Dear Ms. Taylor:
Reference is made to the captioned document which I received by regular mail on
August 23, 2017.
In connection with the attached, I make two inquiries regarding the "Non -Ad Valorem
Assessment". They are as follows:
What is the basis for providing Utility Assessment? If there is a code or an
ordinance which the Town asserts that I have the obligation to make the payment
for, I would ask that you provide a copy to me.
2. As to the "Garbage Services", please let me know if I were to obtain a private
garbage service company would the fee still apply? If so, I'm assuming that it
would be an obligatory fee. If I am wrong, please correct me in that regard.
Otherwise, I would appreciate it if you could send me any code or ordinance
requiring me to use the Garbage Services as shown on the attached.
Should you be unwilling to respond to the inquiries in this letter as a matter of courtesy
and in response to a Town resident/taxpayer asking the Town officers for an explanation,
please accept this letter as a Records Request under Chapter 119 of the Florida Statutes.

Dear Mr. O'Boyle:
Before I answer your two questions, I must point out that the
reference at the top of your letter refers to your 112017 Notice of
Proposed Property Taxes for Lot 2 in Hidden Harbour Estates" but the
document you enclosed with the letter is the 2016 Notice of Proposed
Property Taxes for your Lot 5, where you reside. However, my answer
will apply to both properties.
1. The Utility Assessment covers the undergrounding project
that is underway. Property owners voted in favor of the
project in 2011, Public Hearings were held and proper
Resolutions were adopted, which you can find on line.
2. The Garbage Service is a charge from the Solid Waste
Authority, not the Town, for waste disposal, not waste
collection.
There is no charge for this information since there was no research
involved. These methods of collection have been in place for
many years through the Florida Statutes.
