INFORMAL BID FOR CONSULTING SERVICES AND CONSTRUCTION OF 'THREE MUIVICIPAL PARKING LOTS LOCATED AT 3320 SANBORN AVENUE, 11228 LONG BEACH BOULEVARD, AND 5150 IMPERIAL HIGHWAY Comments: Construction of three municipal parking lots located at 3320 Sanborn Avenue, 11228 I Long Beach Boulevard, and 5150 Imperial Highway, will greatly enhaace the viability � of three of the City's commercial areas. Development of these lots will be expedited I through the use of consultant design services and through the utilization of the � informal bid process. � Recommendation: I Staff respeafully requests that after consideration, the City Council adopt the attached resolution authorizing staff to obcain consultant design semces and authorizing staff to utilize the informal bid process for the construttion of three municipal pazking lots. 15. Tree of Life - Youth Trainee and Positive Motion - Youth Trainee, dated March 31, 1994 c. City of Lynwood, dated April 19, 1994 Recommendation: It is recommended that the City Council approve the Warrant Registers. DISCUSSION ITEM 17. RENEWAL OF MOTION CONCERMNG TI�. APPEAL OF PLANIVING COMMISSION ON VARIANCE NO. 27 AND CONDITIONAL USE PERMIT NO. 140, PERMITTTNG THE SALE OF BEER AND WINE AT 10910 LONG BEACH BOULEVARD Comments: To allow the City Council to reconsider a motion made at the Council's regularly scheduled meeting of April 5, 1994 (agenda item 9) to uphold an appeal of Planning Commission actions granting Variance No. 27 and Conditional Use Permit No. 140 permitting the sale of beer and wine in an established wholesale grocery store at 10910 Long Beach Boulevard and act on that motion if so desired. Recommendation: Pursuant to Council direction, in order to allow reconsideration of the subject case, staff respeafully requests that, after consideration, the City Council: a. Resolve to renew the motion to uphold the appeal of the Planning Commission ' aaion granting Variance No. 27 and Conditional Use Permit No. 140 and aa on that motion. b. If the motion is approved, resolve to uphold the appeal of the Planning Commission action granting Variance No. 140 and adopt the attached resolution in support of the appeal. 18. COMMISSION VACANCIES Commentr. a. Two Youth Commissionen have had at least three absences in the cvrrent year. In addition, another Youth Commissioner hu verbally resigned. Youth Commission Applications have been submitted by Emily Gonzales and Andre Combs, asking for Council consideration for appointment. b. A Community Developmenc Block Grant Advisory Board Commissioner has been absent three times during the current year. I 5 j ! � ' � LYNWOpD CITY COUNCIL, APRIL 5 1994 The City Council of the City of Lynwood met in a ReguIar Session in the City Hall, 11330 Bullis Road on the above date at 7:33 p.m. Mayor Richards presiding. Councilmembers Byrd, Heine, Henning, Rea and Richards answered the roll call. Also present were'City Manager Gonzales, Interim City Attorney Rudell, City Clerk Hooper and City Treasurer Pygatt. City Clerk Hooper announced the Agenda had been duly posted in accordance with The Brown Act. It was then moved by Councilmember Rea, seconded by Councilmember Henning and carried to approve the following minutes: a) Regular Meeting, March 15, 1994 ' It was then moved by Councilmember Byrd, seconded by Councilmember Rea and carried to recess to the Lynwood Redevelopment Agency and Lynwood Information Inc. at 7:34. Council reconvened at 9:08. PUBLIC HEARINGS � Mayor Richards introduced the first Public Hearing, Appeal of Planning Commission Action Granting Variance No. 27 and Conditional Use Permit No. 140. It was moved by Councilmember Henning, seconded by Councilmember Rea and carried to open the Public Aearing. Arturo Reyes 11149 Carson Dr. stated he had consistently heard negative comments on this portion of Long Beach Blvd. Spoke in opposition to CUP �140. Donald Alvarado, Vice President and General Counsel of Smart & � Final questioned appeals submitted by Councilmembers. Also introduced Ralph Vasque2, Store Manager, Chuck Vanderqriff-Area � General Manager and Employees present in support of the store. I Stated Smart & Final usually services caterers, business owners � and restaurant owners. Stated Smart & Final had aqreed to all � recommendations set forth by the Planning Commission. Adolph Lopez-11431 Plum St., spoke regarding the City Code which is clear on the footage distance between establishments that sell alcohol. Spoke in opposition to CUP 140. � I Ezequiel Vallejo, owner of Mkt. spoke in opposition to CUP #140, stated information relative to the city code and distance restrictions. Carmen Mendoza spoke in opposition to CUP �140. Ralph Vasquez, Smart & Final Store Manaqer spoke of his involvement with the City. Also spoke in favor of CUP �140. Stated his intention is to keep taa dollars in the City. i I Maurice Horton spoke in favor of CUP ,�140. � � Hearing no further discussion, it was then moved by Councilmember I Rea, seconded by Councilmember Byrd and carried to close the Public Hearing. i Councilmember Rea discussed the cities zoninq ordinance which � prohibits alcohol sales within a specified distance of existing establishments which sell alcohol. Stated there is no history of 1 �a,�c. t� I , � � zoning enforcement by Smart & Final, no permits for fencing, and questioned problems with criminal activity. Stated there are already enough liquor establishments within the city. Stated he is opposed to CUP �140. It was moved by Councilmember Henning, seconded by Councilmember Rea to consider overturning the decision of the Planning Commission: Councilmember Henning stated he has no feelings of negativity towards Smart & Final, however, is not in favor of the sale of alcohol. Liquor Store owner and Merchants have agreed to a limitation of liquor establishments. Does not see any justification in allowing a new liquor establishment. Councilmember Heine stated he is personally opposed to alcoholic beverages, however is aware of other occasions for distance variances. Councilmember Byrd spoke regarding the alcohol only being sold in large lots. Questioned the refrigerated kegs. Mr. Alvarado stated current conditions allow the refrigeration of keg beer, however will pull this if so required. Smart & Final is trying to offer a convenience to their current clientele. Mayor Richards questioned the vote by the Planning Commission and asked what the rationale was behind the vote. Director of Community Blumenfeld stated unusual circumstances regarding wholesale establishments -v- liquor establishments was considered. Mayor Richards stated he wanted to look at this fairly. The . issue appears to be competition, also stated every community � `requires stable facilities. He has a commitment to continue to ; work with the business owners, however, feels it would be unfair j not to give this one business every opportunity. � Interim City Attorney stated the motion on the floor is to I reconsider the Planning Commissions decision. Suggested changing the motion to one of two forms either to uphold the appeal and I overturn the action taken by the Planning Commission or deny the I appeal and uphold the action of the Planninq Commission. (See attached map, Exhibit A) OBJECTIVE: To have the City Council adopt a resolution declaring the existence of a public nuisance and directing the abatement of said nuisance. FACTS• - 1. On March 15, 1994 the City Council adopted a resolution declaring the intention to conduct a public hearing on April 19, 1994, to determine if a public nuisance is being maintained at 12501 Mannette Place, pursuant to provisions of Chapter 3-13.1 of the Lynwood Municipal Code. 2. Chronology of events is as follows: 12-14-93 Discussed case via phone with Sol : Blumenfeld, Community Development Director. City Prosecutor will send letter giving seven days to remove the vehicles from the unpaved area and submit release/authorization for the City to clean up site. ' Items will be faxed directly to Sol Blumenfeld and a copy will then be given to Code Enforcement staff. 12-16-93 City Prosecutor and Sol Blumenfeld met ' regarding site. Release was modified. ' 01-16-94 Office conference with City Prosecutor. Will research abatement procedures and review case. 02-01-94 It was administratively decided to proceed with a nuisance abatement as previous legal case at the site was not treated in a positive way by the judicial system. BACRdROUND• Staff has received innumerable �omplaints regarding the conditions at this site. All attempt to obtain compliance from the property owner have been unsuccessful. It is apparent that the property in its current state is in violation o# the Lynwood Municipal Code and its present accumulation of junk, trash and debris, excessive overgrown vegetation and inoperable vehicles in the front setback of the site presents a potential hazard to the City and its reaidenta. NOW, THEREFORE, the City Council of the Ciry of Lynwood does . hereby find, determine, order and resolve as follows: Section 1. The property described as Parcel 6186, Lot 015, Page 043, generally known as 12501 Mannette Place, in the Ciry of Lynwood, California, is hereby found and declared to be a public nuisance as defined in Chapter 3-13.1 of the Lynwood Ciry Code. , Section 2. The particular conditions of said properry which are hereby found.and determined to constitute a nuisance are described as follows: • 1. Overgrown vegefation throughout site. � 2. Junk, trash and debris scattered throughout site. , 3. Vehicles parked in front setback and unpaved' area of site. ' Section 3. It is further found and determined that the methods by which said conditions could be abated include, but are not limited to: 1. Remove all the overgrown vegetation at the site, properly dispose of it and i maintain site. � 2. Remove and properly dispose all the junk, trash and debris currentiy at the site and maintain sue clean. 3. Remove all vehicles from the front setback and unpaved area of site. Section 4. The owner of said property, Nancy B. Kotzar is ordered and directed ro take said steps and to abate said nuisance. Section 5. If the property owner fails to take the steps as provided in this resolution within ten (10) days after the date this resolution is posted upon said property, the City of Lynwood shall immediately cause the same to be abated by City - personnel or private contractor and such personnel or persons under contract are expressly authorized to enter upon the premises for such purposes. Section 6. In the event the City of Lynwood causes the . aforementioned nuisance to be abated by Ciry personnel or private contractor, the owner of the premises shall be liable to said City. All said costs shall constitute a special assessment against the subject property. Section 7. The City Clerk is authorized and directed to post conspicuously at least one copy of this Resolution on the sub)'ect property and to send another copy of this Resolution by registered or certified mail, postage prepaid, return receipt requested, to the owner of said land as his name and address appears on the last equalized assessment roll, or as known to the Ciry Clerk. 1 � � � . PURPOSE: To recommend that the City Council adopt the attached resolution authorizing consultant services for and informal bidding of the construction of three municipal parking lots located at 3320 Sanborn Avenue, 11228 Long Beach Boulevard, and 5150 Imperial Highway, BACKGROUND: Staff has prepared preliminary plans for the subject properties for construction of three municipal parking lots in Redevelopment . Project Area "A". The parking lots wi21 provide surface parking for up to 82 cars and contain perimeter landscaping and lighting. On .December 21, 1993 the Agency authorized staff to prepare preliminary plans and cost estimates to construct the subject lots � which are located in Redevelopment Project Area "A". Staff has been working with business and property owners within Project Area "A" in connection with the City's Commercial Rehabilitation program. During the course of marketing the program, it was noted by many business and property owners that the commercial corridors are severely undersupplied with parking. ia order to carry out a successful commercial rehabilitation • program it is necessary to work with business and property owners to assist in the provision of needed off-site parking facilities. The City's parking standards can.be satisfied with alternative ' parking arrangements which locate parking in proximity to shops and businesses along commercial corridors. Staff is currently working within two target areas of the City's Commercial Rehabilitation Program which provide the opportunity to supply needed off-street parking at three sites. The property located at 5150 Imperial Highway is privately owned and would require lease arrangements with the property owner and the properties at 3320 Sanborn Avenue and 11228 Long Beach Boulevard are Agency-owned. All three properties are poorly maintained and their improvement will upgrade the adjacent neiqhborhood while providing necessary area parking. ANALYSIS: It will take approximately four weeks to prepare construction drawings and four weeks to construct the parking lots, Zn addition it will be necessary to order materials signing and lighting for the projects. Therefore, in order to expedite the projects the City . can informally bid consultant services and construction of the projects. The cost to construct the parking lots is estimated at approximately $180,000 and the City can more economically and expeditiously carry out the projects if done through informal bids. • �6mOl ITDI . ! • Under Section 6-3.13 of the. Lynwood Municipal Code, City Council can authorize purchases through informal bids by a 4/5 votes. ' A lease for the property located at 5150 Imperial Highway is currently being negotiated with the property owner who has expressed interest in leasing the parking area. Staff will bring •� the proposed lease to the Redevelopment Agency for consideration , upon completion of negotiations. The requested action would authorize an informal bid process for the purpose of expediting the project. Upon receipt of bids staff would return to Council with recommendations for contract award. RECOMMENDATION Staff respectfully request that after consideration, the City - Council adopt the attached resolution authorizing consultant services and informal bidding for three municipal parking lots through an informal bid procedure. Wholesale Grocery Store at 10910 Long Beach Boulevard. � PURPOSE To allow the City Council to reconsider a motion made at the Council's regularly scheduled meeting of April 5, 1994 (Agenda Ztem 9) to uphold an appeal of Planning Commission actions granting Variance No. 27 and Conditional Use Permit No. 140 permitting the- sale of beer and wine in an established wholesale grocery store at 10910 Long Beach Boulevard and act on that motion if so desired. BACKGROUND: At their regularly scheduled meeting of April 5, 1994, the City Council held a public hearing on an appeal brought by Councilman Rea of a Planning Commission action to permit the off site sale of beer and wine at a wholesale grocery°store (Agenda Item 9). • After testimony was taken and the public hearing was closed, the ' Council considered a motion to uphold the appeal. No action was taken on that motion due to a tie vote - two Council members in favor, two'opposed and one abstention. " At the conclusion of the Agenda, Mayor Richards indicated his desire to change his vote on Agenda Item 9. The City Attorney indicated that he would research if the vote could be changed and would report back, as he had determined that a motion to reconsider � could not be made as there was no prevailing side. ANALYSIS: The City Attorney has determined that the proper procedure to follow in 'this s,ituation is to "renew" the motion. This is an accepted parliamentary procedure that allows.a legislative body to. ,. again vote on a motion that failed to receive sufficient votes for passage when it was last considered. The motion is renewed by making the same motion again. The City Attorney has advised that in ordeT to reconsider and take � action on this item, a motion to renew the motion concerning Agenda Item 9 should be placed on the April 19, 1994 Agenda, and that the original applicant, Smart and Final Store, Inc. be informed of this action.
