 27, 2020, Michael and Stephen Brack were present, requesting a recommendation of approval for a Minor Subdivision Final Plat and Conditional Use Permit for Retreat at Ptarmigan; and WHEREAS, Modern Mountain Homes LLC is the current owner of said property, represented by Michael and Stephen Brack; and WHEREAS, the owners are proposing to subdivide and replat Lot B into Retreat at Ptarmigan Lot 1 and Lot 2 and construct one single family structure on Lot 1; and WHEREAS, the application is also being processed as a Conditional Use in accordance with Section 19-2-270 (d) of the Fraser Municipal Code, which allows for reduced lot size, width, setback and/or floor area for a residential dwelling subject to certain provisions; and WHEREAS, the Planning Commission has determined that this use complies with the necessary criteria specified in the Code; and WHEREAS, the Planning Commission has considered other factors in regard to the proposed use and has determined that such use fits in well with the existing land uses in the immediate vicinity and will not have a negative impact on the neighborhood; and WHEREAS, the Fraser Planning Commission recommended approval of the Minor Subdivision, Final Plat and a Conditional Use Permit for the Retreat at Ptarmigan Minor Subdivision with conditions. THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO THAT THE TOWN BOARD HEREBY APPROVES THE ABOVE DEVELOPMENT APPLICATION WITH THE FOLLOWING CONDITIONS: 1. Add total square footage of"Lot B" to final plat. 2. Delete Dave Barker from Dedication and revise with Michael Brack. 3. Add "lot" to plat note #11 after the word "reduced" relating to Section 19-2-270(d). 4. Correct the spelling of current in plat note #12. 5. Add access easement across Lot 2 to allow for better driveway access for Lot 1. 6. Payment of all applicable fees. 7. Execution of all documents. 8. Provide 911 mylar and electronic copy of the plat in accordance with the Subdivision Regulations. APPROVED AND ADOPTED THIS 3rd DAY OF JUNE, 2020.
