Member missing : William Hoag Also Present : The Chair read the Recording or Taping Notification : "As required by the Open Meeting Law we are informing you that the Town will be audio and video taping this public meeting . APPROVAL of MINUTES : August 13, 2019 MOTION by Patricia Eggers to APPROVE Minutes of 94349 as corrected , Second by Susan McShane, VOTE : 6-0- 0 2 . 19 - 27 Jared T. and Amy Noering, ( Represented by J . M . O'Reilly & Associates), 34 Red Wing Cartway, MAP 69 LOT 79, in the RM zoning district. The applicant seeks a Special Permit under MGL 40A § 6 and Brewster Zoning Bylaw 179-25 to remove the existing dwelling and construct a new dwelling on the property. Members hearing this application : Patricia Eggers, Arthur Stewart, Jeanne Kampas, Susan McShane and Brian Harrison . Mr . John O 'Reilly ( representing the Noering's gave an overview of the application . • As noted in cover letter of August 7 , 2019 ; located in the RM zoning district, applicable setbacks 1971 ANR creation • 1967 original cottage • 1988 remodeled with ZBA permit ( 191ml27 ) • Conservation has heard this applicant and is writing Order of Conditions (This has been received On 09 - 19 - 19 • Total lot upland 17 . 7 existing , 22 . 8 proposed ( meets 25 % of lot coverage) Demolishing existing home • Change topography with drive under garage • Photos and plans provided • Pre-existing ZBA MINUTES 9- 10 - 19 9/ 19/2019 11 : 35 AM Page 1 of 2 • NOT within Conservancy Soils area BOARD QUESTIONS • Comfortable with John 's calculations regarding retaining wall • RE : Spa ; adds 15 . 4 coverage Cupola : added to break up the mass elevation • Make sure it meets height requirements, weathervane exceeds height ( it can be removed ) • Please submit a copy of 1971 ANR Preexisting , nonconforming Won 't matter if demolishing Board Member questioned if this should be a Variance because of the 1971 ANR . The Zoning Agent didn 't question this . • Nothing has been received from abutters • Widows walk is an unusual feature in this area in Brewster • Mr. O'Reilly indicated this widows walk will be used to sit outside FURTHER DISCUSSION Variance or Special Permit seems to be a question NOT trying to change the use Prior owner had a strict Variance TO BE LOOKED INTO . . . Ryan (Town Planner) will ask Victor to look into " 2 unique rights" Or rely strictly on Victor's project review ZBA members would like Ryan to run this by Tow Counsel Applicant asked for a CONTINUANCE to our next scheduled meeting, OCTOBER8, 2019 • One member will not be available at that meeting , we will ask member absent tonight to review Material , watch the video of meeting and sign a MULLEN document.
