This document, if a development regulation or amendment thereto, has been filed with the
Middlesex County Planning Board as per the Municipal Land Use Law, Chapter 291, Laws
of New Jersey 1975, C.40:55D -16, as amended, which reads in part:
Development regulations, except for the official map, shall not
take effect until a copy thereof shall be filed with the county
planning board. A zoning ordinance or amendment or revision
thereto which in whole or in part is inconsistent with or not
designed to effectuate the land use plan element of the master
plan shall not take effect until a copy of the resolution required
by subsection 49 of the act (C.40:55D -62) shall be filed with
the county planning board.

This document, if a master platil,, master plan element, or revision thereto, has been filed
with the Middlesex County Planning Board as per the Municipal Land Use Law, Chapter
291, Laws of New Jersey 1976, C.40:66D -13, as amended, which reads in part:
(3) Notice by personal service or certified mail to the county
planning board of (a) all hearings on the adoption, revision or
amendment of the municipal master plan at least 10 days prior
to the date of the hearing; such notice shall include a copy of
any such proposed master plan, or any revision or amendment
thereto; and (b) the adoption, revision or amendment of the
master plan not more than 30 days after the date of such adoption,
revision or amendment; such notice shall include a copy of the
master plan or revision or amendment thereto,
We understand these regulations to mean that, unless zoning ordinances and master plans
as amended are filed with the county, they do not have legal effect.

AMENDING AND SUPPLEMENTING CHAPTER 160
ENTITLED
"DEVELOPMENT ORDINANCE OF THE BOROUGH

BE IT ORDAINED by the Mayor and Borough Coun-
cil of the Borough of Carteret (the "Borough ") as
follows:
Section 1 Article XVI, §160 -138 "HFA Heavy Indus
trial Zone regulations" is hereby amended to de
New Jersey Uniform Fire Code, or
as currently enacted or as may be

Section 3 Article XV1,§160 -3 "Definitions' Is hereby
amended and supplements as follows:
HAZARDOUS MATERIALS- Any material that Is de-
fined delineated and /or designated as hazardous
by the National Fire Protection Agency the New
Jersey Uniform Fire Code, and OSHA 29, as
currently enacted or may be revised from time to
time.
Section 4 Followine the Introduction of this Ordi-
ice to the Middlesex County

ing of the Council of the Borough of Carteret held
June 5, 2003 when it was adopted on First Reading.
The said ordinance will be further considered on
Second Reading for final adoption at a meeting of
said Council of the Borough of Carteret on July 1)0
2003 at approximately 7.00 P.M., Municipal
Court /Police Facility, 230 Roosevelt Avenue, Car-
teret, New Jersey at which time and place all
c ersons interested will be given an opportunity to
e heard.
