COMMUI�tITY DEVELOPMENT BLOCK GRANT APPLICATION FOR FISCAL YEAR 1994-95 Comments: � The purpose of this item is to request that the City Council conduct a public hearing to obtain citizen input on the CDBG Statement of, Objeaives and Projeaed Use of ' Funds for the 199495 program year; and after consideration of recommendations by the CDBGAB Commission and citizen_input, adopt the attached resolution approving " the Final Statement of Objecties and Projeaed Use of Funds for Fiscal Year 1994-95. ACCEPTANCE OF TREE MAINTENANCE PROJECT - AREA 1, FY 1993-94 ` Comments: The Tree 1VIaintenance Project Area 1 for FY 1993-94 has been completed in accordance with contract documents. Recommendation: ' It'is recommended that the City Council adopt the attached resolution accepting the Tree Maintenance Project, Area 1, FY 1993-94, as complete. 13. SPECIAL PERMIT Commentr. , An application for special permit has been submitted by the Church Soldiers of the Cross for the purpose of religious solicitation and to raise funds at places open to the public. Recommendation: It is recommended that City Council review and approve the above request for special � permit. . 14. STATUS UPDATE ON CDBG REHABILITATION PROGRAM ACTIVITIES - Comments: The rehabilitation and preservation of residential housing is one of the eligible activities permitted and encouraged under the Community Development Block Grant Program (CDBG). The City Council•initially authorized the use of CDBG funds to estabiish , a residential rehabilitation program on November 2, 1975. The subject report provides a status of the City's efforts currently. Recommendation: - Staff respectfully requests that after consideration, the City Council receive and file this lnformation. 15. COMMISSION VACANCIES Comments: a. A Community Development Block Grant Advisory Board Commissioner has , been absent three times during the current year. This item was held over at the Gouncil regular meeting of April 19, 1994, when Council asked staff to contact Commissioner Ventura and request documentation justifying the absences. ' Commissioner Ventura has verbally requested that Council be given a copy of , her 1991 request for appointment. b. Two Youth Commissioners have had at least three absences in the current yeai. In addition, another Youth Commissioner has verbally resigned. Youth Commission Applications have been submitted by Emily Gonzales, Andre Combs, and Jennifer McZeal, asking for Council consideration for appointment. This item was held over at the Council regular meeting of April 19, 1994. � c. The terms of two Personnel Commissioners expire in May, 1994. Both Patrice Bell and Kent Swik have submitted letters requesting consideration for reappointment. Recommendation: It is recommended that City Council nominate and appoint: a. One new member to the Community Development Block Grant Advisory Board Commission. b. Three new members to the Youth Commission. c. • Two new members to the Personnel Commission. 17. RENEWAL OF MOTION AND ACTION ON MOT'ION TO UPHOLD THE APPEAL OF PLANIVING COMMISSION ACTION TO APPROVE VARIANCE NO. 27 AND CONDITIONAL USE PERMIT NO. 140, PERMITTING THE SALE . OF BEER AND WINE IN AN ESTABLISHED WHOLESALE GROCERY STORE ; AT 10910 LONG BEACH BOULEVARD Comments: To allow the City Council to reconsider a motion made at the Council's regularly scheduled meeting of April 5, 1994 (agenda item 9) to uphold an appeal of Planning _. Commission accions granting Variance No: 27 and Conditional Use Permit No. 140 permitting the sale of beer and wine in an established wholesale grocery store at 10910 Long Beach Boulevard and act on that motion if so desired. Adolph Lopez questioned warrants and payees. Also urged Council to uphold the appeal on Smart & Final in order to help reduce any - additional bad elements within our city. Also spoke reqarding • commissioners and absences from meetings. ` Donald Alvarado-4700 S. Boyle Ave. Los Angeles, Vice-President ' and General Counsel for Smart & Final, questioned why the appeal had been resubmitted. Stated he was under the impression the matter had been laid to rest at the last meeting. Also stated his three reasons for being present tonight. 1) Smart &.Final had already gone through all procedural steps. 2) Create a record in order to explain options to his client. Feels Smart & Final • has rights. 3) Suqgests fairness exist during which a Public Hear.ing is conducted_ Also stated the timing for Smart & Finals' request for beer & wine sales has nothing to do with the racial . population of the city. Dennis Schivley, Senior Vice-President of operations and Real `Estate for Smart & Final. Spoke regarding fairness and stated he did not feel his store had been treated fairly by Council. Jerrell Hunter spoke regarding fairness in the city. Also stated residents need to see a cut-off on liquor establishments. Michael Heriot- South Carolina, spoke reqarding the section of the agenda that deals with Closed Session- Pending Litiqation and Potential Litigation. At this time Mayor Richards request,ed reordering the aqenda in order to take action on discussion item #17 dealinq with Smart & Fina.1. Spoke reqarding the impact to the merchants of the community. Stated he would like to meet with these merchants and discuss their point of view before making his final decision. It was moved by Councilmember Henninq to renew the previous motian as introduced on April 5, 1994 to uphold the appeal of actions by the Planning Commission action granting Conditional Use Permit No. 140 and Variance No. 27. Councilmember Henning requested holding the item until the full council was at the table. Councilmember Heine requested holdinq the item until members of the Council along with the cities Merchants and Smart & Final can meet and discuss the terms of the CUP. Councilmember Henning questioned the time limit remaining in order to take action on this item. ' Znterim City Attorney Rudell stated if no action is.taken by the City Council on the appeal� within twenty-one (21) days after the hearing, then the decision of the Planning Commission stands. 2 � � It was then moved by Councilmember Henning, seconded by Councilmember Rea to renew the previous motion to uphold the appeal on the decision of the Planning Commission grantinq Variance No. 27 and Conditional Use Permit #140. Mr Alvarado stated with permission from the City Council he would agree to a 10 day continuance. Interim City Attorney Rudell stated applicant could waive the right to the twenty-one (21) day stipulation. It was moved by Councilmember Heine, seconded by Councilmember to continue the item with a thirty (30) day extension. Mr. Alvarado stipulated a thirty (30) day extension from any action this evening. It was moved by Mayor Richards, seconded by Councilmember Heine _ to carry this item over to the next regular scheduled meeting. _ Councilmember Henning stated he does not wish to continue this item. Feels action on this item has been delayed long enough. During February of 1994, the City began receiving CDBG . funding proposals for fiscal year 1994-95. . On March 9th, 24th, and April 6, 1994, the Community Development Block Grant Advisory Board (CDBGAB) Commission reviewed and discussed the proposals submitted for CDBG funding. As ', a result of these meetings, recommendations for funding were made. 3. on April 18, 1994, a Special meeting was held by the CDBGAB to conduct a Public Hearing for F Year 1994-95 CDBG Projected Use of Funds. The following programs have been recommended by the Commission for denial of CDBG funding for FY 1994-95: , PUBLIC SERVICES: REQUESTED AMOUNT a. New Testament ChildCare $ 57,330.00 , b. Truevine Homeless Men $ 38,700.00 c. Genesys Academy for Youth $107,500.00 ' a 5. On April 18, 1994, a Public Hearing was held during a special CDBGAB Commission meeting, .in order to allow the public and Commission to review and make recommendations regarding the Proposed Use of CDBG funds for fiscal year 1994-95. During the Public Aearing, the Lynwood Library staff gave a b.rief presentation and answered questions regarding their - proposal.` In,addition, St. Francis provided"a brief ' presentation regarding their proposal. There were no other public comments regarding the City�s Proposed Use of CDBG £unds at the Eublic Hearing. 6. On March 23, 1994, a proposal was submitted by the Lynwood Public Library to request CDBG funding. The Commission agreed to consider funding. However, recommended funding is less than the amount requested. The recommended amount eliminates supplies by $10,000 and staffing, (3 clerks), by ` $7,000. :. 7. On April 13th and 28, 1994, a notice was published in the Ci.ty�s adjudicated newspaper, (the Lynwood Press), regarding the City�s Statement of Objectives and Projected Use of P'unds and Public Hearing (to obtain citizen input). CDBG regulations established by the Department of Housing � and Urban Development (HUD) require that a least one Public Hearing be held to obtain citizen input. e. The City Council may decide,. {at' it's discretion and after obtaining citizens comments), to modify the proposed Statement of Objectives and Projected Use of Funds. Council approval of the Final Statement, which incorporates any changes from the Draft Statement is ' required prior to submittal to HUD. � � � 9. The Department of Housing and Urban Development (HUD) � requires a 30 .day period to review the Statement prior to the approval of CDBG applications. HUD also requires the Final Statement be made available for citizen review prior to submission to HUD. The public review period is ' from April 28, 1994 to May 31, 1994. , 10. The City's 1994-95 CDBG application, which includes the Final , Statement of Objectives and Projected Use of Funds, is required to be submitted to HUD no later than June l, 1994. The three phase plan consists of property acquisition, rehabilitation and construction, which will result in the development of a 77,000 square foot retail center/facility. • This project will stimulate local reinvestment • and facilitate the City�s effort in meeting the ' CDBG National Objectives for low and moderate income residents of the community. The. project under Phase one will initially generate . approximately 30 jobs. PUBLIC ORALS• A Public,Hearing was held on the City's proposed CDBG Projected Use of Funds for FY 1994-95. The Public Aearing , began at 6:25 p.m. Mr. Philip Gray and Dr. Vincent Castro of St. Francis Medical Center gave a brief presentation on the program, (St. Francis ' Program for Non-Compliant Children). The requested amount is $60,000. Mr. Gray stated that there has been an egcessive amount of children (preteens) referred to the Childrens Center who have behavioral problems, which prompted the development of a new • program. Mr. Gray stated that the length of services is approximately 24 weeks. It also includes a 14 week program ' for the parents, and the program has been 80� effective. Mr. Gray stated that the funding, if approved , will cover ' one full time employee. • Commissioner Araujo stated that she contacted the proqram to refer a student and was informed that the back log was at. least 3 months. 1 � � Dr: Vincent Castro, Director of the program, stated that the current status has improved with the addition of staff. However, there is limited space and an effective way to deal with space problems would be to.implement group.therapy . sessions, which are in effect. Commissioner Wibecan asked what would be the effect on the '. program if the City were unable to provide funding. Mr. Gray stated that the treatment would be provided, and the hospital would find fundinq from other sources. ' The Commission thanked Mr. Gray and Dr. Castro for the presentation and answering questions. Rosalie Relleve, of the County Library Enhanced Services provided the Commission with a revised funding request and gave a b=ief presentation. Ms. Relleve stated that the previous proposal submitted to� the Commission was proposing to provide full library � services for one day. However, the revised proposal which request less funding will include circulation services only, which means the library will be staffed with Library Assistants and clerical staff only. Ms Rellev.e stated that it is the Library�s intention to shift Full library services, which includes full staff, from Saturday to Wednesday in order to provide an extra day to the teachers and students. Therefore, If approved the CDBG funding would assist in opening the Library on Saturday which would require less staff. � Commissioner Wibecan stated that the proposal shows 6 positions in the clerical staff and asked if the clerical • staff would assist in finding material. Ms. Relleve stated that 4 of those positions are Library Aids who work behind : the desk, distributing the material, and answer phone questions, etc. The other 2 are Library pages who return the • materials to the shelves. The only person to assist in locating materials would be the Library Assistant. Commissioner Wibecan asked if it would be possible to implement a telephone system to inform the public of Library ' hours and general information, which will require less staff. Ms.` Relleve stated that a system was considered before the budget cuts. However, the funding is not available at the present time to implement such a system. Ms. Relleve �stated that less staff people would be required on Saturday, which is why the Library is considering moving the full service day from Saturday to Wednesday. Commissioner Araujo pointed out that funds were being .r.equested for other services in addition to salaries. How would'those funds be expended. Ms. Relleve stated that those funds would be utilized to purchase new books, videos, _ reference material etc. Commissioner Wibecan asked if the Library accepted used book donations. Background: The rehabilitation and preservation of residential housing is one of the eligible activities permitted and encouraged under the Community Development Block Grant Program (CDBG). The Ciry Council initially authorized the use of CDBG funds to establish a � residential rehabilitatio program on November 2,1975. The Housing Rehabilitation Program was initiated by the City Council to meet the City's goals of providing residents with decent, safe and sanitary housing and a suitable living . environment. The Rehabilitation Program provides technical and tinancial assistance to qualifying owners of residential properties in the City of Lynwood. The primary funding , for the program is through the Community Development Block Grant Program (CDBG). The primary purpose of the CDGB Program under the Tide 1 of the Housing and Community Development Act of 1974, as amended, is the development of viable communities by enhancing local housing and economic opportunites principally for persons of low or moderate income: , The Housing Division is currently focusing on several azeas of home improvement: Over � the past three years the Housing Division has rehabilitated an average of 17 units per year which has resulted in approximately 51 total units rehabilitated in the City. Thus the Housing Division is currendy processing approximately three times the number of loans aad grants it had been processing in 1991. The Rehabilitadon Program offers qualifying property owners financial assistance in the form of Senior Cidzen Grants. Emergency � Grants and Deferred Payment Loans During the Fiscal Year 1992-93, the Housing Division completed twelve Senior Citize❑ ` grants, four Emergency Grants and ten Deferred Payment Loans. In addition, the ' Housing Division has computerized all the forms to facilitate the rehabilitation process and ensure proper dowmentaUOn pursuant to HUD guidelines I i , Technical assistance is provided by program staff to qualifying applicants in loan � • counseling, code compliance, property rehabilitation, azchitectural design, prepazation of I cost estimafes, preparation of bids and contracts, selection of contractors and construcuon monitoring. During the second quarter of 1993 the Housing Division was reorganized. New staff was hired and a new innovative marketing strategy was implemented which consisted of a newsletter that was sent out to owners of single family homes informing them of the program and a brief detail of the qualifying guidelines. As a result, the City received in ' excess of sixty applicadons which are currently being processed. �0�0� TS� � , i � � . The kinds of renovation work undertaken through the Program include the replacement or repair of major and minor Code items such as roofing, plumbing, electrical, heating and foundation and pest extermination. The Program also provides housing preservation through the repair or replacement of remodeled kitchens, new doors, screens and windows, carpet installation, bedroom and bathroom additions, new fencing or fencing repairs and interior and exterior painting. The improvements range in cost from $3,000.00 to $20,000.00 and have substantiaily improved the housing of residents participating in the Program.(Please see attached typical project photos.) CURRENT STATUS: ,, During ,the £irst quarter of Fiscal Year 1993-94 the Housing Division completed thirty three Defe�ed Payment toans and Emergency Grants.The City has received twenty . seven Emergency Grant applications and Senior Citizen Grant applications which are being processed. PURPOSE To allow the City Council to reconsider a motion made at the Council's regularly scheduled meeting of April 5, 1994 (Agenda Item 9) to uphold an appeal of Planning Commission actions granting Variance No. 27 and Conditional Use Permit No. 140 permitting the sale of beer and wine in an established wholesale grocery store at 10910 Long Beach Boulevard and act on that motion if so desired. BACKGROUND: At their regularly scheduled meeting of April 5, 1994, the City Council held a public hearing on an appeal brought by Councilman Rea of a Planning Commission action to permit the off site sale of tieer and wine at a wholesale grocery store (Agenda Item 9). After testimony was taken and the public hearing was closed, the I Council considered a motion to uphold the appeal. No action was taken on that motion due to a tie vote - two Council members in favor, two opposed and one abstention. At the conclusion of the Agenda, Mayor Richards indicated his desire to change his vote on Agenda Item 9. The City Attorney indicated that he would research if the vote could be changed and would report back, as he had determined that a motion to reconsider could not be made as there was no prevailing side. � i At the Council meeting on April 19, 1994, pursuant to advice from � the City Attorney, an item was placed on the Agenda (Item 17) to renew the motion concerning the Appeal of Variance No. 27 and Conditional Use Permit No. 140. After discussion, and upon concurrence by the applicant, the Council determined to continue action on the motion to renew until after a meeting could be held � with the members of the Southern California Beverage Merchants � Association and other concerned beverage retailers. � � 1►NALYS I S : � The City Attorney has determined that the proper procedure to I follow in reconsidering Council action on this appeal is to "renew" I the motion. This is an accepted parliamentary procedure that � I allows a legislative body to again vote on a motion that failed to receive sufficient votes for passage when it was last considered. I The motion is renewed by making the same motion again. i On advice of the City Attorney, a motion to renew the motion I concerning Agenda Item 9 was placed on the April 19, 1994 Agenda (Item 17), and the original applicant, Smart and Final Store, Inc. . was informed of this action.: � � � I � I I � � _ At the April 19, 1994 meeting, and �with the concurrence of the ' original Applicant, Council voted to continue consideration of the motion to renew until after a meeting was held with member's of the Southern California Beverage Merchants Association and other ' concerned beverage retailers. " On Apri1 26, 1994 a meeting was held, chaired by Mayor Richards and attende3 by Councilman Heine and City Manager Gonzales, with a number of beverage retailers. Mayor Richards indicated that this meeting was not to discuss legal or technical details but to give members of the community further opportunity to voice their concerns. The group discussed in general the problems associated with operating.small liquor stores and grocery stores that sell beer and _ wine. There was concern about the impact of additional competition" and the participants emphasized the contributions that small ' retailers make to the community. , Since the meeting with the beverage retailers has been held, the ' Council may wish to consider the motion to renew the previous • motion. `If that motion passes Council should act on the previous motion to uphold the' appeal of the Planning Commission action (approvinq Variance No. 27 and Conditional Use Permit No. 140), This will rescind the action of the Planning Commission. In the event that City Council votes to uphold the appeal, staff _ has prepared a-resolution in support of Council action. RECOMMENDATIONS: Pursuant to Council direction in order to allow reconsideration of the subject case, Staff respectfully, requests that, after ' consideration, the City Council: 1.
